after divine service, on the firft funday fucceeding fuch feizure; and at the fame time caufe to be proclaimed, the day and place, when and where he means to proceed to the fale thereof: provided that the place of fale fhall be in the fame parish in which the feizure is made, and provided always that the fheriff fhall not fell any chattels, so to be seized and notified, until eight days after notification of fale as abovefaid. And that, at the request of the plaintiff, the fheriff may caufe goods and merchandises so seized as abovesaid, to be transported from the parish where feized, to the city of Montreal or Quebec (being in the diftritt where feized) and there to be fold after due notice, as aforefaid. And that execution, fo to be iffued against chattels or personal eftate, fhall be made returnable at fuch day as the court from whence it may iffue, fhall judge, reasonable. And that the execution fhall if fue against chattels, or perfonal and real eftate, in one and the fame writ, but that fuch execution fhall be firft levied upon the chattels or perfonal estate, and be returnable as to such first levy, yet nevertheless, may have force and effect, and be returnable also, at a more distant period, as to the fecond levy on real eftate, for the full fatisfaction of the execution aforefaid.

XXXIII. When lands and tenements fhall be feized by the fheriff, under a writ ling real property of execution, he shall advertise the fale thereof, three feveral times, in the Quebec gazette, to be on fome certain day after the expiration of four months from the date of the first advertisement, and proclaim the said sale at the church door of the parish ' in which the premises are fituated, immediately after divine fervice, on the three fundays next preceeding the fale; and caufe a copy of the faid advertisement to be fixed on the door of the parish church; and that lands en roture fhall be fold at the door of the church of the parish where feized, And the fheriff is hereby further required, to advertise, immediately after the feizure, that all and every perfon having any claim on faid lands and tenements, by mortgage, or other right or incumbrance, de give notice thereof at his office, either before or after the fale, where the law makes a diftinction, and to remove all doubts, the fale then by the fheriff, without any other formality, fhall have the fame force and effect as the decret had heretofore.

XXXV. On every execution the fheriff fhall be allowed all his disbursements, and fhall be authorised to charge over and above, at the rate of two and an half per cent. to be deducted out of the money he levies..

XXXII. Lorfque des meubles feront faifis par le Sherif en vertu d'execution, il en fera publier la faifre à la porte de l'églife de la paroiffe, immédiatement après le fer- dre les meubles, vice divin, le premier Dimanche après la dite faifie, et il fera en même tems publier le jour et le lieu où il fera procédé à la vente d'iceux, pourvû que le lieu de la vente foit dans la même paroille où la faisie a été faite. Et pourvû toujours que le Sherif ne vendra aucuns meubles, ainfi faifis et notifiés, que huit jours après la notification de la vente, comme ci-deffus; et qu'à la requête du demandeur, le Sherif pourra faire transporter les effets et marchandifes faifis, dans les villes de Montréal ou de Québec (étant du district où ils ont été faifis) pour y être vendus après une notification, comme ci-deffus. Et que les exécutions ainfi données contre les meubles, feront raportées à tel jour que la Cour, d'où elles feront émanées, le jugera raisonable. Et que les exécutions fortiront contre les meubles et les immeubles dans le même ordre: mais qu'elles feront premierement prélevées fur les meubles, dont le Sherif fera d'abord fon raport, cependant il aura fa force et fon effet, quoique raporté à un tems plus éloigné quant aux immeubles, pour fatisfaire entiérement à l'éxécution comme ci-dellus.

XXXIII. Lorfque des immeubles feront faifis par le Sherif en vertu d'éxécutions, il en avertira la vente par trois diférentes fois dans la Gazette de Québec, pour être procédé à la dite vente un jour fixé, après l'expiration de quatre mois, du jour de la date du premier avertiffement, et il fera publier la dite vente à la porte de l'églife de la parciffe où feront fitués les biens, immédiatement après le fervice divin, pendant trois Dimanches confécutifs qui précéderont la vente, et fera aficher une copie du dit avertiffement à la porte de l'églife paroifliale; et que les terres en rôture feront vendues à la porte de l'églife de la paroille où elles auront été faifies. Et il eft en outre. ordoné que le Sherif avertira immédiatement après la faiffe, que tous et chaque particuliers qui auront quelques prétentions fur les immeubles, ainfi faifis, par hipotéques, et autres droits, ou fervitudes, en donneront connaiffance à fon bureau, foit avant, ou après la veute, fuivant la diflinction qu'en fait la loi. Et pour lever tous doutes, il est ftatué, que les ventes faites par le Sherif, fans aucunes autres formalités, auront les mêmes forces et effets que les décrets qui étaient faits ci-devant..

XXXIV. Si deux ou plufieurs ordres d'exécutions font délivrés für fentences ou jugemens prononcés le même jour, contre un ou plufieurs defendeurs, et ainfi certifiés fur les ordres d'exécution, elles auront le même privilége et feront remplies dans la même proportion Pourvû.toujours que, aucunes opofitions ou prétentions, font faites au bureau du Sherif, foit devant la vente des meubles, foit devant ou après la vente des immeubles, ainfi qu'il eft requis par la loi. Dans l'un et l'autre, des cas cideffus mentionés, ou lorfque les meubles faifis pourront être reclamés par quelqu'un comine à lui apartenent, dans tous-tels cas le Sherif en fera fun raport à la Cour d'où feta émané l'ordre d'exécution, dans les tems convenables, afin que la dite Cour puiffe fur l'audition de telles prétentions et opofitions et fur celle de parties qui y font intéreffées, adjuger les dites prétentions et opolitions conformément à la loi.

