I HAVE this moment received a letter from M. Count Raftopfchin, in which his Excellency mentions, that his Imperial Majefly, our gracious monarch, has been pleased to take. off the embargo on Englifh fhips, and on the property of Englifhmen in Ruffia.

T HE cruifes which the commandant of the Danish fhips of war in the Mediterranean will make, according to circumftances, against the pirates of Barbary, will always afford an opportunity to the captains of Danith merchantmen to enjoy the protection of the Danifh fhips of war, if they meet them near the harbour or in the open fea. But the captain is to be himfelf refponfible in this cafe, both with regard to the legality of his papers, and that his cargo be of a quality warranted by treaty. The King's meafures againft the pirates in the Mediterranean tend only to reftrain them from acts of violence, and to effectuate the fecurity of the Danish trade in the Mediterranean by an ultimate treaty with the powers of Barbary.

THE army is informed that there is a prolongation of the armiftice for forty-five days, on condition of the furrender of the three places of Ulm, Ingolftadt, and Philipfburgh, which has been confented to by the Emperor.

Head-quarters, Nymphenbourg, Sept. 18, in the eighth Year of the French Republic, one and indivifible.

General in Chiefs

HAVE this inftant received by the telegraph the answer of the government to the difpatches of which its courier was the bearer from Vienna. I cannot communicate to you in a more fatisfactory manner the orders which it has tranfmitted to me than by literally tranfcribing them.

Announce to the Commander in Chief of the Auftrian army, that the Emperor refufes to ratify the preliminaries of peace, and that you are compelled to recommence hoftilities. You may, however, confent to an armiftice for a month, if the enemy inftantly furrenders to you places of fecurity. M. de Lehrbach is immediately to be furnished with paffports.

You fee, General, that the intentions of the First Conful are confpicuously manifefted in favour of peace, fince the renewal of hoftilities depends wholly on the ratification of the treaty of preliminaries concluded with M. de St. Julien; and that he thinks it his duty not to expofe himself to endlefs diplomatic difcuffions without fecurities for the fincerity of our enemy's intentions.

I have charged the General of Brigade Lahorie, to proceed to the advanced pofts of the army under my command, for the purpofe of requiring of you the places of fecurity for which new conjunctures juftify us in making the demand. Should the propofitions which he has to fubmit to you be rejected, hoftilities will be. refumed after to-morrow, at break of day (the 3d complementary day, Sept. 20th).

I beg your Royal Highnefs will receive the affurance of the high confideration with which I am, &c.

THE French government had, notwithstanding its fucceffes in ' Germany and Italy, confented to negotiate for peace with its enemies.

The treaty of the 28th of July, figned at Paris by the Minister for foreign affairs, and the Count de St. Julien, is a proof of its moderation, and a defire to make peace.

The Emperor has conftantly refused to ratify it, and, upon our declaration to recommence hostilities, proposes to enter into another negotiation.

Our government accedes to it; but perfuaded, like all Europe, that our enemies have merely wished to gain time to repair their loffes, it demands places of fecurity, that they may ferve as pledges of their good faith.

The Chief Conful, full of confidence in your attachment to the republic and in your valour, confiders himself certain of a fpeedy peace, fince it is you whom he charges with the conqueft of it.

The Commander in Chief orders this proclamation, the treaty of the preliminaries of peace figned at Paris on the 28th of July, and his letter of this day to the Commander in Chief of the Auftrian army, to be inferted in the general orders of the army, and printed in the French and German languages.

Convention for a Prolongation of the Sufpenfion of Arms between the French Army of the Rhine and the Army of his Imperial Majefty in Germany.

THE Count de Lehrbach, Minister Plenipotentiary of his Imperial Majefty with his army in Germany, and the Baron de Lauer, General of the armies of his Majefty, on the one part,

The ad complementary day of the year 8 (19th September 18), his Majefly the Emperor empowers Count de Lehrbach and Baron Lauer to treat with the General of Brigade Lahorie.

