PREFATORY NOTE.

THE Author must here acknowledge the great assistance he has received in compiling the following pages, from Mr Drysdale (of the firm of Munro, Drysdale, and Gordon, Messengers-at-Arms). Mr Drysdale has most kindly furnished him with almost the entire collection of Forms, and has assisted to revise in proof, not only the Forms, but the greater part of the body of the work itself. The Author begs further to acknowledge obligations for information kindly furnished by Messrs Logan and Barron, of the Teind Office; Mr Wemyss, of the Edictal Citation Office, and many others.

The present treatise is based upon the late Mr Darling's book on the Powers and Duties of Messengers

at-Arms and other Officers of Law. That work has, however, been entirely recast, and the book now assumes the form of an original treatise, which it is hoped will be useful as a guide to practice. When Mr Darling's authority is relied on for any statement, his book is referred to in the notes.

ERRATUM.

At page 103. for, "but the Court have ordered intimation on fourteen days' induciæ," read, "but it is understood that intimation will be ordered on fourteen days' induciæ."
