Provided always, and be it enacted, that no perfon, profeffing the Religion of the Church of Rome, and refiding in the Lid province, fhall be obliged to take the oath required by the faid ftatute paffed in the first year of the reign of Queen Eliza. beth, or any other oaths fubftituted by any other Act in the place thereof; but that every fuch perfon who, by the faid flatute, is required to take the oath therein mentioned, fhall be obliged, and is hereby required, to take and fubfcribe the following cath before the Governor, or fuch other perlon in fuch Court of Record as his Majefty fhall appoint, who are hereby authorized to adminifter the fame, videlicet,

And every fuch perfon, who fhall neglect or refufe to take the faid oath before-mentioned, fhall incur and be liable to the fame penalties, forfeitures difabilities, and incapacities, as he would have incurred and been liable to for negle&ing or refufing to take the oath required by the faid ftatute paffed in the first year of the reign of Queen Elizabeth.

VIII. And be it further enacted by the authority aforefaid, that all his Majefty's Canadian fubjects within the province of Quebec, the religious Orders and Communities only excepted, may alfo hold and enjoy their property and poffeffions, toge ther with all cultoms and ufages relative thereto, and all other their civil rights in as large, ample, and beneficial manner, as if the faid proclamation, commiffions, ordinances, and other acts and inftruments, had not been made, and as may confift with their allegiance to his Majefty, and fubje&ion to the Crown and Parliament of Great Britain; and that in all matters of controverfy, relative to property and civil rights, refort fhall be had to the laws of Canada, as the rule for the decifion of the fame; and all causes that fhall hereafter be instituted in any of the Courts of Juftice, to be appointed within and for the faid province by his Majefty, his heirs and fucceffors, fhall, with refpect to fuch property and rights, be determined agreeably to the faid laws and customs of Canada, until they fhall be varied or altered by any ordinances that fhall, from time to time, be paffed in the faid province by the Governor, Lieutenant Governor, or Commander in Chief, for the time being, by and with the advice and confent of the Legislative Council of the fame, to be appointed in manner herein aftermentioned.

And whereas the certainty and lenity of the Criminal Law of England, and 'the benefits and advantages refulting from the ufe of it, have been fenfibly felt by the inhabitants, from an experience of more than nine years, during which it has been uniformly administered;' be it thereof further enacted by the authority afore. faid, That the fame thall continue to be adminiftered, and fhall be obferved as law in the province of Quebec, as well in the description and quality of the offence as in the method of profecution and trial; and the punifhments and forfeitures thereby inflicted to the exclufion of every other rule of Criminal Law, or mode of proceeding thereon, which did or might prevail in the faid province before the year of our Lord one thoufand feven hundred and fixty-four; any thing in this Act to the contrary thereof in any refpe&t notwithstanding; fubject nevertheless to fuch alterations and amendments as the Governor, Lieutenant Governor, or Commander in Chief for the time being, by and with the advice and confent of the Legiflative Council of the faid province, hereafter to be appointed, fhall, from time to time, caufe to be made therein, in manner herein-after directed.

' XII. And whereas it may be neceffary to ordain many regulations for the future 'welfare and good government of the province of Quebec, the occafions of which cannot now be forefeen, nor, without much delay and inconvenience, be provided for, 'without intrufting that authority, for a certain time, and under proper reftrictions, to 'perfons refident there: And whereas it is at prefent inexpedient to call an Affembly;' be it therefore enacted by the authority aforefaid, That it fhall and may be lawful for his Majefty, his heirs and fucceffers, by warrant under his or their Signet or Sign Manual, and with the advice of the Privy Council, to conftitute and appoint a Council for the affairs of the province of Quebec, to confift of fuch perfons refident there, not exceeding twenty-three, nor lefs than feventeen, as his Majefty, his heirs and fucceffors, fhall be pleafed to appoint; and, upon the death, removal, or abfence of members of the faid Council, in like manner to conftitute and appoint fuch and fo many other person or perfons as fhall be neceflary to supply the vacancy or vacancies; which Council, fo appointed and nominated, or the major part thereof, fhall have power and authority to make Ordinances for the peace, welfare, and good government, of the faid province, with the confent of his Majefty's Governor, or, in his abfence, of the Lieutenant Governor, or Commander in Chief for the time being.

XI. Et comme la clarté et la douceur des loix criminelles d'Angleterre, dont il re'fulte des bénéfices et avantages que les habitants ont fenfiblement reffenti par une ex- nelles périence de plus de neuf années, pendant lefquelles elles ont été uniformement ad- font dans la Pro'miniftrées, il eft, à ces caufes, auffi Etabli par la fufdite autorité, Qu'elles continueront vince, à être adminiftrées, et qu'elles feront obfervées comme loix dans la dite province de Québec, tant dans l'explication et qualité du crime que dans la maniere de l'inftruire et de le juger, en conféquence des peines et amendes qui font par elles infligées, à l'exclufion de tous autres réglemens de loix criminelles, ou maniéres d'y procéder qui ont prévalus, ou qui ont pu prévaloir en ladite province, avant l'année de notre Seigneur mil fept cens foixante quatre, nonobftant toutes chofes à ce contraires contenues en cet acte à tous égards, fujets cependant à tels changemens et corrections que le Gouverneur, Lieutenant Gouverneur ou Commandant en Chef, de l'avis et conlentement du Confeil Legiflatif de la dite province qui y fera établi par la fuite, fera à l'avenir, dans la maniere ci-après ordonnée.

XII. Comme il pourra auffi être néceffaire d'ordonner plufieurs réglemens pour 'le bonheur futur et bon gouvernement de la province de Quebec, dont on ne peut préfentement prévoir les cas, et qu'on ne pourrait éta blir, fans courir les rifques de beaucoup de retardement et d'inconvéniens, à moins d'en confier l'autorité pendant 'un certain tems, et fous des limitations convenables, à des perfonnes qui y refideront: 'et qu'il eft actuellement très defavantageux d'y convoquer une Affemble: Il eft à ces causes, Etabli par la fufdite autorité, Qu'il fera et pourra être loifible à fa Majefté, fes héritiers et fucceffeurs, par un ordre figné de leur main, de l'avis du Confeil Privé, d'établir et conftituer un Confeil pour les affaires de la province de Québec, compofé de telles perfonnes qui y refideront, dont le nombre n'excedera point vingt trois membres, et qui ne pourra être moins de dix-fept, ainsi qu'il plaira à sa Majefté, fes héritiers et fu effeurs, de nommer; et en cas de mort, de démiffion, ou d'abfence en quelques-uns des membres du dit Confeil, de conflituer et nommer en la même maniére telles et autant d'autres perfonnes qui feront néceffaires pour en remplir les places vacantes: lequel Confeil ainfi conftitué et nommé, ou la majorité d'icelui, aura le pouvoir et autorité de faire des Ordonnances pour la Police, le bonheur et le bon gouvernement de dite province, du confentement du Gouverneur, ou en fon abfence, du Lieutenar Gouverneur, ou Commandant en Chef.

XVIII.
