El Gobierno de los Estados-Unidos Mejicanos por una parte, y el de la República de Chile por la otra, deseando confirmar y estrechar los sentimientos de fraternidad que entre ambas Republicas han existido siempre por la intendidad de su orijen, idioma, costumbres é intereses; y establecer reglas seguras para la conservacion y fomento de sus relaciones comerciales por medio de un Tratado solemne de Amistad, comercio y navigacion, han nombrado con este objeto sus respectivos Plenipotenciarios, á saber: Su Excelencia el Vice-Presidente de los Estados-Unidos Mejicanos à Su Excelencia Don Miguel Ramos Arispe; Y Su Excelencia el Vice-Presidente de la República de Chile à Su Excelencia Dón Joaquin Campino. Quines despues de haberse comunicado mútuamente sus Plenos Poderes, y hallándolos en buena y debida forma, han acordado y concluido los Artículos siguientes: Art. 1. Será perpetua entre la República de Chile por una parte, y los Estados Unidos Mejicanos por la otra, aquella estrecha y franca amistad que ha existido siempre entre ambas, por la identidad de su orijen, idioma, leyes y costumbres; y que tanto importan al interes comun de su reciproca independencia y libertad. 1 1831 1. In the name of Almigthy God, the Creator and Legislator of the Universe. The Government of the United States of Mexico on the one part, and that of the Republic of Chili on the other, being desirous of confirming and consolidating the fraternal sentiments which have ever existed between the two Republics, from their identity of origin, language, customs and interests; and of establishing permanent regulations for the preservation and encouragement of their commercial relations, by mean of a solemn Treaty of Friendship, Commerce and Navigation, have appointed, for this purpose, their respective Plenipotentiaries, viz : His Excellency the Vice-President of the United States of Mexico, His Excellency, Don Miguel Ramos Arispe; And his Excellency the Vice-President of the Republic of Chili, his Excellency, Don Joaquin Campino. Who, after presenting and examining their respective Full Powers, and finding them in due and regular form, have agreed upon and concluded the following Articles: Art. I. The strict and sincere friendship which has ever subsisted between the Republic of Chili on the one part, and the United States of Mexico on the other, from the identity of their origin, language, laws and customs, and which friendship is so important to the common interests of their reciprocal independance and liberty, shall be perpetual. 1 1831 11. Las partes Contratantes declaran, que los Chilenos y Mejicanos respectivamente, desde su entrada al territorio de la una ó de la otra Kepública, gozarán de la consideracion, derechos y garantías, que por las Leyes de uno y otro Pais gozaren en ellos respectivamente, los que han obtenido carta de naturaleza; con tan solo, que acrediten que en el pais á que pertenecen, están en posesion y goce de Naturalizados, Nativos ó Ciudadanos de él. Podrán en consecuencia, luego que acrediten cualquiera de las cualidades antedichas, solicitar J' obtener carta de ciudadania, observando solo las demas condiciones, que se exijen para ello á los ya naturalizados, por las Leyes respectivas de la una y la otra República. III. Los Naturales de ámbas Repúblicas gozaran de la mas completa libertad para ir con sus buques y cargamentos á todos los lugares, puertos y rios de la una ó de la otra, en los que actualmente se permite, ó en adelante se permitiere entrar, á los Súbditos y Ciudadanos de la nacion mas favorecida. Podrán permanecer y residir en cualquier lugar de las mencionadas Repúblicas, y ocuparse libre y seguramente en la industria, profesion, jiro ú oficio, que mas les convenga; arreglándose á las Leyes de cada Pais para sus Naturales respectivos. IV. Todo comerciante, comandante de buque ú otros, naturales, bien sean de la República de Chile, en Méjico, ó de la de Méjico en Chile, estaran exentos de todo servicio militar forzoso en el Ejército y Armada, no se les impondrá especialmente a ellos préstamos forzosos, y su propiedad no estará sujeta á otras cargas, requisiciones ó impuestos que los que se paguen por los Nativos del respectivo Pais. ό V. Los naturales de ambas Repúblicas gozarán respectivamente en la una y en la otra, de libertad completa para manejar por si sus propios negocios, ó para encargar su manejo á quien mejor les parezca, sea corredor, factor, ó ajente; no se les obligará á emplear para estos objetos otros personas, que las que se acostumbran emplear por los naturales; ni estarán obligados á pagarles mas II. The Contracting Parties declare that Chilians 1831 and Mexicans respectively, immediately upon their entering the territory of either Republic, shall enjoy the same respect, rights and privileges, as are lawfully enjoyed in each respective Country by those who have obtained letters of naturalization; provided always, that the said individuals prove, that, in the Country to which they belong, they are in the possession and enjoyment of all the rights belonging to Naturalized Persons, Natives or Citizens. In consequence of which, they can, as soon as they have given proof of possessing either of the above qualifications, solicit and obtain letters of citizenship, subject to the other conditions required in such case from those already naturalized by the respective Laws of the two Republics. III. The Natives of the two Republics shall enjoy the most unrestricted liberty of proceeding with their ships and cargoes to all the towns, forts and rivers of either State, wherever the Subjects and Citizens of the most favoured Nation are now, or shall hereafter, be allowed to enter. They may stay and reside in any Town of the said Republics, and engage in, and exercise, in full and complete security, any trade, profession, pursuit or office they may prefer; provided always that they duly observe the Laws existing in each Country, respectively, for the Natives. IV. All Merchants, Masters of Vessels, and others, Natives of the Republic of Chili, or of that of Mexico, who may be respectively in Mexico or Chili, shall be exempt from all compulsory military service either in the Army or Navy, and especially from all forced contributions, and their property shall not be liable to any other charges, demands, or imposts than such as are paid by the Natives of the respective Country. V. The Natives of the two Republics shall respectively enjoy in both States, an uncontrouled freedom in the management of their private affairs, or in intrusting the management of them to whatsoever Broker, Factor, or Agent they may think fit: they shall not be required to employ for this purpose any other persons than those who are usually employed by the Natives; neither shall they be compelled to pay them |
