AN ACT to repeal certain Parts of an Act, paffed in the Fourteenth Year of His Majefty's Reign, intituled, An Act for making more effectual Provifiou for the Government of the Province of Quebec, in North America; and to make further Provifion for the Government of the faid Province.

WHE

HEREAS an Act was paffed in the Fourteenth Year of the Reign of His present Majefty, intituled, An At for making more effectual Provifion for the Government 14 Geo, III. cap, of the Province of Quebec in North America: And whereas the faid Act is in many Refpects inapplicable to the prefent Condition and Circumftances of the faid Province: And whereas it is expedient and necessary that further Provifion fhould now be made for the good Government and Profperity thereof: May it therefore pleafe Your moft Excellent Majefty that it may be enacted; and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this present Parliament affembled, and by the Authority of the same, That fo much of the faid Act as in any Manner relates to the Appointment of a Coun cil for the Affairs of the faid Province of Quebec, or to the Power given by the faid Act to the faid Council, or to the major Part of them, to make Ordinances for the Peace, Welfare, and good Government of the faid Province, with the Confent of His Majefty's Governor, Lieutenant Governor, or Commander in Chief for the "Time be ing, fhall be, and the fame is hereby repealed.

II. And whereas His Majefty has been pleafed to fignify, by His Meffage to both Houfes of Parliament, His Royal Intention to divide His Province of Quebec into Two separate Provinces, to be called The Province of Upper Canada, and The Prothe intended Pro- vince of Lower Canada; be it enacted by the Authority aforefaid, That there fhall be within each of the faid Provinces refpectively a Legislative Council, and an Aflembly, to be feverally compofed and conflituted in the Manner herein-after described; and that in each of the faid Provinces refpectively His Majefty, His Heirs or Succeffors, fhall have Power, during the Continuance of this Act, by and with the Advice and Confent of the Legiflative Council and Affembly of fuch Provinces refpectively, to make Laws for the Peace, Welfare, and good Government thereof, fuch Laws not being repugnant to this Act; and that all fuch Laws, being paffed by the Legiflative Council and Affembly of either of the faid Provinces refpectively, and affented to by His Majefty, His Heirs or Succeffors, or affented to in His Majefty's Name, by such Perfon as His Majelly, His Heirs or Succeffors fhall from Time to Time appoint to be the Governor, or Lieutenant Governor of fuch Province, or by fuch Perlon as His Majefty, His Heirs or Succeffors fhall from Time to Time appoint to adminifter the Government within the fame, fhall be, and the fame are hereby declared to be, by virtue of and under the Authority of this Act, valid and binding to all Intents and

N A&te aiant été pallé dans la quatorziéme année du Regne de sa présente Majesté, intitulé, Alle qui pourvoit plus efficacement pour le Gouvernement de la Pro- 14me Geo. III Et le dit Acte n'étant plus à pluvince de Quebec, dans l'Amérique du Nord: fieurs égards, applicable à la préfente condition et circonftances de la dite Province; Et étant expédient et néceffaire de pourvoir actuellement plus amplement pour le bon Gouvernement et la profpérité d'icelle: A ces caufes, qu'il plaife à votre très Excellente Majefté, qu'il foit flatué, et il eft ftatué par la très Excellente Majestė, du Roi, par et de l'avis et confentement des Lords Spirituels et Temporels, et des Communcs, affemblés dans ce préfent Parlement, et par la dite Autorité, Qu'autant du dit Acte qui a dáns aucune maniere rapport à la Nomination d'un Confeil, pour les affaires de la dite Province de Québec, ou au pouvoir donné par le dit Acte au dit Confeil, ou à la majorité des membres, de faire des Ordonnances pour la paix, le bonheur et le bon gouvernement de la dite Province, avec le confentement du Gouverneur de fa Majefté, du Lieutenant Gouverneur, ou Commandant en Chef pour Je tems d'alors, fera et eft par ces piéfentes rappellé.

