recited Act &c. for the said Act under which Possession was, at the Time of the passing Sections of of the said Act, held for any Charitable Uses whatsoever, of any to apply to Hereditaments of any Tenure whatsoever, or of any Estate or Interest all Deeds, therein, whether such Deeds or Assurances respectively were or were Charitable 5 not made for such full and valuable Consideration, and to take effect in possession and without Power of Revocation, as in the said Third Section mentioned. Uses there tofore made. 6. Nothing in this Act contained shall extend to render null and Act not to void any Deed or Assurance already good and valid. CLAUSE B. invalidate any Deed. Establishing the Jurisdiction of the Charity Com- such under HEREAS by many Private or other Acts of Parliament, Preamble. and Decrees or Orders relating to particular Charities, it is or may be provided that various Objects connected with the Administration or Management of such Charities or the Proper5 ties thereof shall or may be effected under the Direction or Sanction of the High Court of Chancery, which Objects, in the Absence of Provisions, might be beneficially and effectually accomplished the Acts relating to the Charity Commissioners for England and Wales, by means of Orders, to be obtained upon summary 10 Applications to the said Commissioners, and without the Intervention of the said Court; but it has been considered that in some of such Cases the Jurisdiction of the said Commissioners for such Purposes is excluded, and that in others of such Cases the Sufficiency of such Jurisdiction for such Purposes is open to legal Doubt: Be it therefore 15 enacted and declared by the Queen's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, as follows: 1. No Provision contained or to be contained in any such Act of No Provision 20 Parliament or Decree or Order as aforesaid, for the Appointment or [Bill 201.] in any Act of Parliament, Removal or Decree relating to under any Court of Removal of Trustees of any Charity, or for or relating to the Sale, any Charity Exchange, leasing, Disposal, or Improvement of any Property, or for Order of the the Performance of any other Act connected with the Administration or Management of any Charity or its Endowments, by or under the Chancery, to exclude any Order or with the Approval of the Court of Chancery, shall, (in the 5 Jurisdiction Absence of any express Direction to, the contrary, to be contained in which might otherwise be any future Act of Parliament,) exclude or impair any Jurisdiction or exercised by Authority which might otherwise be exercised for the like Purposes the Charity Commis sioners. by the Charity Commissioners for England and Wales. |
