CHAPTER XXVIII.

SUNDRY MATTERS RELATING TO ARMY AND NAVY. By a resolution of March 3, 1847,1 it is provided:

Resolved by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War be, and he is hereby authorized and required to cause to be refunded to the several States, or to individuals for services rendered acting under the authority of any State, the amount of expenses incurred by them in organizing, subsisting and transporting volunteers previous to their being mustered and received into the service of the United States for the present war,2 and for subsisting troops in the service of the United States, without waiting for deductions to be made from the pay of said volunteers.

The benefits of this resolution were, by an act of June 2, 1848,3 extended "so as to embrace all cases of expenses heretofore incurred in organizing, subsisting and transporting volunteers, previous to their being mustered and received into the service of the United States for the present war,2 whether by States, counties, corporations or individuals, either acting with or without authority of any States," provided the Secretary of War should be satisfied, by proof of the necessity of such expenditures. Interest was allowed upon moneys thus advanced, at six per centum per annum, where claimants paid or lost the interest upon advances, or were liable to pay it.

ury, for examination. An abstract of the claim should be made out, and an affidavit of its correctness attached. With this should be filed such evidence in connection with the expenditure as the claimant may possess. Vouchers, showing the expenditures, with dates, items and amounts paid, must also be filed in support of the claim.'

EFFECTS OF DECEASED OFFICERS AND SOLDIERS.

Whenever an officer dies or is killed at any military post or station,

No allowance will be sanctioned for expenses of volunteers, whether officers or men, not afterwards mustered into the service; and there must be evidence that the persons supplied were mustered in.

Personal expenses of officers (except as to board and lodging) recruiting their companies prior to muster into service are not allowable; but the expenses of recognized agents of a State, when shown by bills and vouchers, will be refunded.

It is not sufficient to show that a gross amount was expended; still less, that sums were given to individuals to expend, without evidence by bills and vouchers that it was expended.

No more than fifty cents per day, per man, for subsistence, nor more than seventy-five cents for subsistence and quarters will be sanctioned, the rate to depend upon the price paid for complete rations at the nearest recruiting station or military post.

Purchases of subsistence in bulk, will be paid for at the current rates at the place of purchase, provided the quantities are in reasonable proportion to the number of men.

The articles of subsistence must be such as are recognized in the regular service; or if others are substituted, the cost of the whole must not exceed the price of regular supplies. This will also apply to forage for mounted volunteers. Spiritous liquors will not be paid for.

Transportation is restricted to the usual routes and modes of conveyance. Troops moving by land will not be allowed more than two four-horse wagons, and teams for the transportation of baggage and provisions a company of from fifty to seventy-five men. Wagon hire for the transportation of men will not be refunded.

Bounties paid men to induce them to volunteer, will not be refunded. As the law has made the payment of interest conditional upon certain contingencies, the facts should be fully stated from which the department oan infer that the contingency has occurred.

or in the vicinity of the same, it will be the duty of the commanding officer to report the fact direct to the adjutant-general, with the date and any other information proper to be communicated. If an officer die at a distance from a military post, any officer having intelligence of the same will, in like manner, communicate it, specifying the day of his decease; a duplicate of the report will be sent to department headquarters.

Inventories of the effects of deceased officers, required by the ninetyfourth article of war, will be transmitted to the adjutant-general. If a legal administrator or family connection be present, and take charge of the effects, it will be so stated to the adjutant-general.

Inventories of the effects of deceased non-commissioned officers and soldiers, required by the ninety-fifth article of war, will be forwarded to the adjutant-general, by the commander of the company to which the deceased belonged, and a duplicate of the same to the colonel of the regiment. Final statements of pay, clothing, etc., will be sent with the inventories. When a soldier dies at a post or station, absent from his company, it will be the duty of his immediate commander to furnish the required inventory, and at the same time to forward to the commanding officer of the company to which the soldier belonged a report of his death, specifying the date, place and cause; to what time he was last paid; and the money or other effects in his possession at the time of his decease; which report will be noted on the next muster roll of the company to which the man belonged. Each inventory will be indorsed: "Inventory of the effects of late of company, regiment of who died at the day of, 18-."

If a legal representative receive the effects, it will be stated in the report. If the soldier leave no effects, the fact will be reported. Should the effects of a deceased non-commissioned officer or soldier not be administered upon within a short period after his decease, they shall be disposed of by a council of administration, under the authority of the commanding officer of the post, and the proceeds deposited with the paymaster, to the credit of the United States, until they shall be claimed by the legal representatives of the deceased.

In all such cases of sales by the council of administration, a statement in detail, or account of the proceeds, duly certified by the council and commanding officer, accompanied by the paymaster's receipt for the proceeds, will be forwarded by the commanding
