And to take away all doubts and fcruples with refpect to the right of appeal in any court of appeals caufe before the faid courts of common-pleas, be it enacted and declared by the fame touching fecurity. authority, that the court of appeals fhall be deemed and adjudged to have an appellate jurifdiction, with all the power neceffarily annexed to fuch jurifdiction, and that it fhall henceforth belong to the provincial court of appeals to determine the queftion when fecurity fhall be requifite, and the fufficiency thereof, and the admiffion, difniffion or remiffion of appeals, and the fupply of the defects of the record, and of the effect of the appeal as a fuperfedeas of all or any proceedings in the lower courts, for the flay of execution on the judgment of the fame, or any process of the nature of execution, with authority alfo to make rules and orders to regulate, effectuate and accelerate the proceedings in all caufes of appeal, for the advancement of juftice, and to prevent unneceffary delays and expence in the fame.

And where appeals are brought by executors, adminiftrators, curators, tutors or guardians, the plaintiff fhall not have execution, nor any procefs in the nature of execution, without fuch fecurity firft given as the court of common-pleas in their difcretion fhall direct, to refund the damages and cofts, in cafe the judgment shall be reverfed, together with fuch cofts as the court of appeals may award.

And for the more convenient difpenfation of juftice in fmall caufes, it is enacted and ordained by the fame authority, that it fhall and may be lawful for his excellency the governor or the commander in chief of the province, for the time being, by and with the advice and confent of his Majefly's council, to appoint by commiffion, fuch and fo many perfons as he fhall judge fit, and for. fuch parts of the province as he fhall think proper, to hear fummarily and to determine finally without appeal all matters of debt of ten pounds or under. And it shall likewife be lawful for his excellency the governor, or the commander in chief, for the time being, by and with the advice and confent of his Majefty's council, to regulate the fees to be taken by the perfons fo commiffion'd and by their fubordinate officers, and to direct a mode of proceeding for them; whereof, and the extent of their jurifdiction refpectively, a notification fhall be published in the Quebec Gazette for the information of all perfons whom it may concern.

Whereas there are many thousands of loyalifts and others fettled in the upperCountries above Montreal, and in the bays of Gafpé and Chaleurs below Quebec, whofe eafe and convenience may require, that additional diftricts fhould be erected as foon as circumftances will permit, it is enacted and ordained by the authority aforefaid, that it may be lawful for the governor or commander in chief for the time being, with the advice and confent of the council, to form by patent under the feal of the province, one or more new diftricts, as his difcretion fhall direct, and to give commiffion to fuch officer or officers therein as may be neceflary or conducive to the ease and convenience of his Majefly's fubje&ts refiding in the remote parts of the province.

Provided always, that nothing herein contained fhall be conftrued to the prejudice of the rights of land-lords in their legal courfe for the recovery of rents, according to any former mode of proceeding by any law, ufage or custom whatsoever. And And provided alfo, that whenever the defendant or debtor fhall either pay the debt and cofts, or give security to the fheriff or officer for the goods fo attached, as in case of bail on perfonal arrefts fubject to juftification in court to answer the value of the goods, and abide the judgement of the court, the fame fhall be forthwith restored; and for that purpose, the defendant or debtor fhall be allowed forty-eight hours, after which period if the debt and cofts be not paid, nor fecurity given, the goods fo feized fhall remain attached and held by the fheriff or officer to answer the judgment of

law.

Be it further enacted by the authority aforefaid, that the additional regulations hereby enacted, fhall be in force until the end of the feffions that fhall be held in the year of our Lord one thoufand feven hundred and eighty-nine, or as long as the ordinance hereby renewed; and that the ordinance paffed in the twenty-fifth year of the reign of his prefent Majefty, intituled, "An Ordinance for granting a limited civil power and jurifdiction to his Majifty's juftices of the peace, in the remote parts of this province," be no longer in force than until "fuch fmall jurifdictions as by this act are authorized, fhall be actually erected.

AN ORDINANCE

To explain an l amend an ordinance for eftablishing courts of criminal juris diction in the province of Quebec.

HEREAS it is expedient, that public officers fhould be established in the several

vrement de rentes fuivant aucune ancienne forme de procéder, en conféquence de toutes loix, ufages et coutumes quelconques; et pourvû auffi que dans le cas, où le défendeur ou débiteur païera la dette et les frais, ou donnera caution au fheriff ou huiffier, de répondre des effets, ainfi faifis et arrêtés, comme dans les cas de cautionement perfonel, fujet à juflification en cour, pour répondre de la valeur des effets, et pour. fatisfaire au jugement de la cour, les dits biens, dettes et effets feront rendus, et à cet effet, il fera aloué au défendeur ou débiteur quarante-huit heures, après lequel tems,.. fi la dette et les frais ne font point païés, et qu'il n'ait été donné aucune caution, les effets ainsi saisis et arrètés refteront fous la garde du fheriff ou huiffier, pour fatisfaire au jugement.

Ces nouveaux réglemens feront

deux années.

Qu'il foit en outre ftatué, par la dite autorité, que les nouveaux réglemens ftatués par ces préfentes, feront en force jusqu'à la fin de la féance qui tiendra dans l'année de en force pour notre Seigneur mil fept cens quatrevingt-neuf, ou auffi longtems que l'ordonance renouvellée par ces préfentes; et que l'ordonance paffée dans la vingt-cinquième année du régne de fa majefté, intitulée, " Ordonance qui accorde un pouvoir et juridiction civile limités, aux juges à paix de fa majefié, dans les parties éloignées de cette province," ne fera en force que jufqu'à ce que telles petites jurifdictions, autorifées par cet acte, feront établies.

ted and ordained by his excellency the governor and the legiflative council, that all and every the captains, and other inferior officers of militia in the faid feveral parishes of this province, duly commiflioned by his excellency the governor, or the commander in chief for the time being, and likewife the ferjeants named and appointed by the faid captains, and other officers in their refpective parishes be, and they are hereby declared to be public and peace officers within their refpe&ive parishes, and authorifed and enjoined to do and exercife all and fingular the duties and fervices of public and peace officers within their refpective parifhes according to law.

And be it further enacted by the fame authority, That it fhall be lawful for the appointed for the commiffioners or juflices of the peace, affembled in quarter feffions, or by a majori ty of the fame, and they are hereby required as foon as conveniently may be, to name and appoint fuch and fo many perfons as they may think fufficient, within the towns and banlieues of Quebec and Montreal, for carrying into execution the orders and decrees of the feveral courts, and to preferve the public peace therein; every of which perfons fo appointed fhall faithfully perform the duties of the offices, for which he may be fo appointed for the space of one year; previous to the expiration whereof, it fhall be the duty of the faid commiffioners or juftices of the peace, annually to appoint others to ferve in their flead; and to increase or diminish the number firft appointed, as to them fhall appear to be moft for the public weal and fafety; and that no fuch appointinent fhall be valid in Quebec or Montreal, and their banlieues relpectively, in the cafe of a civil or military officer, or any perfon in priefts orders, or in the profeffion or practice or phyfic or furgery, or any miller, ferryman, fchoolmafter or ftudent of any college or feminary, or any perfon not of full age. And for neglec ting or refufing to perform the faid office or offices there fhall be the forfeiture of twenty pounds, to be recovered in any court of record, with cofts of fuit, by bill, plaint or information, in which no effoign, wager of law, or any more than one imparlance, fhall be allowed.
