To enable Persons holding Licenses to sell Beer, Spirits, and other Exciseable Liquors in Scotland, to obtain a Renewal of their Licenses from the Excise.

HEREAS

Whereas an Act was passed in the sixth year of the Preamble.

reign of his late Majesty King GEORGE the Fourth, inti

tuled, "An Act to repeal several Duties payable on Excise Licenses in Great Britain and Ireland, and to impose other Duties in lieu thereof, and to amend the Law for granting Excise Licenses:"

And whereas another Act was passed in the ninth year of the reign of his late Majesty King GEORGE the Fourth, intituled, "An Act to regulate the granting of Certificates by Justices of the Peace and Magistrates authorizing Persons to keep common Inns, 10 Ale-houses and Victualling-houses in Scotland, in which Ale, Beer, Spirits, Wine, and other exciseable Liquors may be sold by retail under Excise Licenses, and for the better Regulation of such Houses, and for the Prevention of such Houses being kept without such Certificates:"

And whereas it is expedient to alter and amend certain provisions contained in the said recited Acts;

Be it therefore Enacted, by The QUEEN's most Excellent MAJESTY, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and

by the Authority of the same, THAT from and after the passing of
this Act, every person who, under the authority of the said recited
Acts, shall have obtained any Certificate, and upon such Certificate
shall have taken out from the Excise a License enabling such person
to retail Ale, Beer, Spirits, or other exciseable Liquors, and every
person who shall hereafter, under the authority of the said recited
Acts, obtain any Certificate enabling such person to apply for a
License to retail Ale, Beer, Spirits, or other exciseable Liquors, and
shall have applied for and obtained such License, shall be entitled to
require, and it shall be lawful for the proper Officers of Excise 10
authorized and empowered to grant Licenses, in each and every year
hereafter, on the application of such person to renew his License, to
grant and deliver to such person a License authorizing such person
to retail Ale, Beer or Spirits, or other exciseable Liquors for the
ensuing year, without such person being required or obliged to 15
obtain any fresh annual Certificate under the said Act of the ninth
year of his said late Majesty's reign, from the Justices of Peace or
Magistrates of any Royal Burghs, unless a written intimation shali
have been transmitted to such Officers of Excise in terms of the said
recited Act of the ninth year of the reign of his Majesty King 20
GEORGE the Fourth, of such person having been convicted of any
offence in breach of the conditions and terms of their, his or her
Certificate, by which conviction such certificate has thereupon been
adjudged null and void, or unless such person shall have changed
the place where he or she shall have carried on business in the pre- 25
vious year: Provided always, That where any License shall have
during the currency thereof been transferred to any person not the
original holder of such License, such person shall not be entitled
under the provisions of this Act to obtain from the Excise a renewal
of the same without having obtained a Certificate from the Justices 30
of the Peace or Magistrates in terms of the said recited Act of the
uinth year of the reign of King GEORGE the Fourth.

And be it Enacted, That this Act shall not extend to England or Ireland.

And be it Enacted, That this Act may be amended or repealed altered during by any Act to be passed in the present Session of Parliament.

HERCAS by an Act passed in the second and third Preamble: years of the reign of his late Majesty King WILLIAM the Fourth, intituled, " An Act to repeal the Duties, under the Management of the Commissioners of Stamps, on Stage Carriages, and on Horses let for Hire in Great Britain, and to grant other Duties in lieu thereof, and also to consolidate and amend the Laws relating thereto," certain Duties contained in Schedule (A.) to the said Act annexed, were granted and imposed, and are now payable for and in respect of every Mile which a Stage Carriage shall be licensed to travel; and 10 amongst the said Duties are the following; (that is to say)

And whereas it is expedient to substitute the reduced rate of Duty hereinafter contained for and in lieu of such of the Duties granted by the said Act as are hereinbefore recited;
