To prevent the exportation of unmerchantable flour, and the falfe taring

of bread and flour calks.

E it ordained and enacted, by his honour the lieutenant-governor and commander council thereof, and by the authority of the fame, it is hereby ordained and enacted, that every bolter of flour, or baker of bread, for exportation, from any part of this province, fhall cach, provide and have a feparate and diftinguishable brand-mark, and fhall therewith brand each and every cafk of flour or bifcuit, of his own bolting or baking for exportation as abovesaid, before the fame fhall be removed from the place where fuch flour or bifcuit fhall have been packed, or put into cafks for expor tation, under the penalty of one fhilling for every calk fo removed, and not branded as aforefaid.

II. That every bolter and baker, who may bolt or manufacture flour, or bake bil cuit, for exportation, fhall, prior to the use of any brandmark as abovefaid, enter, with the clerk of the peace, for the diftrict where fuch bolter or baker may refide, fuch his brand-mark or marks, together with his name and place of abode; and the faid clerk is hereby directed to record the fame, in a book to be kept for that fpecial purpose; and for which regiftry he fhall receive one fhilling, and no more: And that every bolter or baker, neglecting to record his brand-mark as aforefaid, fhall forfeit and pay the fum of forty fhillings.

III. That all wheaten flour, fo bolted and manufactured for exportation, as aforefaid, shall, by the bolter thereof, be made merchantable, and of due fineness, and honestly and well packed, in good ftrong cafks, well made, of staves well feafoned, and bound with ten hoops, and the tare of the cafk fhall be marked thereon. And that, from and after the first day of September, in the year of our Lord one 'thousand seven hundred and eighty-fix, each cafk fhall contain one quintal and one quarter, one quintal and two quarters, one quintal and three quarters, or two quintals, of one hundred and twelve pounds, English weight, each: And each and every cask, fhall be well and fufficiently nailed, before the fame may be removed from the place where packed. And if any bolter or bake, fhall offend in all or any of the premises, he shall forfeit and pay the fum of one fhilling for each cask.

IV. That if any perfon or perfons, fhall put a falfe or wrong tare on any cask of flour or bread, to the difadvantage of any purchafer of the fame, the perfon fo offending, fhall forfeit and pay for every fuch calk, fo falfely tared as aforefaid, the fum of three fhillings.

ORDONNANCE

ORDONNANCE

Qui defend l'exportation de Farine non marchande, ainfi que le faux Tare fur les Quarts de Farine et de Biscuit.

Q

U'IL foit ftatué et ordoné par Son Honneur le Lieutenant Gouverneur et Commandant en Chef de cette Province, de l'avis et confentement du Confeil Légiflatif d'icelle, et par l'autorité, d'icelui, il est par ces préfentes ftatué et ordoné, que tous Fabriquants de farine ou de biscuit, pour être exportés d'aucune des parties de cette Province, se pourvoiront et auront une marque léparée et diftinctive, pour marquer tous et chacun quarts de farine ou de bifcuit, qu'ils auront fabriqué ou boulangé, pour exportation, comm'il eft dit ci-deffus, avant qu'ils foient tranfportés de l'endroit où tels farines ou biscuit auront été mis en quarts pour être exportés, fous peine d'un fhelling d'amende par chaque quart, qui aura été ainfi transporté, fans être marqué comme ci-deffus.

II. Que tous Fabriquants ou Boulangers qui fabriqueront de la farine ou boulangeront du biscuit, avant de se servir d'aucune marque comm'il eft dit ci-deffus, feront enregîtrer chés le Grefier de la paix du Diftrict, où ils réfideront, leurs marques ou étampes, enfemble leurs noms et les lieux de leur réfidence: et il eft par ces piéfentes ordoné au dit Grefier d'enregîtrer la dite marque dans un Regître gardé à cet effet, et pour tel enregîtrement il recevra un fhelling et point plus. Et que tous Fabriquants ou Boulangers qui négligeront de faire enregîtrer leurs marques, comme ci-deffus, encourront et paieront la fomme de quarante shellings.

III. Que toute farine de froment, ainfi fabriquée pour être exportée, comme ci-def fus, fera faite par les fabriquants, marchande, et de la fineffe requife, et bien honêtement mife dans des quarts folides, bien faits de douves féches et bien conditionnées, garnis de dix cercles, et le tare marqué deffus. Et que du jour et après le premier jour de Septembre dans l'année de notre Seigneur mil fept cens quatrevingt-fix, chaque quart contiendra un quintal et un quart, un quintal et deux quarts, un quintal et trois quarts, ou deux quintaux, de cent douze livres poids Anglais chacun; et tous et chaque quarts feront bien et fuffilament cloués, avant qu'ils foient tranfportés de l'endroit où la farine aura été mise en quarts. Et fi aucun Fabriquant ou Boulanger contrevient à aucune des conditions ci-delfus mentionées, il encourra et paiera la fomme d'un fhelling pour chaque quart.

