to advance and to pay to the proper Responsible Minister of the Crown, for the purposes of this Act, any sums of money not exceeding in the whole the sum hereby authorised to be raised; and any sums of money so advanced and paid shall be retained by the Treasurer out of any moneys raised by him under the authority hereof.

7. The Treasurer shall on or before the thirtieth day of Sep- Returns. tember in each year, cause an account in abstract to be prepared of the whole receipts and of the expenditure of all moneys advanced to him for the purposes of this Act for the year preceding, under the several distinct heads of receipt and expenditure, with a statement of the balance of such account duly audited and certified by the Auditor-General, and a copy of such account shall be forthwith published in the Government Gazette.

8. This Act may be cited as "The Public Purposes Loan Act, Short Title. 1878."

An Act to amend the Marine Board Act of 1860.

[Reserved, 30th November, 1878.]

HEREAS it is expedient to amend the Marine Board Act of 1860, with reference to the engagement and discharge of seamen of home trade ships-Be it therefore Enacted by the Governor of the Province of South Australia, with the advice and consent of the Legislative Council and House of Assembly in this present Parliament assembled, as follows:

1. This Act may be cited as Marine Board Amendment Act, Short title. 1878.

2. In the construction of this Act the expression "Home trade Home trade ship. ship" shall include every ship employed in trading or going between any places within the limits of the Province of South Australia, excepting the Northern Territory.

the agreement to be read over and explained to the seaman, and the seaman shall thereupon sign the same in the presence of some person who shall sign as attesting witness, and, in any default in the premises, the master or owner shall for each offence incur a penalty not exceeding Five Pounds.

5. In cases where several home trade ships belong to the same owner the agreement with the seaman may be made by the owner instead of by the master, and the seaman may be engaged to serve in any two or more such ships: Provided the names of the ships and the nature of such services are specified in the agreement; but, except as aforesaid, all provisions which relate to ordinary agreements shall be applicable to agreements made in pursuance of this section.

6. The provisions of sections 68, 69, 70, and 71 of the Marine Board Act of 1860, shall apply to any discharge although not effected before an officer of a mercantile marine office, except that the mutual release mentioned in section 68 may be attested by any person, and shall be executed in duplicate and one copy shall be retained by each party, and one copy of the report mentioned in section 69 shall be delivered to the seaman, and the account mentioned in section 70 shall be delivered to the seaman.

7. This Act shall come into operation from and after a day to be fixed by the Governor, by Proclamation in the Government Gazette, and such day shall be not more than three months from the day upon which Her Majesty's pleasure upon the said Act shall be signified in the said Gazette.

8. This Act shall be incorporated with the Marine Board Act of 1860, and the Acts amending the same.

I reserve this Bill for the signification of Her Majesty's pleasure thereon.

An Act to authorise the Shareholders in a Joint Stock Company or Association, called "The Commercial Bank of South Australia," to carry on the business of Banking in the Province of South Australia, to incorporate such Shareholders under the style or title of "The Commercial Bank of South Australia," and to limit their liability.

[Assented to, 22nd October, 1878.] HEREAS a Joint Stock Company, under the name, style, or Preamble. title of "The Commercial Bank of South Australia," has been lately formed in the City of Adelaide, in the Province of South Australia, under and subject to the covenants, clauses, articles, conditions, stipulations, regulations, and provisions contained in a certain deed purporting to be the deed of settlement of the said company, and bearing date the thirteenth day of August, in the year of our Lord one thousand eight hundred and seventy-eight, and the additions, alterations, variations, and modifications to be made in pursuance of such provisions: And whereas, by the said deed of settlement, the several parties thereto covenanted and agreed to be and continue associated together (until dissolved under the provisions in that behalf therein contained) as a Joint Stock Company or Association, under the name, style, or title of "The Commercial Bank of South Australia," for the purpose of carrying on the business of a bank of issue and deposit, the lending of money on cash credits, promissory notes, bills of exchange, or letters of credit, and on other securities, the dealing in money, bullion, specie, gold-dust, assayed gold, precious metals, and exchanges of and with all countries, and in notes, bills, drafts, or other securities for money, and generally the transacting of all such other business as was then or should or might at any time thereafter be usual for establishments carrying on banking in all its branches, or dealing in