II. Et aiant plû à fa Majefté de fignifier par fon meffage aux deux Chambres de Parlement, fon intention Royale de diviler fa Province de Québec en deux provin ces féparées, qui feront appellées la Province du Haut Canada et la Province du BasCanada; il eft ftatué par la dite autorité qu'il y aura dans chacune des dites provinces refpectivement un Confeil Legifla.if et une Affemblée, qui feront feparément compofés et conftitués dans la maniere qui fera ci-après défignée; et que dans chacune des dites provinces refpectivement fa Majeflé, fes héritiers ou fucceffeurs, auront le pouvoir, pendant la continuation de cet Acte, par et de l'avis et conientement du Confeil Légiflatif et de l'Affemblée de telles Provinces refpectivement, de faire des Loix pour la tranquilité, le bonheur et le bon Gouvernement d'icelles, telles Loix ne répugnant point à cet acte: Et que toutes et telles loix, qui feront paffées par le Confeil Legillatif et l'Ailemblée de l'une ou l'autre des dites Provinces respectivement, et qui feront approuvées par fa Mjefté, fes Heritiers ou Succeffeurs ou approuvées au nom de fa Majefté, par telle Perfonne que fa Majefté, fes Héritiers ou Succeffeurs nommeront de tems à autre pour ètre Gouverneur ou Lieutenant Gouverneur de telle province, ou par telle perfonne que fa Majefté, les Heritiers ou Succefleurs nommeront de tems à autre pour l'adminiftration du Gouvernement dans icelle, fe

III. And be it further enacted by the Authority aforefaid, That for the Purpose of conftituting fuch Legislative Council as aforefaid in each of the faid Provinces refpectively, it fhall and may be lawful for His Majefty His Heirs or Succeffors, by an Inftru ment under His or their Sign Manual, to authorize and direct the Governor or Lieutenant Governor, or Perfon administering the Government in each of the faid Provinces respectively, within the Time herein-after inentioned, in His Majefty's Name, and by an Inftrument under the Great Seal of fuch Province, to fummon to the faid Legiflative Council, to be established in each of the faid Provinces refpectively, a fufficient Number of difcreet and proper Perfons, being not fewer than Seven, to the Legiflative Council for the Province of Upper Canada, and not fewer than Fifteen, to the Legiflative Council for the Province of Lower-Canada; and that it fhall also be lawful for His Majefty, His Heirs or Succeffors, from Time to Time, by an Inftrument under His or their Sign Manual, to authorize and direct the Governor or Lieutenant Governor, or Perfon adminiftering the Government in each of the faid Provinces refpectively, to fummon to the Legislative Council of fuch Province, in like Manner, fuch other Person or Perfons as His Majefty, His Heirs or Succeffors, fhall think fit; and that every Person who fhall be fo fummoned to the Legislative Council of either of the faid Provinces refpectively, fhall thereby become a Member of such Legislative Council to which he fhall have been fo fummoned.

IV. Provided always, and be it enacted by the Authority aforefaid, That no Person Age, etc. to be fhall be fummoned to the faid Legiflative Council, in either of the faid Provinces, who shall not be of the full Age of Twenty one Years, and à nanural-born Subject of His Majefty, or a Subject of His Majefty naturalized by Act of the British Parliament, or a Subject of His Majefty, having become fuch by the Conqueft and Ceffion of the Province of Canada.

V. And be it further enacted by the Authority aforefaid, That every Member of each of the faid Legislative Councils fhall hold his Seat therein for the Term of his Life; but fubject nevertheless to the Provisions herein-after contained for vacating the fame, in the Cafes herein-after specified.

VI. And be it further enacted by the Authority aforefaid, That whenever is Majefty, His Heirs or Succeffors, fhall think proper to confer upon any Subject of the Crown of Great Britain, by Letters Patent under the Great Seal of either of the faid Provinces, any Hereditary Title of Honour, Rank, or Dignity of fuch Province, def cendible according to any Courfe of Defcent limited in fuch Letters Patent, it fhall and may be lawful for His Majefty, His Heirs or Succeffors, to annex thereto, by the faid Letters Patent, if His Majefty, His Heirs or Succeffors, fhall fo think fit, an Hereditary Right of being fummoned to the Legislative Council of fuch Province, defcendible according to the Courfe of Defcent fo limited with refpect to fuch Title, Rank, or Dignity; and that every Perfon on whom fuch Right fhall be fo conferred, or to whom fuch Right fhall feverally fo defcend, fhall thereupon be entitled to demand from the Governor, Lieutenant Governor, or Perfon adminiftering the Government of fuch Province, his Writ of Sammons to fuch Legislative Council, at any Time

