CA P. I.

An ACT or ORDINANCE

Further to regulate the inland Commerce of this Province, and to extend

the fame.

HEREAS a commercial intercourfe with the neighbouring States, to a certain extent, was opened in the course of the last year, and it is conceived that it may, under due reftrictions, be made useful to this Province and to Great-Britain; Be it enacted therefore by his Excellency the Governor and the Legiflative Council, and it is hereby enacted by the authority of the fame, that all goods, wares, and merchandifes (Beaver, Peltries and Eurs excepted) of the growth and manufacture or product of this Province, or of any other the dominions of Great-Britain, and fuch as may lawfully be imported into this province by fea, may be exported therefrom by land or inland navigation, to any of the neighbouring States, free from duty, im-poft or refraint. And there fhall be the like freedom of importation from the said States into this Province, if the fame be made by the route or communication of Lake Champlain and the River Sorel or Richelieu, and not otherwife, of the following enumerated articles, that is to fay, Mafts, Yards, Bowfprits, Spars, Plank, Boards, Knees, Futtocks, or any kind of Ship-timber; Hoops, Staves, Shingles, Clapboards, Trees, Wood, Lumber, Pitch, Tar, Turpentine, Tallow, Hemp, Flax, and any kind of naval ftores; Seeds, Wheat, Rye, Indian Corn, Beans, Peas, Potatocs, Rice, Oats, Barley, and all other grains; Butter, Cheefe, Honey, Horfes, Neat-cattle, Sheep, Hogs, Foultry, and other live-ftock, and live provifions, and fresh fish; and what!oever is of the growth of the faid States; and Gold or Silver Coin or Bullion,

II. And be is further enacted by the fame authority, that the importation by land or the inland navigation into this Province, of Rum, Spirits, Copper-coin, and of all other goods, wares and merchandifes not enumerated as aforefaid, be prohibited, and fuch articles feized and forfeited, together with every of the enumerated articles a bove-mentioned, if the fame thall not have been imported by the route and commu nication aforefaid.

III. And be it also enacted by the fame authority, that the Exportation of Beaver, Peltries and Furs into any of the neighbouring States be prohibited, and that the fame fhall be liable to feizure and forfeiture upon due proof of their being in the way towards either of the faid States, with intent to be exported to the fame by Land or Wa ter; and it fhall be conclufive Evidence of fuch Intent, if any perfon be found in the way to either of the faid States, in any place between the South-fide of the River St. Lawrence, and the Southernmoft extent of his Majefty's Government, with Beaver, Furs or Peltrics, and without a certificate from one of his Majefty's Juftices of the Peace, certifying that oath has been made before him by the Owner or Proprietor, or his Factor or Agent, that the fame Beaver, Peltries, and Furs are not intended for fuch exportation; and every perfon aiding and aflifting, and directly or indirectly interested or concerned in any attempt to make fuch Exportation, fhall incur a fine

Qui régle plus amplement, et étend d'avantage le Commerce intérieur de

cette Province.

NE correfpondance de Commerce, jufqu'à une certaine étendue, ayant été ouverte dans le cours de l'année derniere avec les Etats voifins, que l'on croit pouvoir, fous des reftrictions convenables, être utile à cette Province et à la GrandeBretagne. Qu'il foit ftatué et ordoné, par fon Excellence le Gouverneur et le Confeil Législatif, et il est par ces présentes, ftatué par la dite autorité, que tous effets, denrées et marchandifes (caftors, pelleteries et fourures exceptés) du crû, des manufactures, ou produit de cette Province, ou d'aucuns domaines de la Grande-Bretagne, et tous et tels effets qui peuvent être légalement importés dans cette Province par mer, pourront être exportés d'ici par terre, ou par la navigation intérieure, dans aucuns des Etats voisins, afranchis de tous droits, impôts ou contraintes; et qu'il y aura également une même liberté d'importer des dits Etats dans cette Province, les effets cideffous mentionés, pourvû qu'ils foient amenés par la route ou communication du Lac Champlain et de la riviére Sorel ou Richelieu et non autrement, favoir, mâts, vergues, beauprès, barres, planches, bordages, côtes pour navires, courbes ou aucuns espéces de bois propres à la conftruction; feuillards, douves, bardeaux, planches preparées pour futailles, arbres, bois de conftruction et de meubles, poix,térébentine, fuif, chanvre, lin, et toutes fortes d'effets pour la marine, graines, bled, feigle, bledinde, fives, pois, patates, ris, avoine, orge et tous autres grains; beurre, fromage, miel, chevaux, bêtes à corne, moutons, cochons, volailles et autres provifions et denrées vivantes, et poiffon frais, et généralement tout ce qui eft du crû des dits Etats, et de l'or et de l'argent en espèces ou en lingots.

II. Et qu'il foit de plus ftatué, par la même autorité, que l'Importation par terre, ou par la navigation intérieure dans cette Province, de rum, liqueurs fortes, monoie de cuivre, et tous autres effets, denrées et marchandifes qui ne font point ci-deffus détaillés, foit défendue, et que tels articles feront faifis et confifqués ainfi que chacun de ceux ci-dessus mentionés, s'ils n'ont point été importés par la route ou communication ci-deffus.