The next day, or 3d complementary day, the convention was figned.

and the General of Brigade of the French army of the Rhine, Victor' Fancau Lahorie, on the other, refpectively charged with full powers neceflary to conclude and fign a convention relative to a prolongation of the fufpenfion of arms, have agreed to the following articles:

Art. 1. His Imperial Majefty and King, in confequence of the demand of the First Conful of the French republic, and with a view of giving a proof of his defire to check the calamities of war, confents that the places of Philipsburgh, Ulm, and the for treffes which depend upon it, with the place of Ingolstadt, which are comprehended within the line of demarkation, fixed by the convention of the 15th July laft (the 26th Meffidor), fhall be given up to the difpofition of the French army, as a pledge of his intentions.

2. The garrifons in the places fhall freely depart with every thing belonging to them, and join the Imperial army in Germany. 3. The evacuation of the above places, both with respect to the troops and military ftores of all kinds, is to take place within the fpace of ten days at fartheft. For that purpose, there shall be furnifhed by the French army all the conveniencies and facilities in their power to transport the articles of every kind, which fhall be defrayed at the expense of his Majesty the Emperor and King,With refpect to the poffeffion of the places, there fhall be delivered to the difpofition of the French army, in the courfe of five days, one of the posts on the grand communications. The choice fhall be determined by delegates, who fhall be immediately sent with the utmost dispatch, to afcertain the state of it.

4. The military ftores, provifions, and the military waggons, fhall be equally evacuated, as fhall the artillery, with the exception of that of the Empire. The latter fhall be afcertained and certified by deputies named to that effect.

5. The mode of the conveyance and evacuation of thefe places fhall be determined with the fhorteft delay, by a particular conyention, as well as the evacuation of the fick, who cannot be sent off with the garrifon.

6. In order to carry into effect the above-mentioned regulations, there fhall be a prolongation of the armistice, and suspension of hoftilities between the army of his Imperial Majesty and King, and his allies, and the army of the French republic on the Rhine, of forty-five days, to commence from to-morrow, in which are to be comprehended fifteen days, to ferve as notice for the refumption of hoftilitiès, thould they take place.

7. The Commander in Chief of the army of the Rhine engages to procure the immediate ceffation of hoftilities, with refpect to the army of the French republic in Italy, fhould the renewal of them have taken place.

8. The line of demarkation fixed by the convention of the 15th

of

of laft July (26th Meffidor) is preferved in all its details under the modifications in the 1ft, 2d, 3d, 4th, and 5th articles, as before and hereafter recited.

9. The French army of the Rhine fhall fall back and take a pofition between the two banks of the Ifer, and the Imperial army of Germany thall take poft on both banks of the Inn, each at the distance of 3000 toifes, whether from thefe rivers or the places fituated on their courfe. A chain of advanced pofts fhall only be placed on the line of demarkation, as fixed by the convention of the 15th of laft July (26th Meffidor).

10. The difpofitions of the faid convention fhall be executed in every arrangement that is not contrary to the present. The 8th article of the convention of the 15th July is not only applicable to the inhabitants of the places above mentioned in all its points, but the Commander in Chief is at the fame time invited to take into his confideration the fituation to which the inhabitants have been reduced by the calamities of war.

11. The prefent convention fhall be difpatched by couriers to all the commanders of the corps of the refpective armies, both in Italy and Germany, with the greatest expedition, that hoftilities may not only be and continue fufpended, but that the articles of it may be executed immediately within the term abfolutely neceffary, with refpect to the different distances.

12. Deputies fhall be appointed by the commanders in chief of both armies, in order to carry into effect the articles of the prefent convention.

Concluded, duplicates being interchanged, at Hohenlinden, the
20th of September (third complementary day of the year 8).

The First Conful to the public Functionaries fent from the
Departments.

PRELIMINARIES of peace were figned at Paris on the 28th of July, between Citizen Talleyrand, minifter of exterior relations, and the Count St. Julien. Thefe were ratified within twenty-fours by the Confuls.

Citizen Duroc was charged with conveying them to Vienna. The intrigues of the faction hoftile to peace, which still appeared to enjoy fome credit there, prevented the Emperor from ratifying

them.