III. Et il eft de plus ftatué par la dite autorité, qu'afin et à l'effet de conftituerte! Sa Majefté pour Confeil Legislatif comme ci-devant mentionné dans chacune des dites Provinces refpectivement, il fera, et pourra être légal à fa Majefté, fes Héritiers ou Succeffeurs, le Lieutenant par un Acte fous fon ou leur Seing Manuel, d'autorifer et ordonner au Gouverneur chaque Province ou Lieutenant Gouverneur, ou à celui qui aura l'adminiftration du Gouvernement dans fommer lea chacune des dites provinces refpectivement, dans le tems ci-aprês mentionné, au nom de fa Majefté, et par un Acte fous le grand Sceau de telle Province, de fommer au dit Confeil Législatif qui fera établi dans chacune des dites Provinces refpectivement, un nombre fuffifant de perfonnes fages et convenables, qui ne fera pas moins de fept au Confeil Légiflatif pour la province du Haut Canada, et pas moins de quinze au Confeil Légiflatif pour la province du Bas-Canada; et qu'il fera auffi légal à fa Majeflé, fes Héritiers ou Succeffeurs, de tems à autre par un Acte fous Son ou Leur Seing Manuel, d'autorifer et de requérir le Gouverneur où le Lieutenant Gouverneur, ou celui qui aura l'adminiftration du Gouvernement dans chacune des dites Provinces refpectivement, de fommer au Confeil Légiflatif de telle province, en la même maniere, telle autre perfonne ou perfonnes que fa Majefté, fes Héritiers ou Succeffeurs, jugeront à-propos: et que chaque perfonne qui fera ainfi fommée au Confeil Légiflatif de l'une et l'autre des dites Provinces refpectivement, deviendra par cela membre de tel Confeil Légiflatif auquel il aura été fommé.

IV. Pourvu toujours, et il eft ftatué par la dite Autorité, Qu'aucune perfonne ne fera fommée au dit Confeil Législatif, dans l'une et l'autre des dites Provinces qui n'aura pas atteint l'age accompli de vingt-un ans, et qui ne fera pas un Sujet né natu rel de fa Majefté ou un fujet de fa Majefté naturalifé par Acte du Parlement Britannique, ou un fujet de fa Majeflé devenu tel par la Conquète et Ceffion de la Province du Canada.

V. Et il eft de plus ftatué par la dite autorité Que chaque membre de chacun des dits Confeils Légiflatifs y gardera fa place pendant le terme de fa vie, fujet néan moins aux conditions ci-après contenues pour la rendre vacante, dans les cas ci-après fpécifiés.

VI. Et il eft de plus ftatué par la dite Autorité, Que toute fois que fa Majefté, fes Héritiers on Succeffeurs, jugeront à propos de conférer à aucun fujet de la couronne de la Grande Bretagne, par Lettres Patentes fous le Grand Sceau de l'une ou de l'autre des dites Provinces, aucun titre Héréditaire d'Honneur, Rang ou Dignité de telle Province, defcendant conformément au Cours de lignage fpécifié dans telles Lettres Patentes, il fera et pourra être legal à la Majefté, fes Héritiers et Succeffeurs, d'y annexer, par les dites Lettres Patentes, dans le cas ou la Majefté, fes Héritiers ou Succeffeurs, le croiront convenable, un droit Héréditaire d'être fommé au Confeil Législatif de telle Province, defcendant conforméinent au Cours de lignage ainfi spécifié, quant à tel Titre, Rang, ou Dignité, et que chaque perfonne à qui tel droit aura été accordé, ou à qui tel droit defcendra ainfi, pourra demander au Gouverneur, Lieutenant Gouverneur, ou à la Perfonne qui aura l'adminiftration, du Gouvernement de telle Province fon Writ de fommation à tel Confeil Légiflatif, en aucun tems après qu'il aúra at teint l'âge de vingt-un ans, fujet néanmoins aux conditions ci-après contenues.
