(a) Appeal from Dismiss under Fishery Acts.-In case any Justice or Justices shall, after the passing of this Act, dismiss any complaint made under the provisions of the Act 5 & 6 Vic. c. 106, or of any Act altering or amending same, either on the merits or without prejudice, if any person prosecuting shall feel aggrieved by such order of dismissal, such person may appeal against such order, and the several provisions of the 24th sec. of the Petty Sessions (Ireland) Act, 1851, as amended by this Act, shall extend, and may be applied to such appeal: provided that the amount of the recognizance to be entered into by such appellant shall be such as to the Justice shail seem reasonable.-40 & 41 Vic. c. 56, sec. 74. For amendments by this Act in appeals, &c., see ss. 72, 73, 75, 76, 78. Sec. 72 amends recognizance. Sec. 73, Justice at original hearing shall not take part in appeal. Sec. 75 provides for the estreating of the recognizances. Sec. 76 provides that convictions shall not be quashed on the ground of error in complaint. Sec. 78 provides that exceptions need not be negatived. And see notes on Appeals, Petty Sessions (Ireland) Act, 1851, Appendix.

(a) Foreign Deserters Act, 1852.-To the present the Foreign Powers brought within the provisions of the Act by orders in Council, and communicated to the

Offence, or cause of Complaint.

Extent of Jurisdiction.

FRAUDS AS TO PROVISIONS; (a) Grain. Any person who shall sell or offer for sale any wheat, rye, meslin, pease, beans, barley, bere, oats, shillin, cutlings, meal, flour, malt, or other corn, in whole or in part spoiled or adulterated by wetting or mixtures of dirt, &c., or damaged corn or other stuff, or which shall not be equal to sample, or using any fraud to increase weight, &c.

Meat, Fish, &c.-Exhibiting for sale unwholesome or fradulently prepared meat, fish, or other provisions or food of any kind, for man or beast, or shall practise any deceit or fraud in respect to the quality of any such meat, fish, or other provisions. (b)

Magistrates are:-Austria, Belgium, Brazil, Chili, Columbia, Denmark, Equator, France, German Empire, Greece, Hawaii, Italy, Madagascar, Morocco and Fez, Netherlands, Nicaragua, Ottomon Porte, Peru, Russia, Salvador, Siam, Spain, Sweden and Norway, Tunis, Uruguay, Paraguay, Zanzibar, Dominion of Helenes, Independent State of Congo, Empire of Brazil, United States of Mexico. The section states that such penalties shall be recovered as penalties for harbouring deserters from British merchant ships; and these, by the Merchant Shipping Act, are directed to be recovered under the Petty Sessions (Ireland) Act. (a) May be heard out of Petty Sessions.

(b) It is an indictable offence at Common Law to sell unwholesome food, or to mix noxious ingredients in provisions which are offered for sale and sold.-Dizon's Case, 3 M. & Selw. 11.

There are many instances of convictions by indictment having been had for selling unwholesome food (meat or grain), not fit to be eaten by man.-See notes on the above sections, "Coppinger's Practice," p. 699.

The above Act occupies a very considerable space in the Statutes for the year. It appears to have been prepared with great care and attention, and with a full knowledge of the evils that grew up under the former system by the want of any proper legal control. There seems to be ample provision to prevent frauds; and where it is found that an offence by a society becomes an offence by every officer, or member of committee, who does not take steps to prevent its commission, or who cannot bring evidence of innocence by proving his ignorance of the transgression, dishonest practices must be less frequent than heretofore.

Trustees of society not liable to make good deficiencies; only liable for money actually received by them, respectively, on account of society.

What loans may be made to members.

Disputes shall be decided in manner directed by the rules of the society, and the decision so made shall be binding and conclusive on all parties, without appeal, and shall not be removable into any Court of Law or restrainable by injunction; and application for the enforcement thereof may be made to the County Court (in Ireland, the Civil Bill Court).

Proviso, as to references of disputes and the procedure before referee. Where rules direct disputes to be referred to Justices, the disputes shall be determined by Court of Summary Jurisdiction. Proviso

-that it shall be lawful for the parties to consent to its being determined by County Court.

Where rules contain no direction as to disputes, or where within 40 days after application to society for a reference under rules, no decision is made thereon, aggrieved may apply either to County Court or Summary Jurisdiction Court to hear and determine dispute. The Court, Chief or other Registrar, may, at request of either party,
