Commiffioners fhall be appointed on both parts, to proceed to the execution of the articles: the difpofitions of which fhall be applied to the Heffian troops in the fervice of England, and who have been made prifoners of war.

IX. The prefent treaty to have no effect until it is ratified by the contracting parties, and the ratifications to be exchanged in this town of Bafle, within a month from this day, or fooner if poffible.* We, the undersigned plenipotentiaries of the French Republic, and of his Moft Serene Highnefs the Landgrave of Heffe Caffel, in virtue of our refpective powers, have figned this prefent treaty of peace, and have fealed it with our respective feals. Done at Bafle, the 11th of the month Fructidor, the third year of the French Republic, and the 28th of August, 1795.

Subftance of the Treaty between Great Britain and the Dey of Algiers, concluded in January, 1796.

THE Algerines fhall be permitted to carry their prizes to Corfica and to fell them publicly there.

There fhall be fent monthly from Corfica a veffel, which fhall fetch from Algiers private letters or commercial advices.

The English fhall not, under any pretext, obtain poffeffion of what fhall be found on board an Algerine fhip. In cafe the property of the fhip become the object of difpute it fhall be referred to the Dey to decide.

The Algerines grant freedom to all the Corfican flaves, and permiffion to fish in the environs of the coaft. In confequence of this arrangement the Dey is allowed to draw a draft upon the Vice-roy of Corfica for the fum of 179,000 piaftres of Algiers, independently of another fum of 24,000 piaftres for the payment of a cargo of grain taken by the English, which was Algerine property under Swedish colours.

The treaty was ratified by the National Convention on the 4th of September, and by the Landgrave of Heffe Caffel a few days afterwards.

Treaty of Peace and Amity, concluded this prefent Day, Lima Artafi, the twenty-first of the Safer Year of the Hegira, 1210, correfponding with Saturday, the 5th of September, 1795, between HASSAN BASHAW, Dey of Algiers, his Divan and Subjects, and GEORGE WASHINGTON, Prefident of the United States of North America, and the Citizens of the faid United States.

ART. I. FROM the date of the prefent treaty there fhall fubfift a firm and fincere peace and amity between the Prefi dent and citizens of the United States of North America, and Haffan Bafhaw, Dey of Algiers, his divan and fubjects; the veffels and fubjects of both nations reciprocally treating each other with civility, honour and refpect.

II. All veffels belonging to the citizens of the United States of North America fhall be permitted to enter the different ports of the regency, to trade with our fubjects, or any other perfons refiding within our jurifdiction, on paying the ufual duties at our custom-houfe that are paid by all nations at peace with this regency; obferving, that all goods difembarked, and not fold here, fhall be permitted to be reimbarked, without paying any duty whatever, either for difembarking or embarking. All naval and military flores, fuch as gun-powder, lead, iron, plank, fulphur, timber for building, tar, pitch, rofin, turpentine, and any other goods denominated naval and military ffores, fhall be permitted to be fold in this regency, without paying any duties whatever at the cuftom-houfe of this regency.

III. The veffels of both nations fhall pafs each other without any impediment or moleftation; and all goods, monies, or paffengers, of whatfoever nation, that may be on board of the veifels belonging to either party, fhall be confidered as inviolable, and fhall be allowed to pafs unmolested.

IV. All fhips of war belonging to this regency, on meeting with merchant veffels belonging to citizens of the United States, fhall be allowed to vifit them with two perfons only befides the rowers; thefe two only permitted to go on board faid vetfel, without obtaining exprefs leave of the commander of faid veffel, who fhall compare the paffport, and immediately permit faid veffel to proceed on her voyage unmolefted. All fhips of war belonging to United States of North America, on meeting with an Algerine cruifer, and fhall have feen her paffport and certificate from the conful of the United States of North America, refident in this regency, fhall be permitted to proceed on her cruife unmolefted; no paffport to be iffued to any thips but fuch as are abfolutely the property of citizens of the United States; and eighteen months thall be the term allowed for furnishing the fhips of the United States with paffports.

V. No commander of any cruifer belonging to this regency, shall be allowed to take any perfon, of whatever nation or denomination, out of any veffel belonging to the United States of North America, in order to examine them, or under pretence of making them confefs any thing defired; neither fhall they inflict any corporal punishment, or any way else moleft them.

VI. If any veffel belonging to the United States of North America fhall be ftranded on the coaft of this regency, they fhall receive every poffible affiftance from the fubjects of this regency; all goods faved from the wreck fhall be permitted to be reimbarked on board of any other veffel, without paying any duties at the custom-house.

VII. The Algerines are not, on any pretence whatever, to give or fell any veffel of war to any nation at war with the United States of North America, or any veffel capable of cruising to the detriment of the commerce of the United States.

VIII. Any citizen of the United States of North America having bought any prize condemned by the Algerines, shall not be again captured by the cruifers of the regency then at sea, although they have not a paffport; a certificate from the conful refident being deemed fufficient, until fuch time as they can procure fuch paffport.

