Such agreement Error or Provisions of this act, how to apply. shall be binding upon all persons taking property subject to such tax, except for fraud or manifest error; and executors and trustees are hereby expressly authorized to enter into such an agreement unless a contrary intention shall appear in the instrument defining their powers. Such agreement may, at any time or from time to time after its execution, be modified with the approval of the attorney-general and with the consent of all parties thereto, their successors or assigns, in such manner as may be agreed. Whenever a clerical or palpable error or mistake shall have been made in any inventory or supplemental statement heretofore or hereafter filed with the board of tax commissioners under the provisions of this chapter concerning any matter of information, or in entering amounts or figures, in such inventory or supplemental statement, the board of tax commissioners may assess an additional tax; or may certify a correction to the general treasurer in the amount of any tax assessed in the event that such error or mistake has resulted in an overassessment, and the general treasurer shall receive and collect said tax in accordance with the correction so certified. In case said tax has already been paid into the state treasury the general treasurer shall receive and collect any additional tax assessed as aforesaid, or shall refund any overpayment to the executor, administrator or trustee or to the person by whom the tax was paid without any further act or resolution making appropriation therefor; provided, that not more than two years shall have elapsed from the payment of said tax." SEC. 3. The provisions of this act shall apply to the estates of persons dying hereafter and also to the estates, which are now in the process of administra tion, of persons dying heretofore but after the passage of chapter thirteen hundred thirty-nine of the public laws of 1916, entitled "An act taxing the net estates of decedents and inheritances, legacies and gifts.' SEC. 4. If any clause, sentence, paragraph, section or part of this act shall for any reason be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate any other portion of this act which can be given reasonable effect without the part so adjudged invalid. SEC. 5. This act shall take effect upon its passage, and all acts and parts of acts inconsistent herewith are hereby repealed. CHAPTER 424. [2309] AN ACT IN AMENDMENT OF AND IN ADDITION TO CHAP- 66 OF CANVASSERS AND REGISTRATION AND OF THE It is enacted by the General Assembly as follows: SECTION 1. Chapter 7 of the general laws, entitled "Of boards of canvassers and registration and of the registering, listing, and returning lists of voters and of proof of their qualification to vote," is hereby amended by adding thereto the following section: "Sec. 30. The board of canvassers and registration of the city of Providence shall between the first day of April and the fifteenth day of June in the year 1924, and in each second year thereafter, on such dates as said board may designate, hold at least two registration meetings in each ward in said city of Providence for the purpose of receiving the registration of persons entitled by law to vote in such ward upon being registered, from seven until nine o'clock P. M. Said board shall advertise said registration meetings in one or more daily newspapers published in said city of Providence at least one day prior to said registration meetings." SEC. 2. This act shall take effect upon its passage. CHAPTER 425. [2310] H 945 A. Washington bridge commission, how composed. Vacancy. Officers; quorum. Secretary; compensation. AN ACT CREATING A COMMISSION TO BE KNOWN AS THE WASHINGTON ITS DUTIES. It is enacted by the General Assembly as follows: SECTION 1. Within thirty days from and after the passage of this act the city council of the city of Providence by joint resolution shall appoint two residents of said city and the town council of the town of East Providence shall appoint two residents of said town who, together with the members of the state board of public roads, shall constitute a commission to be known as the Washington bridge commission. Any vacancy in said commission shall be filled in the same manner as the retiring member was originally appointed. Within ten days from and after the time the Providence and East Providence members are appointed said commission shall organize and elect a chairman. Five members of said commission shall constitute a quorum. Said commission is hereby authorized to appoint a secretary who may or may not be a member of said commission. Said secretary not to be interested in contracts. Commission to January, 1924. shall hold office during the pleasure of said commission, and shall be paid a salary at the rate of twentyfive hundred dollars per annum in equal monthly installments in full compensation for his services rendered the state during the time he holds such office. The members of said commission shall serve without compensation; provided, however, that in case a member is chosen secretary of said commission he shall be entitled to receive the salary as herein provided; and provided, further, that nothing herein contained shall in any way affect the salary of any member of the state board of public roads. No Commissioner commissioner shall be directly interested in any contract made pursuant to the provisions of this act. Said commission shall during the month of January, report in A. D. 1924, make a final report to the general assembly of the work entrusted to it, and thereupon said commission shall be discharged and terminated. SEC. 2. Said commission is hereby authorized to Powers and employ a competent architect or architects, engineer or engineers and such other assistants as it deems advisable and shall fix the compensation of all persons so employed; to hire offices necessary for the proper carrying on of its labors, and may in the name and behalf of the state carry on such negotiations with the war department of the United States of America or such other department as may have supervision over the public waterways of this state as may be necessary for widening or deepening the passages at the draw of Washington bridge, so-called; to sign on behalf of the state such contracts with the war department of the United States and expend such sums within the amount appropriated therefor as may be necessary; provided, however, that the attorney general shall examine and approve the form of all contracts or documents which may be drawn or duties of commission. Board of public roads to turn over to commission certain plans, plats, etc.. Appropriation for carrying out the provisions of this act. negotiated. Said commission is further authorized and directed to prepare plans, specifications and estimates for the erection of a new bridge with suitable abutments and approaches at or near the site of the present Washington bridge. SEC. 3. The state board of public roads is hereby directed to turn over to said commission within thirty days from and after its organization all plans, plats, specifications, drawings, surveys and other data prepared or collected by said state board of public roads in its study and report to the general assembly relative to Washington bridge. SEC. 4. For the purpose of carrying out the provisions of this act during the term of office of the commission herein created and to pay the salary of the secretary and the expenditures authorized in section 2 of this act, the sum of twenty thousand dollars or so much thereof as may be necessary, be, and the same hereby is appropriated out of any money in the treasury not otherwise appropriated; and the state auditor is hereby authorized and directed to draw his orders on the general treasurer for the payment of said sum or so much thereof as may from time to time be required upon receipt by him of proper vouchers approved by said commission. SEC. 5. This act shall take effect upon its passage. |
