AN ACT for the relief of certain Sheriffs: Approved December 22, 1798.2 Litt. 229.

WHEREAS certain sheriffs within this Commonwealth, have by law been required to advertise in the public newspapers, certain tracts of land lying in their respective counties, for sale, for the taxes due thereon, in which they have been put to a considerable expense; and whereas there is now no provision made by law for allowing the aforesaid sheriff's a credit for the aforesaid expenses; for remedy whereof,

Be it enacted by the General Assembly, That the aforesaid sheriffs shall be allowed a credit with the Auditor for the several sums they may severally make appear to have been expended in advertising the lands aforesaid. Provided however, That where a sheriff has, through any inaccuracy or neglect of his own, been obliged to advertise more than once, he shall only have credit for the money paid for the last advertisement; and every sheriff shall, before he has such credit, make oath that he has neither directly or indirectly had any of the money so paid by him refunded.

AN ACT to amend an act entitled "an act to amend and reduce into one the several acts concerning constables, and authorizing coroners to summon a jury:" Approved November 24, 1804.-3 Litt. 169.

AN ACT to amend the law of proceedings in civil cases: Approved February 4, 1812.-4 Litt. 386.

SEC. 14. Be it further enacted by the authority aforesaid, That the sheriff executing any such process for a contempt, shall be entitled to sixty-two and a half cents for the arrest, [and five cents per mile for travelling to and returning to execute such process,] to be paid out of the public treasury,* upon the order of such court and the warrant of the auditor, if the person prosecuted shall clear the contempt charged; but if not, to be paid by the person so in contempt.

* By an act of January 18, 1830, Session Acts, p. 74, the above law so far as relates to civil cases is repealed, and that portion allowing mileage is repealed in all cases. The fee of 62 1-2 cents is all that is allowed in criminal or quasi criminal prosecutions, where the witness clears himself of the contempt.

AN ACT to fix the amount of revenue to be collected in the year 1816: Approved
February 10, 1816.-5 Litt. 591.

SEC. 3. Be it further enacted, That the sheriff or collector of each county, shall be entitled to the commission of seven and one half per cent. for collecting the revenue directed by this act, in lieu of the commission allowed by law.

AN ACT to regulate the Fees of Jailers in this Commonwealth: Approved January 31, 1818.-Session Acts, p. 449.

SEC. 3. Be it further enacted, That sheriffs in this Commonwealth be allowed the same fees as jailers are allowed by this act for similar services by them rendered.

AN ACT for the benefit of Sheriffs: Approved January 7. 1824.-Session Acts, p. 455.

SEC. 2. Hereafter, when a senatorial district shall be composed of more counties than one, the several sheriff's in such districts shall be, and they are hereby entitled to the same fees for comparing the polls for any senator in said districts, and for travelling to and from the place of comparison, as they are now allowed by law for similar services, in comparing the polls for a member of congress, payable in like manner.

IN FORCE FROM ITS PASSAGE.

AN ACT to further regulate the pay of the Sheriffs for comparing polls for Governor and Lieutenant Governor: Approved Jan 12, 1825.-Session Acts, p.185. SEC. 1. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That hereafter the sheriffs of the several counties, within this Commonwealth shall be entitled to the same mileage and compensation for comparing polls for Governor and Lieutenant Governor, as is now allowed by law for comparing polls for representatives to congress, and to be drawn in the same manner.

SEC. 2. That the Auditor of Public accounts be, and he is hereby directed, upon the application of the sheriff's of the several counties within this Commonwealth, to issue his warrant upon the Treasurer, for such sum as is provided for by the first section of this act.

AN ACT to provide for the payment of postage on public communications made to
the Executive of this state: Approved December 18, 1800.-2 Litt. 391.
Be it enacted by the General Assembly, That whenever letters
by post shall be directed to the Governor of this Commonwealth,
and contain certain business which shall relate thereto, and upon
which postage shall not be paid, the Governor shall, and he is
hereby authorized to draw on the Auditor of public accounts for
a warrant for the amount thereof, which shall be paid out of the
public treasury.

IN FORCE FROM ITS PASSAGE.

AN ACT to amend an act entitled "an act to provide for the payment of postage on public communications made to the Executive of this state: Approved December 19, 1804.-3 Litt. 235.

Be it enacted by the General Assembly, That the Governor of this Commonwealth, whenever he shall find it necessary to forward militia or other commissions, or any orders to any general or field officer, by post, shall pay the postage thereon, and draw on the auditor of public accounts for a warrant for the amount thereof, which warrant the auditor is hereby directed and requested to issue.