IV. Que qui que ce foit qui mettra un faux tare fur aucun quart de farine ou de bifcuit, au préjudice de tout acheteur, encourra et paiera l'amende d'une fomme de trois fhellings.

V. That no perfon or perfons, fhall fhip any flour for exportation as aforefaid, until the same shall have been inspected and examined, by fome one of the officers or infpectors, who may be hereafter appointed for that purpose, by his Majefty's courts of quarter feffions of the peace, for the refpective diftricts of Quebec and Montreal. And the faid infpectors, are hereby feverally authorized and required, to fearch, try, and examine the faid flour, fo packed for exportation, by boring the head of the cafk, and piercing through the flour, with an inftrument to be contrived for that purpose, in order to prove whether it be honestly and truly packed, and to judge of its goodness. And the faid infpector fhall afterwards plug up the hole. And if the said infpector fhall find and judge the faid flour, fo examined, to be of a proper fineness and merchantable, according to the directions of this ordinance, he fhall brand every fuch cask of flour on the quarter, in a fair and diftinguishable manner, with the name of the place where fhipped, and the initial letters of his christian and furname, and for which trouble the infpector fhall receive, from the purchafer, two pence per calk

and no more.

VI. That, if any difpute fhall arife between any of the faid inspectors and the proprietor of fuch flour, fo examined, concerning the fineness or goodness thereof, upon application made to any one of his Majesty's juftices of the peace, he fhall, and is hereby required, to hear and receive the opinion of three persons of fkill and integrity; that each of the faid parties may name one of the faid three perfons, and the third to be named and appointed by the magiftrate as abovefaid. That the faid three perfons fhall be duly fworn, carefully to examine the faid flour, and make their report to the faid magiftrate forthwith, according to the true ftate in which they find the fame. And if, in the opinion of the faid three perfons, or any two of them, the faid flour is not fit to be exported, the faid magiftrate fhall iffue an order, in writing, to the owner or holder thereof, that the faid flour fhall not be exported, on pain of forfeiture; and if exported, contrary to the said order, the exporter thereof fhall forfeit, and be liable to pay, the full value thereof. And the faid magistrate shall award, and order the owner of the faid flour, to pay unto the inspector, two-pence for each cafk of flour, judged unfit for exportation as aforefaid, with reasonable cofts and charges. But if, in the opinion of the faid three perfons, or any two of them, the faid flour fhall be found good and merchantable, according to the directions of this ordinance, the charges of infpection fhall be borne and paid by the inspector or purchafer, at whofe requeft the examination was made.

VII. That the faid feveral infpectors, fo to be appointed, fhall have full power, and lawful authority, by virtue of this ordinance, to enter on board of any fhip or veffel, in which any flour is loading, for exportation, and the fame to fearch and examine; and if on searching, he or they fhall discover any cask or cafks of flour, that may not be branded in manner as before directed, the fame fhall be forfeited, and fo held and adjudged. And the mafter of fuch fhip or veffel, who fhall have received on board his veffel, fuch cafk or cafks of flour, not branded as aforefaid, fhall forfeit and pay, for each cafk fo received and not branded as aforefaid, the fum of ten jfhillings. And if the mafter or commander of any fhip or vessel, or any of his fervants or feamen, fhall obftruct or prevent any infpector or infpectors in making fuch fearch as aforesaid, every person so offending shall forfeit the sum of thirty pounds.

VIII. That all and every inspector, fo to be appointed as is directed by this ordinance, fhall, before entering upon the duties of his faid office, take and fubscribe the following oath, in the court of quarter feffions, or before any one of his Majefty's justices of the peace, for the district wherein he may be fo appointed:

V. Que qui que ce foit n'embarquera aucune farine pour être exportée, comme cideffus, avant d'avoir été vifitée et examinée par un des Oficiers ou Infpecteurs qui feront ci-après nommés à cet effet par les Magiftrats dans les Séances de Quartier de la Paix des diférens Diftricts de Québec et de Montréal, et les dits Infpecteurs font, par ces préfentes, féparement authorifés et requis, de vifiter et examiner la dite farine, ainfi mife en quarts pour être exportée, en perçant le haut du quart et enfonçant dans la dite farine un inftrument à cet effet, afin du juger fi elle a été mife honêtement dans le quart, et fi elle eft d'une bonne qualité. Et fi les dits Infpecteurs trouvent et jugent la dite farine, ainfi examinée fine et marchande, fuivant l'intention de cette ordonnance, ils étamperont chaque quart fur le côté d'une maniere claire et diftinctive, avec le nom de l'endroit où la farine aura été embarquée, et avec les lettres initiales de leur nom de batême et de famille. Et pour cette peine les dits infpecteurs recevront de l'acheteur deux penneis par quart, et point plus.

