Stran 36 - ... breach of warranty. But it would be better to distinguish such cases as a non-compliance with a contract which a party has engaged to fulfil ; as, if a man offers to buy peas of another, and he sends him beans, he does not perform his contract; but that is not a warranty, there is no warranty that he should sell him peas ; the contract is to sell peas, and if he sends him anything else in their stead, it is a non-performance of it.
Stran 36 - A warranty is an express or implied statement of something which a party undertakes shall be part of a contract, and, though part of the contract, collateral to the express object of it.
Stran 37 - But where a chattel is to be made or supplied to the order of the purchaser, there is an implied warranty that it is reasonably fit for the purpose for which it is ordinarily lo° used, or that it is fit for the special purpose intended by the buyer, if that purpose be communicated to the vendor when the order is given, as is shown by the authorities now to be reviewed": Benjamin on Sales, sec.
Stran 57 - Les époux peuvent déroger au partage égal établi par la loi, soit en ne donnant à l'époux survivant ou à ses héritiers, dans la communauté, qu'une part moindre que la moitié; soit en ne lui donnant qu'une somme fixe pour tout droit de communauté; soit en stipulant que la communauté entière, en certain cas, appartiendra à l'époux survivant, ou à l'un d'eux seulement.
Stran 58 - Il est permis aux époux de stipuler que la totalité de la communauté appartiendra au survivant ou à l'un d'eux seulement, sauf aux héritiers de l'autre à faire la reprise des apports et capitaux tombés dans la communauté, du chef de leur auteur.

Stran 36 - When the vendor sells an article by a particular description, it is a condition precedent to his right of action that the thing which he offers to deliver, or has delivered, should answer the description.
Stran 471 - It seems clear upon principle that, when the fact of the prisoner having done the thing charged is proved, and the only remaining question is whether, at the time he did it, he had guilty knowledge of the quality of his act, or acted under a mistake, evidence of the class received must be admissible. It tends to show that he had been pursuing a course of similar acts, and thereby it raises a presumption that he was not acting under a mistake.
