grant fuch regifter, fhall conceive to be competent fecurity, refidents of this province, with condition that if fhe fhall at any time afterwards be employed in any deftination, other than fuch as her clearance or pafs fhall from time to time specify, that the said fum fhall be forfeited.

VI. And be it alfo enacted by the fame authority, that the adventurers in the commerce aforefaid fhall not be punishable or accountable, for the ufe of any wood or timber cut down and taken for fuel, or the purpose of building, mafting, equipping or repairing any fuch veffels, from the ungranted territories and unlocated lands of the Crown, provided always, and be it enacted, that no new-fixed fettlements fhall be any where made in the Western country, except for the temporary protection and defence of commercial effects, without his Majefty's Royal grant or patent first had, under the great feal of this Province.

VII. And be it also enacted by the fame authority, that nothing in this Act shall be conftrued to affect any fmall veffels under the burthen of five tons, found navigating the river St. Lawrence and the bay of Quinty, on the North-eastern side of Lake Ontario, for the convenience of the loyalifts and others in their fettlements: provided always, that no fuch small veffels be at any time ufed for the purpose of any trade prohibited by this Act, or any other law of this Province.

VIII. And to remove the trees felled into the river of St. Lawrence, and the fmall rivers falling into it Weftward of the Eaftern-bounds of the Township of Lancaster, which have greatly incominoded the navigation by compelling boats to contend with the force of the currents, be it further enacted by the fame authority, that the offence aforesaid shail incur the penalty of ten fhillings for every tree fo felled to be recovered in a fummary way before any one of his Majefty's juftices of the peace, and levied by his warrant to any conftable or peace-officer, for the diftrefs and fale of the offenders's goods and chattels at public auction, returning the furplus if any there be, to the offender; and for the removal of the present obftructions by the fifteenth day of July next, it fhall be the duty of the refidents claiming the land on the shores within one league of any tree laying in the water, and inconvenient to the navigation as aforefaid, to take away or prevent the fame, and that every perfon neglecting fuch duty fhall incur the penalty of five pounds, to be recovered in manner aforefaid all which faid penalties fhall belong, one moiety thereof to the Crown, and be paid to the receiver-general and accounted for by him, as his duty and the Royal inftructions may from time to time require, and the other moiety belong to him who fhall fue for the fame.

IX. And be it also enacted by the fame authority, that the perfons fo to be commiffioned for the discharge of the trufts aforementioned, fhall, with all poffible difpatch, make out the clearance of fuch veffei for her intended voyage, and fhall annex the fame to the manifeft of her cargo, which the mafter fhall then deliver to him for that purpose, for which clearance, for every intended voyage, he shall take no greater fee or reward than fuch as are herein after mentioned, to wit, for every vellel from ten to twenty tons burden ten fhillings, for every veffel above twenty and not exceeding fifty tons burden fifteen fhillings, and for every veffel exceeding fifty tons burden twenty fhillings, befide the certificate of a report of arrival at and the palling a poft, which is to be five fhillings, and for demanding any greater fee or reward, fhall forfeit twenty pounds, with cofts of fuit to the party injured, upon due conviction before any one of his Majefty's juftices of the peace, upon a fummary trial to

VII. Et qu'il foit encor ftatué, par la même autorité, que rien de ce qui eft contenu dans cet Acte, ne s'entendra regarder, ni concerner aucuns petits bâtimens dont le port n'excédera point cinq tonneaux qui navigueront fur le Fleuve St. Laurent, ou dans la Baie de Quinty, fur le côté Nord-Eft du Lac Ontario, pour la comodité des loyaliftes et autres dans leurs établissements voifins de ces eaux pourvû toujours que tels petits vaiffeaux ne foyent point employés à aucun comerce défendû par cet Acte, ou par toute autre loi de cette Province.