IX. If any of the Barbary states at war with the United States of North America fhall capture any American veffel, and bring her into any of the ports of this regency, they fhall not be permitted to fell her, but fhall depart the port on procuring the requifite fupplies of provifion.

X. Any veffel belonging to the United States of North America, when at war with any other nation, fhall be permitted to fend their prizes into the ports of the regency, and have leave to dispose of them without paying any duties on fale thereof. All veffels wanting provifions or refreshments fhall be permitted to buy them at market price.

XI. All fhips of war belonging to the United States of North America, on anchoring in the ports of the regency, fhall receive the ufual prefents of provifions and refreshments, gratis. Should any of the fubjects of this regency make their escape on board veffels, they fhall be immediately returned. No excufe fhall be made that they have hid themfelves amongst the people, and cannot be found, or any other equivocation.

XII. No citizen of the United States of North America fhall be obliged to redeem any flave against his will, even should he be his brother; neither shall the owner of a flave be forced to fell him against his will: but all fuch agreements must be made by confent of parties. Should any American citizen be taken on board an enemy fhip, by the cruifers of this regency, having regular paffports, fpecifying they are citizens of the United States, they fhall

be immediately fet at liberty. On the contrary, they having no paffport, they and their property fhall be confidered lawful prizes; as this regency know their friend by their paffport.

XIII. Should any of the citizens of the United States of North America die within the limits of this regency, the Dey and his fubjects fhall not interfere with the property of the deceased; but it fhall be under the immediate direction of the conful, unless otherwife difpofed of by will. Should there be no conful, the effects fhall be depofited in the hands of fome perfons worthy of truft, until the party fhall appear who has a right to demand them, when they fhall render an account of the property. Neither fhall the Dey or Divan give hindrance in the execution of any will that may appear.

XIV. No citizen of the United States of North America fhall be obliged to purchase any goods against his will; but on the contrary, fhall be allowed to purchase whatever it pleaseth him. The conful of the United States of North America, or any other citizen, shall not be amenable for debts contracted by any one of their own nation, unless previously they have given a written obligation fo to do. Should the Dey want to freight any American veffel that may be in the regency, or Turkey, faid veffel not being engaged in confequence of the friendship fubfifting between the two nations, he expects to have the preference given him, on his paying the fame freight offered by any other nation.

XV. Any difputes, or fuits at law that may take place between the fubjects of the regency and the citizens of the United States of North America, fhall be decided by the Dey in person, and no other. Any difputes that may arife between the citizens of the United States, fhall be decided by the conful; as they are in fuch cafes not fubject to the laws of this regency.

XVI. Should any citizen of the United States of North America, kill, wound, or strike a fubject of this regency, he shall be punished in the fame manner as a Turk, and not with more feverity. Should any citizen of the United States of North America, in the above predicament, efcape prison, the conful fhall not become answerable for him.

XVII. The conful of the United States of North America fhall have every perfonal fecurity given him and his household; he shall have liberty to exercife his religion in his own houfe. All flaves of the fame religion fhall not be impeded in going to faid conful's houfe at hours of prayer. The conful fhall have liberty and perfonal fecurity given him, to travel whenever he pleafes, within the regency: he fhall have free licence to go on board any veffel lying in our roads, whenever he fhall think fit. The conful fhall have leave to appoint his own drogaman and broker.

XVIII. Should a war break out between the two nations, the Conful of the United States of North America, and all citizens of

the faid States, fhall have leave to embark themselves and property unmolefted, on board of whatever veffel or veffels they fhall think proper.

XIX. Should the cruifers of Algiers capture any veffel, with citizens of the United States of North America on board, they having papers to prove they are really fo, they and their property fhall be immediately discharged. And fhould the veffels of the United States capture any veffels of nations at war with them, having fubjects of this regency on board, they fhall be treated in like

manner.

XX. On a veffel of war belonging to the United States of North America anchoring in our ports, the conful is to inform the Dey of her arrival; and the fhall be faluted with 21 guns; which the is to return in the fame quantity or number; and the Dey will fend fresh provisions on board, as is cuftomary, gratis.

XXI. The conful of the United States of North America fhall not be required to pay duty for any thing he brings from a foreign country, for the ufe of his houfe and family.

XXII. Should any difturbance take place between the citizens of the United States and the fubjects of this regency, or break an article of this treaty, war fhall not be declared immediately; but every thing shall be fearched into regularly: the party injured fhall be made reparation.

ON the 21ft of the Luna of Safer, 1210, correfponding with the 5th of September, 1795, Joseph Donaldson, junior, on the part of the United States of North America, agreed with Haffan Bafhaw, Dey of Algiers, to keep the articles contained in this treaty facred and inviolable; which we, the Dey and Divan, promife to obferve, on confideration of the United States paying annually the value of twelve thoufand Algerine fequins in maritime ftores. Should the United States forward a larger quantity, the overplus fhall be paid for in money, by the Dey and regency. Any veffel that may be captured from the date of this treaty of peace and amity, fhall immediately be delivered up on her arrival in Algiers.