III. Et qu'il foit encor ftatué, par la même autorité, que l'exportation des caftors, pelleteries ou fourures dans aucun des Etats unis, foit détendue, et qu'ils feront dans le cas d'être faifis et confifqués, fur une preuve légale qu'ils étaient acheminés vers aucun des dits Etats, avec l'intention de les y exporter par terre, ou par eau, Et la preuve de cette intention fera fuffifante de trouver qui que ce foit en chemin vers aucun des dits Etats et dans aucuns licux entre le côte du Sud du fleuve St. Laurent, et l'étendue le plus Sud du Gouvernement de fa Majellé, avec caftors pelleteries ou fourures, fans un certificat d'un Juge à paix de fa Majefté, prouvant qu'un propriétaire, fon facteur ou agent a fait ferment devant lui, que les dits caftors, pelleteries, ou fourures, n'étaient point deflinés pour telle exportation; et que quiconque aidera et affiftera, et qui fera directement ou indirectement intérellé dans quelque deffein de

of ten fhillings for every pound weight of Beaver. and ten Ihilling for every skin of Furs or Peltries, fo exported or attempted and intended to be exported.

IV. And for prohibiting ftill more effectually the exportation of Beaver, Peltries and Furs, be it alfo enacted by the fame authority, that all and every person or perfons who shall export, or shall be aiding or affifting or directly or indirectly interefted and concerned in exporting to any of the faid States by any route from any other part of his Majefty's Government, to the Weftward of St. Regis, any Beaver, Furs or Peltries of any kind, fuch person or perfons fhall forfeit and become liable to pay thrice the fines and penalties above-mentioned.

V. All which forfeitures, fines and penalties fhall be recoverable and be divided, applied, or disposed of, as directed by the ftatute of the fourteenth year of his Ma jefty's reign, chapter eighty-eight, refpecting the forfeitures and penalties therein

mentioned.

VI. Provided always, and it is also hereby enacted by the authority aforefaid, that nothing in this Act contained, fhall be construed to affect travellers to and from this Province and their servants, boats, carriages, and necessary baggage (not including any article whatsoever for trading purpofes;) nor the effects of any kind of fuch perfons coming to fettle in this Province, or others, as fhall have permiffion, in the manner therein to be expreffed, of the Governor or Commander in Chief, for the time -being, under his hand and seal at arms: nor to affect the importation of any of the faid enumerated articles, by any route and communication to fuch pofts, places and districts, and under fuch reftrictions, and for fuch periods, as the Governor or Commander in Chief, for the time being, may conceive to be expedient for the common weal, and from time to time declare and make known by Proclamation under the Great Seal.

VII. And it is also enacted by the fame authority, that it fhall be the duty of the officers of the customs to execute this Act in the manner of executing any of the ftatutes made for the regulation of the plantation trade; and they fhall be intitled to all fuch aid and affistance therein, as they are intitled to, and may demand, under all or any of the ftatutes aforefaid.

VIII. And be it further enacted, by the fame authority, that for every certificate to be given by a Magiftrate as aforefaid, he shall be intitled to the fee of one fhilling, and fhall not receive therefor more, under the pain of extortion, and that any Magiftrate granting a certificate wickedly, knowingly and fraudulently to abet and effect the exportation of Beaver, Peltry or Furs forbidden by this A&t, and thereof duly convicted, shall be liable to fuch fine and imprisonment, as the Court of King's Bench, may impose and adjuge, and thenceforth be incapable of any office, place or employment in his Majefty's Government: And that a wicked and corrupt oath, for obtaining a certificate, fraudulently to effect fuch prohibited exportation, fhall, upon due conviction, expofe the offender to the pains and penalties of falfe fwearing and perjury; and fuch as advise, encourage, and perfuade to bring about fuch wicked, fraudulent, and corrupt swearing, to the pains and penalties of fubornation of perjury.

Enacted and Ordained by the authority aforefaid, and paffed in Council under the Great
Seal of the Province, at the Council-chamber in the caftle of St. Lewis, in the city of
Quebec, the fourteenth day of April, in the twenty-eighth year of the reign of

IV. Et pour prohiber encor plus effectivement l'exportation des caftors, pelleteries et fourures, Qu'il foit auffi ftatué, par la même autorite, que qui que ce puiffent être qui exporteront, ou qui aideront, ou affifteront, ou qui feront directement ou indirectement intéreffés dans l'exportation à aucun des dits Etats par aucuns chemins d'aucunes autres parties du Gouvernement de fa Majefté à l'Oueft de St. Regis aucuns caftors, pelleteries ou fourures d'aucunes efpéces, tels particuliers encourront et feront fujets à payer le triple des amendes et peines ci-deffus mentionnées.

V. Toutes lefquelles amendes et peines feront recouvrées partagées et employées ainfi qu'il eft ordoné par le ftatut de la quatorziéme année du règne de fa Majefté, concernant les amendes et peines y mentionées.