XXXV. Il fera alloué fur chaque éxécution, aux Sherifs tous leurs débourfés, et ils feront autorisés à charger en outre et au deins, deux.et demi pour cent,.qui feront déduits fur le total de l'argent prélevé.

This fummons fhall be figned by one of the judges of the court, and a copy thereof, and of the declaration, ferved on the defendant perfonally, or left at his dwelling house, or ordinary place of refidence, with fome grown person there; and the perfon ferving the fame, fhall inform the defendant, or fuch grown perfon, of the contents thereof.

If at the time mentioned in the fummons, the defendant does not appear, (proof of the fervice thereof being produced in court) the judges, or any one of them, fhall hear the cause, on the part of the plaintiff, and make fuch order, decree, er judgment and award fuch reasonable cofts of fuit, as to him, or them, shall appear agreeable to equity and good confcience.

But if the defendant does appear by himself or his agent, and the plaintiff or his agent does not appear; or appearing, does not profecute or prefecuting, fails in his action; the judge or judges fhall diimifs the defendant, with coits.

If the plaintiff makes good his charge against the defendant, the judge or judges fhall give judgment accordingly, and award cofts and execution; but the execution fhall not iffue until eight days after judgment given.

The execution fhall go against the moveables only of the defendant, which shall be feized by fome perfon to be for that purpose appointed by the court, and fold by him in the manner mentioned in the thirty-fecond article of this ordinance.

But the execution fhall contain an exception of the party's beats of the plough, implements of hufbandry, tools of his trade, and one bed and bedding, uniefs his other goods and chattels fhall prove infufficient; in which cafe, fuch beafts of the plough, implements of hufbandry, and tools of his trade fhall be fold, but not the bed and bedding.

The judge or judges may, if they think proper, order the debt to be levied by inftalments, provided the time allowed fhall not exceed the space of three months, from the day of iffuing the execution.

XXXVII. In matters as well above, as of, or under the value of ten pounds fterling, if the defendant fhall convey away, or fecrete his effects, or fhall with violence, or by fhutting up his houfe, ftore or fhop, oppofe his effects being feized; in all fuch cafes, on due proof thereof, an execution fhall go against his perfon, to be taken and detained in prison until he fatisfies the judgment; any law, ufage, or custom to the contrary notwithstanding.

XXXVIII. For the fatisfaction of all judgments given in commercial matters, bematters, executi- tween merchants or traders, as well as of all debts due to merchants or traders for on against the bo goods, wares and merchandizes by them fold, execution fhall iffue, not only against the goods, chattels, lands and tenements of the defendant, but also, in cafe they fhall not produce the amount of the plaintiff's demand, against his perfon; to be taken and conveyed into the prison of the district, and there detained, until he pays the amount of the judgment, or otherwife fettles with and fatisfies the plaintiff, any law, ufage or custom to the contrary notwithstanding. Provided that if the defendant, after remaining one month in prifon, fhall make application to the court, and make an affidavit, that he is not worth ten pounds, the plaintiff fhall pay to the defendant the fum of three fhillings and fix pence weekly, for his maintenance, as long as he fhall be detained in prifon at the fuit of the plaintiff; and in times of scarcity, the faid court of common pleas may, in its difcretion, augment the faid allowance, not exceeding the further fum of one fhilling and fix-pence per week. Such payment fhall be made in advance, on Monday in every week; in failure of which the court, from whence the execution iffued, fhall order the defendant to be released; but the plaintiff fhall not be obliged to make fuch payment, if he can prove, to the fatisfac tion of the court by which the defendant ftands committed, that the defendant has fecreted or conveyed away his effects, to defraud his creditors.

XXXIX. When any perfon, against whom judgment fhall be given, in any of the of one diftrict in courts of common pleas, fhall not have fufficient goods, chattels, lands or tenements, to fatisfy fuch judgment, within the jurifdiction of the court wherein fuch judgment fhall have been obtained; but fhall have goods, chattels, lands or tenements within the jurifdiction of the other court of common pleas; it fhall be lawful for the judge or judges of the court wherein judgment shall have been obtained, to award execution to the fheriff of the other diftrict, who, after getting the writ indorfed by one of the judges of the court for the district in which the goods, chattels, lands or tenements are fituated, fhall execute the fame, and make return thereof to the court from which it iffued; and fuch writ and return fhall be, by him fent to the fheriff of the district from whence the writ was originally awarded, to be delivered into the court that iffued the fame. The fheriff executing fuch writ, fhall be anfwerable for his doings relative thereto, before the court from which it was originally awarded. And the judges of the court of common pleas for the one diftrict, may in like manner, award execution against the body of a perfon refiding in the other, in cafes where fuch execution is by the law allowed; and the sheriff executing the writ to him in fuch cafe directed, fhall convey the body of fuch perfon into the prifon of the diftrict wherein fuch perfon fhall be arrested.

XL. That this ordinance fhall continue and be in force, for and during two years from the first day of May next, and unto the end of the feffions of the legislative
