To Continue and Amend an A&t paffed in the feventeenth Year of His Majefly's Reign, intituled "An Ordinance to impower the Commiffioners of the Peace to regulate the Police in the towns of Quebec and Montreal "for a limited time."

WHEREAS the Province has lately become divided into feveral new Districts ceffary for the internal Regulation of its rifing Towns and Villages in all the feveral Diftricts, as well as in the principal Cities or Towns of Quebec and Montreal; be it therefore enacted by His Excellency the Governor and the Legislative Council, and it is hereby enacted by the Authority of the fame, that the Powers given by any former Ordinance to the Commithioners of the Peace, to make Rules and Orders touching the Police of the towns of Quebec and Montreal, fhall henceforth be vested in such Commiffioners, and where there are Circles with Courts of Requeft, in the Majority of the Commiffioners of the Peace and of the Judges of the Court of Request convened for fuch Purpose.

II. And be it alfo enacted by the fame Authority, that the Rules and Orders fo to be made, may extend to any City, Town or Village of the District to which it be longs, and for which they fhall be declared to be intended, if the object of Regulation fhall be of the nature of that internal Polity appropriate to Cities and Towns, and refpect Strects, Lanes, Alleys, Markets, Water-courfes, Drains, Nufances, the Health of the Inhabitants, prevention of Accidents by Fire, the Affize of Bread, the due exercise of the neceflary Trades of Butchers, Bakers and other neceffary Occupations, Sign-pofts, Cartmen and their Carriages, Pumps, Wells, Fish, Game and Provifions, and fuch other objects as are mentioned in the Regulations made by the Commiffioners or Juftices of the Peace of Quebec of the Month of April in the Year of our Lord One thoufand feven hundred and eighty, and not repugnant to any Law or Ordinance of the Province, nor to the Duties of any of the public Offi cers thereof, every of which faid Rules and Orders shall be valid for no longer Pe riod than Six Months from the Publication thereof, unlefs the fame, fhall be continued or revived and published by a subsequent Order or Regulation in like manner limited and regularly made and ordained.

III. And be it further enacted by the fame Authority, that every Rule, Order and Regulation of Police to be made under the Limitations and Reftrictions above-mentioned, fhall be as valid and binding in the Law as if the fame was fpecially enacted by an Ordinance of the Provincial Legiflature, and that the fame, being duly made, may be enforced and carried into execution by the infliction of Penalties upon Offenders, and in every inflance, exceeding Forty Shillings, fhall be recovered with Cofts, by Action of Debt, Bill, Plaint or Information in any Court of Record, one Moiety whereof fhall belong to the Informer profecuting for the fame, and the Remainder be paid into His Majefly's Treafury for the Ufe of the Crown; and where the Penalty fhall not exceed Forty fhillings it fhall be recoverable fummarily, before a fingle Judge of the Common Pleas, as in caufes where the demand fhall be of Ten Pounds Sterling and under, and be divided and applied in the manner afore-mentioned; and

A Province ayant été, depuis peu, divifée en plufieurs nouveaux Districts, et ayant augmenté dans le nombre de fes Habitans, et étant néceffaire de pourvoir plus amplement au réglement intérieur de fes villes et villages qui s'établiffent dans tous les différens Districts, ainsi que dans les principales villes de Québec et de Montréal ; qu'il foit à ces caules ftatué par fon Excellence le Gouverneur et le Confeil Légiflatif, et il eft par ces préfentes flatué par la dite autorité, que les pouvoirs donnés par aucune Ordonance ci-devant aux Commiffaires de paix, pour faire des réglemens et des Ordres quant à la Police des Villes de Québec et Montréal, feront donnés à l'avenir à tels Commiffaires et dans les endroits où il y aura des Cercles, à la Majorité des Commiffaires de Paix et des Juges de Cour fommaire affemblés pour cet effet.

II. Et qu'il foit auffi ftatué par la dite autorité, que les réglemens et ordres qui feront ainfi faits, pourront s'étendre à aucune Ville ou Village du diftrict auquel il appartient, et auquel ils feront déclarés s'étendre, fi l'objet du réglement fera de la nature de cette Police appropriée aux villes, et qui regarde les rues, les ruettes Yes paffages, les marches, les cours d'eau, les canaux, les nuifances, la fanté des habitans, l'empêchement des accidens du feu, le taux du pain, le jufte éxercise des métiers néceffaires des Bouchers, Boulangers et autres emplois néceffaires, les enfeignes, les Charetiers et leurs voitures, les pompes, les puits, le poiffon, le gibier, et provifions et tels autres objets qui font mentionnés dans les réglemens faits par les Commiffaires ou Juges de paix de Québec du mois d'Avril dans l'année de notre Seigneur mil fept cens quatrevingt, et qui ne feront point contradictoires à aucune Loi ou Ordonance de la Province ni aux devoirs d'aucun des officiers publics d'icelle, et chaque des dits réglemens et ordres feront valides pour un tems qui ne fera pas plus long que fix mois, à compter de leur publication, à moins qu'ils ne foient continués ou remis en force et publiés par un ordre ou réglement fubféquent, dans la même maniére limitée et réguliérement faite et ordonnée.

