ants should pay, as is provided in the general leasing act, 12 per cent royalty on past production, and that as to future production the provisions of the general leasing act should apply.

However, to enable the Secretary of the Interior to take over and operate the wells pending final adjustment and disposition, if this bill be enacted, it is provided that the Secretary of the Interior may use so much of the moneys heretofore impounded or hereafter paid in as may be necessary to cover expenses of administration and supervision, and that the balance remaining, if any, shall be paid to the parties found to be entitled thereto. As to future operations under the proposed law and the general leasing act, I have suggested that out of the 10 per cent to be paid into the Treasury of the United States, the Secretary of the Interior be authorized to expend such portion as may be required to pay the expense of administration and supervision. The general leasing law, while producing very substantial revenues for the benefit of the reclamation fund, the State, and the General Treasury, made no provision for payment of the expenses necessarily incident to proper administration of the act and supervision over the wells and production therefrom. Congress has, during the past two years, made an appropriation for this purpose in the general appropriation act. but the activity of prospectors and lessees has been such, and so many new fields are being explored, that the amounts allotted are inadequate to provide for such supervision as should be had in the public interest; for example, under the provisions of section 36 of the act of February 25, 1920, the Secretary is directed to sell royalty oils; no provision is, however, made for securing storage for the daily production of the wells, either by construction, rental, or otherwise, and the oil must be disposed of as provided or go to waste. If the Secretary can be given this authority, it will aid materially in the administration of the act and in the conservation, protection, and proper development of these resources.
