Quebec in dark nights, fhall fhew a light at the bowfprit-end under the penalty of ten fhillings. XXII. That if any master of a veffel fhall lay his veffel in the Cul de Sac, otherwife than with her head to the Shore and ftern to the River, with an anchor laid down below the reef of rocks, or throw ballaft of any kind overboard in the Cul de Sac, he shall incur a penalty of ten fhillings, and be obliged to remove the fame. XXIII. And all the fines and forfeitures by this ordinance impofed, may be sued for and recovered before any two of his Majefty's Juftices of the Peace, on the oath of one or more credible witneffes, one half to be paid to the person who fhall fue for the fame, the other half to the Receiver-General for his Majefty's ufe and the fupport of the Government, to be by him accounted for to the Lords Gommiffioners of his Majefty's Treafury, and audited by the Auditor-General of the Plantations or his Deputy. And it fhall be the duty of the captain of the port and fuperintendant of pilots to fee this ordinance carried into execution, under the penalty of twenty fhillings for every wilful neglect, to be recovered and applied as aforefaid. XXIV. Provided nevertheless that nothing in this ordinance to the contrary notwithstanding, fhall extend, or be conftrued to extend to any of his Majefty's fhips of war, that may come into, or be stationed in the River St. Lawrence or harbour of Que bec. WH WHEREAS the Fisheries have ever been found beneficial to the trade of the mother-country, and as feveral large veffels have been yearly fitted out and equipped therefrom to carry on the cod-fifhery in the Bay of Gafpé, at the Ifland of Bonaventure, at Percé, and in the Bay of Chaleurs in this Province, in order to encourage that valuable branch of trade, it is enacted by his Excellency the Governor and the Legislative Council, that all his Majefty's fubjects fhall peaceably have, ufe and enjoy the freedom of taking bait, and of fishing in any river, creek, harbour or road, with liberty to go on fhore on any part between Cape Cat on the South-fide of the River St. Lawrence, and the firft Rapid in the River of Riftigouche, above the Illands XXI. XXIII, Et que toutes les amendes et confifcations impofées par cette ordonance, pourront être pourfuivies et prélevées devant aucuns deux Juges à paix de fa Majesté, fur le ferment d'un ou plufieurs témoins dignes de foi, dont moitié fera payée au poursuivant et l'autre moitié au Receveur-général de fa Majefté, pour fervir au foutien du Gouvernement, dont il rendra compte aux Lords du tréfor de fa Majeft, qui fera examiné par l'auditeur général des plantations ou fon député; et il fera du devoir du Capitaine de port et du furintendant des pilotes de mettre cette ordonance en éxécution, fous peine de vingt hellings, pour chaque négligence volontaire, qui seront prélevés et apliqués comme ci-dessus. Geo Iflands that lie higher up than the New Mission in the said River, which empties itself into Chaleurs Bay within this Province, and on the Island of Bonaventure, for the purpose of falting, drying and curing their fifh, and they may cut down wood and trees there, for building, making, mending, or repairing ftages, flakes, hurdles, huts or cook-rooms, and other things that may be neceffary for curing and preparing their fish for exportation, and all other things that may be useful to their fishing-trade, without any hindrance or interruption, denial or disturbance from any perfon or per-fons whatfoever. II. And be it further enacted by the authority aforefaid, that the commander of every fhip or veffel fitted out from Great-Britain or the dominions thereunto belonging, and entering into any creek or harbour, may reserve to himfelf fo much beach or flakes, or both, as are needful for the number of boats he fhall there ufe, provided ey are unoccupied by any other perfon, or are not in this and the preceding cafes private property by grant from his Majefty, or by grant before the year one thousand feven hundred and fixty. III. And be it further enacted by the authority aforefaid, that no perfon or perfons fall after the publication of this ordinance, rind any trees ftanding or growing on the faid beach referved for the ufe of the fishery, nor in the woods adjacent, nor fet fire to the woods, or do or caufe to be done any damage to the fame, for any ufe whatfoever, except only for neceffary fuel, and for building and repairing huts, flages, flakes and other things ncceflary for carrying on their fifhery; and no perfon or perfons whatfoever, fhall caft anchor or do any thing to annoy or hinder the hauling of feines in the accuflomary baiting places, or in places where falmon are or may be caught, or shoot, his, her or their feine or feines within or upon the feine or feines of any other perfon whatsoever; and alfo, that no perfon or perfons fhall fteal, purloin or take out of the nct or nets of any other perfon, nor fteal, purloin or take away any bait out of any fifliing-boat, or fleal falmon out of any net belonging to any other perfon, under the penalty of five pounds. IV. And be it further enacted, that no ballaft or any thing else hurtful to any of the harbours in the extent