A BIL L For permitting Salmon to be taken with the [Note.-The Words printed in Italics are proposed to be inserted in the Committee.] E it Enacted, by The QUEEN's most Excellent MAJESTY, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, THAT this Act shall come into 5 operation on the Twenty-fourth day of August One thousand eight hundred and Forty. And be it Enacted, That after the expiration of the period at which the Salmon Fishing in the rivers and streams in Scotland shall close, Twenty-one clear days shall be allowed, during which the proprietors 10 of such Fishings may angle with the single rod only for Salmon, Grilse, Sea Trout, or other fish of the Salmon kind; and such proprietors may, by permission in writing, authorize any other person or persons so to angle. 3. selling Salmon. And be it Enacted, That no person shall sell or expose for sale Penalty for 15 any Salmon or Grilse, Sea Trout, or other fish of the Salmon kind, so taken within such period of Twenty-one days; and if any person offend against this Enactment, he shall forfeit for every Salmon or other fish of the Salmon kind so sold or exposed for sale, the sum of Five Pounds. 4. And be it Enacted, That such penalty may be recovered before any small debt court by any person suing for the same; and onehalf of every penalty recovered shall be applied to the use of the informer or party suing, and the other half shall be directed by the Judge to be applied to the relief of the poor, or to be paid, if he think fit, to any charitable institution within the county wherein the conviction takes place. And be it Enacted, That nothing contained in this Act shall be construed to alter any of the laws for the regulation of the Salmon Fisheries in Scotland, further than is enacted by this Act. And be it Enacted, That this Act may be amended, altered or repealed by any Act to be passed during Parliament. this present Session of 5 10 A BILL To amend an Act of the Thirty-ninth Year of the Reign of [Note.-The Words printed in Italics are proposed to be inserted in the Committee.] HEREAS in an Act passed in the thirty-ninth year of the reign of King GEORGE the Third, intituled, "An Act for the more effectual Suppression of Societies established for Seditious and Treasonable Purposes, and for the better preventing Treasonable 5 and Seditious Practices," certain provisions are contained to restrain the printing or publishing of any Papers or Books whatsoever, which should be meant or intended to be published or dispersed without the name and place of abode of the Printer thereof being printed thereon in the manner in the said Act specified : 10 And whereas the said provisions have given occasion to many vexatious proceedings at the instance of common informers, and it is expedient to discourage the same; BE it therefore Enacted, by The QUEEN's most Excellent MAJESTY, by and with the Advice and Consent of the Lords Spiritual 15 and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, THAT so much of the said Act as enacts that every person, who after the expiration of forty days after the passing of the said Act, shall print any Paper or Book whatsoever, which shall be meant or intended to be published or dispersed, 5 whether the same shall be sold or given away, shall print upon the front and 25 And be it Enacted, That every person who after the passing of this Act shall print any Paper or Book whatsoever, which shall be meant 20 to be published, whether the same shall be sold or given away, and who shall not print upon the front of every such paper, if the same shall be printed on one side only, or upon the first or last leaf of every paper or book which shall consist of more than one leaf, in legible characters, his or her name, and usual place of abode or business, shall for every copy of such Paper so printed by him or her, forfeit a sum not more than Five Pounds: Provided always, That nothing herein contained shall be construed to impose any penalty upon any person for printing any paper excepted out of the operation of the said Act, either in the said Act, or by any Act made for the amendment thereof, 30 or any Papers or Books printed by the order or for the use of any Society incorporated or enrolled according to law. And be it Enacted, That it shall be lawful for the Court in which any action shall be tried for the recovery of any penalties under the said Act, or under this Act, or for the Justice before whom any person shall be convicted of any offence against the said Act, or this Act, to reduce the amount of the penalty or sum to be recovered in such manner as to the Court or Justice shall seem fit; and the plaintiff, if he shall recover in any such action, shall not be entitled to costs beyond the amount of the penalties recovered. And be it Enacted, That every person who before the passing of this Act shall have printed any Paper or Book having upon the first or last leaf thereof, in legible characters, his or her name, and the place of his or her dwelling-house, or usual place of abode, in the manner required 5 Leaf. required by the said Act, to be printed upon the first and last leaves of Printer on the every Paper or Book consisting of more than one leaf, shall be freed first or last and discharged from all suits, informations, prosecutions, judgments, fines and penalties whatsoever in respect of such Paper or Book, as fully as if the same had been printed according to the provisions of the said Act. And be it Enacted, That the said Act, and all Acts made for the amendment thereof, except so far as herein repealed or altered, shall be construed as one Act together with this Act. 6. And be it Enacted, That this Act may be amended or repealed by Act may be any Act to be passed in this present Session of Parliament. amended or repealed. |