III. Et qu'il foit de plus ftatué par la dite autorité, que chaque réglement, régle Validité des Ré on ordre de Police qui feront faits fous les limitations et reftrictions ci-deffus men- glemens et or tionnées, feront auffi valides et lieront en Loi, comme s'ils avaient été fpécialement ftatués par une Ordonance de la Législation de la Province, et que les dits réglemens. étant faits duément, feront mis en force et à éxécution, par l'infliction des amendes fur les contrevenans, et dans chaque inftance excédente quarante fhellins, elle fera recouvrée avec les frais, par action de Dette, Bill, Plainte ou Information dans aucune Cour de Record, dont moitié appartiendra au dénonciateur pourfuivant la dite amende, et le refte fera payé au tréfor de fa Majefté à l'ufage de la Couronne et lorfque l'amende n'excédera pas quarante fhellings, elle pourra être recouvrée fommairement, devant un feul Juge des Playdoyers-communs, comme dans les caufes où la demande fera de dix livres fterling et au-deffous, et fera divifée et appliquée de la maniére ci-devant mentionnée, et que la prémiere Ordonance ci-devant mentionnée

that the Ordinance first abovementioned and the last Act or Ordinance to continue the fame, shall be of Force for and during the continuance of this prefent Act; provided nevertheless, and be it further enacted by the fame Authority, that the Power of establishing regulations of Police, fhall extend to no Town or Village with fewer inhabited Houfes than thirty, nor unlefs the regulation of the Police thereof fhall be defired by a Majority of the Heads of the Families in fuch Houfes, under their Signatures before a Notary, filed, in the Office of the Clerk of the Peace of the District, and that no fuch regulation for any Town or Village, in future, fhall bind any Inhabitant without the Precinct of fuch Town or Village aforementioned.

IV. Provided alfo that nothing in this Ordinance contained fhall be conftrued to authorize the affeffment of any Fine or Penalty exceeding Five Pounds.

HEREAS mifchiefs may happen for want of a perfon on the spot to furnish the Documents required for Veffels by the Act intituled, " An Ordinance for pro"moting the Inland Navigation," paffed in the twenty-eighth Year of His Majesty's Reign, whenever there may be a vacancy in the Office authorized to grant the fame, be it therefore enacted by His Excellency the Governor and the Legislative Council, and it is hereby enacted by the authority of the fame, that whenever the Office of Su

Pourvû néanmoins et qu'il foit de plus ftatué par la dite autoritê, que le pouvoir d'établir des réglemens de police ne s'étendra à aucune Ville ou Village qui n'aura pas moins de trente maifons habitées, ni à moins que le Réglement de Police ne foit demandé par une majorité des chefs des familles dans telles maisons, fous leurs feings. devant un Notaire, qui fera filé dans l'office du Greffier de la Paix du district, et tel réglement pour aucune Ville ou Village à l'avenir n'obligera aucun habitant qui fera hors des limites de tel Ville ou Village ci-devant mentionnés.

IV. Pourvû auffi que rien de ce qui eft contenu dans cette Ordonance ne s'entendra à autoriser l'infliction d'aucune peine ou amende qui excédera cinq livres.

THEREAS doubts have arifen refpecting the authority of the Judges of the Courts of Common Pleas in this Province, to ratify and homologate the Refo lutions and Determinations of the Inhabitants thereof at their parifh meetings, for the purpose of building and repairing Churches and Parfonage Houfes, by realon whereof it becomes neceffary to promulgate and make known to His Majefty's fubjects the Laws, Ufages, and Customs refpecting the fame; be it therefore enacted by His Excellency the Governor and the Legislative Council, and it is hereby enacted by the aues, or building or thority of the fame, that whenfoever it fhall become expedient to form Parishes or build or repair Churches or Parfonage Houfes or Cemitaries, the fame course fhall be purfued as was requifite before the conqueft, according to the Laws and Customs at that time in force and practice, and that the Bifhop or Superintendant of the Romish Churches for the time being, fhall have and exercife the rights of the then Bishop of Canada for the purposes afore-mentioned, and that fuch rights as were then in the Crown of France and exercifed by the Intendant and Provincial Government of that day, fhall be confidered as vefted in the Governor or Commander in Chief for the time being, except fo far as may relate to the compelling of the payment of the Affeff-nents and Repartitions for the conftruction and repair of Churches, Prefbytaries and Cemitaries, and all difputes relative to the fame, fhall be recognizable in any of His Majel ty's Courts for Civil Causes to the amount of the matter in controversy.

II. Provided always, and be it also enacted by the fame authority, that nothing in this A&t contained fhall be conftrued to bring any of His Majefty's fubjects of any chargeable with Proteftant denomination whatfoever, or any other perfon than fuch as fhall be of the Roman Catholic communion into charge for any of the purposes aforementioned, or into any manner of compulfory contribution to the fupport of the communion of the Church of Rome,