VI. Pourvû toujours, et il eft encor ftatué, par ces préfentes, par la même autorité, que rien dans cet acte ne s'entendra à affecter les voyageurs, dans, et de cette Province, ainfi que leurs domeftiques, leurs bateaux voitures, et le bagage néceffaire (à l'exclufion de tous effets de comerce) ni les effets de quiconque viendra s'etablir dans cette Province, ou autres qui auront une permiffion, dans la forme prefcrite, du Gouverneur ou du Comandant en Chef pour lors, fous fon feing et le cachet de fes armes ni à empêcher l'importation d'aucuns des dits articles défignés, par aucun chemin, ou aucune communication de tels poftes, lieux et districts, et fous telles reftrictions et tems, que le Gouverneur ou le Comandant en Chef, pour lors pourra juger être néceffaires pour le bien public, et de tems à autre de déclarer et donner conaiffance par Proclamation fous le grand feau.

VII. Et il est encor ftatué, par la même autorité, qu'il fera du devoir des oficiers des Douanes, d'exécuter cet acte de la même maniére, qu'ils mettent à exécution les ftatuts qui réglent le comerce des Plantations, et qu'ils feront autorifés à demander les mêmes aide et fecours qu'ils ont droit de demander, en vertu de tous et chacun des dits ftatuts ci-deffus mentionés.

VIII. Et qu'il foit de plus ftatué par la même autorité, que pour chaque certificat qui fera donné par un Magiftrat, comme ci-dellus, il aura droit à un honoraire d'un shelling, et ne pourra recevoir plus fous peine de concuffion. Et que tout Magiftrat qui accordera un certificat méchament, avec conaiffance et frauduleusement, afin d'aider et faciliter l'exportation des caftors. pelleteries fourures, prohibée par cette ordonance, et qui en fera duement convaincû, fera fujet à telles amendes et à tels emprifonemens, que la Cour du Banc du Roi pourra impofer et prononçer, et fera encor incapable de tenir aucuns ofices, charges ou emplois dans le Gouvernement de fa Majesté; et qu'un ferment méchant et faux, fait pour obtenir un certificat frauduleusement, pour faire telle exportation prohibée, expofera, fur une due conviction, le contrevenant aux peines et amendes de fauffaire et parjure; et que ceux qui confeilleront, encourageront, ou perfuaderont à faire faire tel ferment méchant et faux, aux mêmes peines et amendes pour fubornation et parjure.

An ACT or ORDINANCE,

For the easy settlement and recovery of the Crown Debts incurred on the commercial transportation over the interior Lakes.

WH

HEREAS the inland commerce has been, for divers years paft, aided and protected by his Majefty's vessels and naval armaments upon the great lakes, and large fums are due from merchants, traders and others for the freight and transportation of their effects, to the payment of which transportation, though previously acquiefed in, by merchants, traders and others, obstacles have been raised since the year one thousand feven hundred and eighty-one, the recovery of which fums may require fpecial provision to be made therefor by the legiflature; the engagements, promifes and fecurities for the freight-money being made and given to naval ftore-keepers, pay-mafters, or other agents for the Crown, fome of whom are abfent or dead; and divers difputes and controverfies are fubfifting on the claims of the owners and fhippers of the effects, for delays, damages, and loffes, refpecting the carriage and delivering of the goods for which fuch freight-money was to accrue. And whereas many of the debtors as well as the witneffes refide at Detroit and other remote places, where examinations, enquiries, and fettlements may be moft conveniently made; to the intent therefore that the faid difputes and controverfies may be adjusted, and the balances due liquidated, and that the perfons indebted for the fame may be legally discharged and quieted, and his Majefty's dues be afcertained and recovered: Be it enacted by his Excellency the Governor and the Legislative Council, and it is accordingly hereby enacted and ordained by the authority of the fame, that all monies remaining in the hands of any perfon or perfons that were originally paid by the merchants, traders or others for freight, in the commerce aforefaid, and not delivered over for, or already jufly applied to the ufe and benefit of the Crown; and that all monies ftill outstanding and unpaid for freights due in the faid commerce, and all promifes, bonds, notes and fecurities therefor, fhall for the purpofe of recovering the fame, for the ufe of the Crown, be deemed and adjudged in the law to have been, and to be the right and property of the trufees to be appointed as herein after mentioned; who shall have as compleat and perfect power and authority to afk, demand, compound for, agree, and adjust the fame, and liquidate and receive the balances, and give acquittances, receipts, difcharges, and releafes therefor, or fue for and recover the fame freight-monies, or any part thereof, in all or any of the courts of the Province (which for that purpofe fhall have cognizance thereof both in law and equity) as if they where the original owners of the faid freight-monies, and all the contracts and fecurities therefor, were made in their names, and payable to them for their own benefit and ufe.

II. And be it further enacted and ordained by the fame authority, that the faid truftees fhall be fuch perfons as the Governor of this Province, or the Commander in Chief thereof, for the time being, fhall authorife for that purpose by commission
