All commandants of pofts, not being commiffioners of the peace, are hereby required to fend fuch fecurity, together with all informations and papers relative to fuch feizure, and for want of fuch fecurity to fend the goods, wares, merchandizes, provi. fions, boats, battoes, canoes or other carriages fo feized, together with a certificate of the caufe of feizure, to the commiffioners of the peace refiding nearest the place where fuch feizure fhall be made, who fhall proceed therein in manner herein before mentioned.

VI. If any perfon or perfons fhall think him or themselves aggrieved by the judg ment or determination of the faid commiffioners of the peace, it fhall and may be. lawful for fuch person or persons to appeal therefrom, at any time within twelve months from the time of giving fuch judgment or determination, to the governor and council of this province, any five or more of whom (the commiflioners of the peace who fhall have given such judgment or determination only excepted), with the Governor, Lieutenant governor or chief juftice, fhall conftitute a court of appeals for that purpose; who are hereby authorized fully to examine into the grounds and nature of the appeal, and the judgment or determination of the faid commiffioners of the peace to reverse, or affirm, according to the opinion of the major part of the faid court of appeals:—and in case the same shall be reserved, the appellant fhall be reftored to all that he has loft by fuch feizure and condemnation, and be allowed fuch cofts and charges as the faid court shall award and adjudge.

But no perfon fhall be intitled to fuch appeal, unless he fhall have first given good, and fufficient fecurity for profecuting the fame, and paying all fuch condemnation money and cofts, as fhall be awarded by the court of appeals, in cafe the judgment and determination of the commiffioners of the peace fhall be affirmed.

Upon fuch fecurity fo given, the levying of the penalty, and the fale of the goods, pended untill the wares, merchandizes, boats, battoes, canoes, or other carriages feized, fhall be fufdetermination of the appeal. pended, and be made to abide the final determination and judgment of the court of appeals.

Diftribution of VII. All penalties and forfeitures recovered by virtue of this ordinance, fhall be divided and applied in the manner following, that is to fay, after deducting the charges of prosecution from the grofs produce thereof, one moiety of the net proceeds fhall be paid into the hands of the receiver general of this province, for the ufe of the King's Majefty, and the other moiety to the perfon or perfons who fhall feize inform and fue for the fame.

VI.Si quelqu'uns fe trouve lézés, par telle fentence ou décifion des Commiffaires de la paix, fleur fe et pourra être loilible d'en interj. tter appel en tous tems dans l'espace d'une année du tems auquel telle fentence ou décision aura été donnée, au Gouverneur et Confeil de cette Province, dont cinq ou plus des membres (excepté feulement les Commiffaires de la paix qui auront prononcé telle fentence ou jugement) avec le Gouverneur, le Lieutenant gouverneur ou le Juge en Chef, conftitueront une cour d'apel à cet effet qui font, par ces préfentes, autorifes d'examiner le fonds et la nature du dit apel, et d'infirmer ou confirmer la fentence ou décision des dits Commiffaires de la paix, à la pluralité des voix de la dite cour d'apel. Et dans le cas où elle fera infirmée, l'apellant fera reftitué de tout ce qu'il aura perdu par telle faifie et condamnation, ainsi que des frais et dépens que la cour lui allouera et adjugera.

Mais qui que ce foit ne fera reçu à l'apel, à moins qu'il n'ait premierement donné bonnes et fuffifantes cautions de le pourfuivre, de paier le montant de la condamnation, et les frais qui feront alloués par la cour d'apel dans le cas où la fentence et décision des Commiffaires de la paix fut confirmée.

VII. If any perfon fo offending, fhall difcover any other perfon fo offending, fo that fuch perfon be thereupon convicted, the perfon fo difcovering fhall be discharged and indemnified from the penalty by realon of any fuch offence, if fuch perfon fo difcovering hath not been before convicted thereof, and fhall be admitted as an evidence to prove the fame.

III. If any person fhall, after the publication of this ordinance, make, coin or counterfeit or caufe to be made, coined or counterfeited, any brafs or copper money of any fpecies or denomination, or fhall import or caufe to be imported into the province, any falfe or counterfeit copper money, in order to fell or pafs away the fame; fuch perfon fhall, for every fuch offence, forfeit the fum of Twenty pounds, which shall be How to be reco-recovered by information, before two or more commiffioners of the peace, who fhall hear and determine fuch information in a fummary manner, and upon the oath of one credible witnefs (being fome other than the informer) and fhall caufe the faid fum to be levied by warrant of diftrefs out of the offender's goods; and of the faid fum, one half shall belong to his Majefty, and the other half to the informer.