VI. Que dans le cas où il s'éléverait quelque dispute entre aucun des dits Inspecteurs et le propriétaire de la farine ainfi examinée, quant à fa fineffe et à fa bonne qualité, on aura recours à aucun des Juges à Paix de fa Majefté, qui eft, par ces préfentes, requis d'écouter et recevoir l'opinion de trois particuliers à ce conaiffans et intégres, dont deux feront nommés par chaque partie, et le troifieme par le dit Magiftrat, lefquels trois particuliers, après ferment par eux prêté, examineront foigneufement la dite farine, et feront enfuite leur raport au dit Magiftrat de l'état vrai où ils auront trouvé la dite farine. Et fi l'opinion des dits trois particuliers ou de deux d'entr'eux eft, que la dite farine n'eft point propre à être exportée, le dit Magiftrat donnera un ordre par écrit au propriétaire de la dite farine, qu'elle ne fera point exportée, fous peine de confifcation; et fi elle eft exportée en contravention du dit ordre, celui qui l'exportera encourra et paiera la valeur entiére d'icelle. Et le dit Megistrat ordonera au propriétaire de la dite farine, de paier au dit Inspecteur deux penneis pour chaque quart de farine, jugé incapable d'être exporté comme ci-deffus, ensemble les dépens et frais raisonables; mais fi en conféquence de l'opinion des dits trois particuliers, ou de deux d'entr'eux, la dite farine eft trouvée bonne et marchande, fuivant l'intention de cette ordonnance, les frais d'inspection feront paiés par l'infpecteur ou l'acheteur, à la requête de qui l'examen aura été fait.

VII. Que les diférens Infpecteurs, ainfi nommés, auront plein et entier pouvoir et autorité, en conféquence de cette ordonance, d'entrer à bord d'aucun vaiffeau ou bâtiment, dans lequel on chargera de la farine pour être exportée, pour l'avoir et l'examiner; et fi, fur l'examen, ils trouvent aucuns quarts de farine qui n'auront point été marquês dans la maniere ci-deffus ordonée, ils feront faifis et jugés comme tels. Et le maitre du vaiffeau ou bâtiment qui aura reçu à bord de fon vaiffeau tels quarts de farine, non marqués, comme ci-deffus, fera condamné pour chaque quart ainfi reçu, et non marqué, comme ci-deffus, à paier une fomme de dix fhellings. Et fi le maître ou commandant du vaiffeau ou bâtiment, ou quelqu'un de fes domeftiques ou matelots, empêche aucun Inspecteur de faire le dit examen, le contrevenant païera la fomme de trente livres courans.

VIII. Que tous et chacun Infpecteurs, ainfi nommés, tel qu'il cft ordoné par cette ordonance, avant d'exercer les fonctions de leur charge, prendront et foufcriront le ferment qui fuit, dans la Cour de Séance de Quartier, ou devant un des Juges de Paix de fa Majefté pour le diftrict dans lequel ils feront nommés:

"An ordinance to prevent the exportation of unmerchantable flour, and the. falfe "taring of bread and flour. So HELP ME GOD."

IX. That no infpector fhall purchase, or caufe to be purchased, any flour, condemned by himself or any other infpector, as unmerchantable, under the penalty of thirty pounds.

X. That if any infpector, on any application to him, to attend furvey, and examine flour as abovefaid (and who fhall not, at the time of fuch application be employed in the examination of flour) fhall neglect, or delay, to proceed to fuch furvey and examination, for the space of three hours, after application made, the infpector, fo neglecting or refufing, fhall, for every fuch offence, forfeit and pay the fum of forty fhillings.

XI. That any perfon or perfons, who fhall counterfeit any of the aforefaid brandmarks, or brand the fame on any cask of flour, or fhall empty any cask of flour, branded by the inspector as aforesaid, in order to put therein other flour, for sale or exportation, without firft cutting out the faid brand-mark; the faid perfon or perfons fo offending, fhall feverally, for every offence, forfeit and pay the fum of one hundred pounds.

XII. That all and every fine and forfeiture, which may be incurred and inflicted by this ordinance, may be fued, profecuted for, and recovered, by bill, plaint, or information, in any of his majefty's courts of common pleas in this province; the one half whereof fhall be paid to his majesty's receiver general, for his majesty's use, and the other half to the informer or perfon fuing for the fame.

Ordained and enacted by the authority aforefaid, and paffed in Council under the Public Seal of the province, at the Council-chamber in the castle of St. Lewis, in the city of Quebec, the thirtieth day of April, in the twenty fifth year of the reign of our Savereign Lord GEORGE the Third, by the grace of GoD of Great-Britain, France and Ireland, King, defender of the faith, and fo forth, and in the year of our LORD one thoufand feven hundred and eighty-five.