of coaft mentioned in this ordinance, fhall be thrown out of any veffel or otherwife by any perlon whatfoever, but that all ballaft or other things fhall be carried on fhore, and laid where they may do no annoyance. under the pe nalty of five pounds. And no fisherman or other perfon fhall throw any fish-guts, 'of fals or gurry overboard out of any veffel or boat within the diftance of two leagues of the fhore or Inlands within this Province, under the penalty of five pounds. V. III. Et qu'il foit auffi ftatué par la même autorité, que qui que ce foit ne pourra, après la publication de cette ordonance, dépouiller, aucuns arbres de leurs écorces, étans ou venus fur les dites grèves refervées pour l'ufage des pêches, ni dans les bois、 adjacens, ou y faire, ou faire faire aucun domage pour tout ufage quelconque, excepté feulement pour le chauffage néceffaire, et pour réparer les cabanes, chafauds, claies et autres chofes néceffaires pour faire leur pêche, et qui que ce foit ne pourra jetter l'ancre, ou faire aucunes chofes pour nuire et empêcher de tirer les rêts dans les endroits acoutumés pour la pêche, ou dans ceux où le faumon eft, et peut être pris et pêché, et de ne point jetter leurs rêts fur celles de qui que ce foit; et aufli que qui que ce foit n'emportera, volera, ou prendra les rêts et filets d'aucun autre pêcheur, ni n'emportera, volera ou prendra aucuns apâts d'aucune chaloupe pêcheufe, ou n'emportera le faumon d'aucun rêt apartenant à tout autre, fous peine d'une amende de cinq livres. IV. Et qu'il foit encor ftatué, par la même autorité, qu'aucun lefte, ou aucune chofe autrement nuifible aux havres dans l'étendue des côtes mentionées dans cette ordonance, ne fera jetté d'aucun vaiffeaux ou autrement, par qui que ce foit, mais que tous leftes ou autres chofes feront portés fur le rivage et mis où ils ne peuvent être nuifibles; et qu'aucun pêcheur ou autres ne jettera aucuns débris ou entrailles de poiffons d'aucuns vaiffeaux ou chaloupes dans la diftance de deux lieuës des rivages ou ifles dans cette Province, fous peine d'une amende de cinq livres. V. Et qu'il foit auffi ftatué, que dans le cas où il arrivera quelques différends ou difputes, entre les maîtres des vaiffeaux pêcheurs, bateaux, chaloupes ou autres bâtimens, quant au droit et à la propriétê des endroits de pêches, chafauds, clayes ou autres comodités ou bâtiffes pour faire leurs pêches, ou pour nétoyer leurs poiffons entre le Cap Chat et le rapide dans la dite riviére Riftigouche dans la Baye des Chaleurs, à Percée ou fur l'ifle de Bonaventure, comme ci-deflus, les dits différends et difputes feront entendus, jugés et déterminés par aucun deu juges à paix de fa Majeflé dans le diftrict, et que dans le cas qu'une des parties fe trouve léfée par tel jugement, il en interjettera apel devant le Lieutenant-gouverneur du diflrict, ou le Juge des Playdoyers-comuns, ainfi qu'il fera plus convenable pour l'appelant de tel jugement, qui font, par ces préfentes, autorifés de le juger définitivement, pourvû que les effets, droits et propriétés, ainfi décidés, n'excédent point la valeur de cinquante livres fterling, auquel cas un apel du jugement du dit Lieutenant-gouverneur, ou du dit Juge des Playdoyers-comuns, pourra être interjetté à la Cour d'apel de la Province. appeal from the judgment of the faid Lieutenant-governor or Judge of Common Pleas may be had to his Majesty's Court of Appeal for the Province, VI. And be it further enacted by the authority aforefaid, that after the appointment of such persons as his Excellency the Governor or Commander in Chief for the time being, may commiffion as cullers and inspectors, all falmon, mackerel, herrings or other wet fifh packed in cafks, fhall, prior to their being shipped for any foreign market, be carefully examined and inspected by fome one of the cullers or inspectors commiffioned as aforefaid; and all fuch as he fall find to be good and merchantable, he fhall brand on the head of the cafk in legible characters his name and the year in which he examined the fame, and for his trouble he fhall be paid fix-pence for every hogfhead, tierce or barrel, and three-pence for every fmaller cafk, and whenever any difputes happen between the feller and purchafer of any dried cod fish, the fame fhall be culled by fuch culler or infpector, for which he fhall be paid at the rate of one penny per quintal; and any culler or infpector commiffioned as aforefaid, who fhall refuse or neglect his duty herein before mentioned, when thereunto required, without a legal and just cause for such refusal, shall forfeit and pay for every fuch neglect and refufal, the fum of five pounds. ན VII. And be it further enacted by the fame authority, that the penalties in this or dinance may be fued for and recovered before any two of his Majefty's Juftices of the Peace for the district, one moiety whereof to be paid to the Receiver-general for the use of his Majesty, his heirs and fucceffors, or to the Commiffioners of his Majefty's Treasury for the time being, and audited by his Majesty's Auditor-general for the plantations, or his deputy, and the other moiety to the perfon who fhall inform and fue and profecute for the fame.