VIII. Et afin d'ôter les arbres qui ont été arrachés et jettés dans le fleuve St. Laurent, et dans les petites riviéres qui s'y déchargent, à l'Oueft des limites Eft de la juridiction de Lancaster, qui ont été très nuifibles à la navigation, en obligeant les canots de furmonter la force des courans :

Qu'il foit en outre ftatcé, par la même autorité, que quiconque fera coupable d'une telle offense ou contravention, encourra l'amende de dix fhellois pour chaque arbre qu'il aura ainfi arraché et jetté dans les riviéres, qui fera prélevée d'une maniére fomaire devant un des Comiffaires à paix de fa Majefté, fur fon ordre adreffé à aucun conetable ou officier de paix, de vendre et exécuter les meubles et effets du contrevénant à un encan public, en rendant le furplus, s'il y en a, au dit contrevenant; et afin d'enlever les embarras qui exiftent actuellement, pour le quinziéme jour de Juillet prochain, il fera du devoir des habitans réfidens qui demandent des terres fur les bords de ces riviéres, de les nétoyer dans l'efpace d'une lieue, ou d'empêcher qu'il n'y ait aucuns arbres, dans l'eau, nuifibles à la navigation, comm'il eft dit ci-deffus, et quiconque négligera de le faire, payera et encourra une amende de cinq livres qui fera prélevée de la maniére ci-deffus mentionée. Et que moitié des dites amendes appartiendra à la Couronne, et fera remife au Receveur-général qui en rendra compte, ainfi que fon devoir et les inftructions royales, peuvent de tems à autre, lui dicter, et l'autre moitié des dites amendes appartiendra à celui qui aura pourfuivi les dites. contraventions.

IX. qu'il foit auffi ftatué, par la même autorité, que ceux qui feront comiffionés de la maniére ci-deffus mentionée, pour la décharge des devoirs qui leurs font confiés, donneront avec toute la diligence poffible la déclaration à tels vaiffeaux pour les voyages auxquels ils font deftinés. qu'il annéxera à l'état de la cargaifon que le Capitaine lui remettra à cet effet, pour laquelle déclaration, pour chaque tel voyage, il ne recevra aucuns autres honoraires ou émolumens que ceux ci-après mentionés, favoir, pour chaque vaiffeau de dix à vingt tonneaux, dix fhellings, pour chaque vaiffeau au-deffus de vingt tonneaux et qui n'excédera point cinquante tonneaux, quinze fhellings, et pour chaque vaiffeau qui excédera cinquante tonneaux, vingt fhellings, en outre pour le certificat d'un rapport d'arrivée et de paffage à, ou d'un

X. And be it allo enacted by the fame authority, that every perfon convicted in due form of law of making a falfe oath, in any of the cafes in which an oath is required as aforementioned, fhall incur the pains and penalties by law annexed to the guilt of wilful and corrupt perjury.

XI. And be it allo enacted by the fame authority, that if any perfon fhall bona fide have contracted to be one of the crew of any veffel, in any intended adventuring yage in the commerce aforefaid, and fhall have entered into a written contract to perform the fame, and afterwards fhall defert from the fervices of the veffel for twentyfour hours, he fhall, upon due conviction thereof, before one of his Majefty's juftices of the peace, be fent to the common prifon and there remain for the space of one month, without bail or mainprize, unlefs one of the owners, or the captain or conductor of the veffel, fhall, in writing under his hand, directed to fuch juftice and left, with him, confent to his difcharge; and if fach defertion be while fuch veffel is out, and before her return, fuch deferter fhall lofe his wages, and be alfo liable to imprifonment for three months; and it fhall be the duty of the captain or conductor and of the crew to neglect no means in their power, to apprehend and bring to juftice, upon their return from their adventuring voyage, any perfon of the fame, or of any other crew, who shall have committed any crime, which, by the law of the land, is punishable by the lofs of the life or limb of the offender, and for wilful neglect to give affiftance in fuch fervice, or to obey the lawful command of any magiftrate for fuch purpose, fhall upon due conviction, or indictment or information. be fubject to fuch fine and imprisonment as his Majefty's court of King's Bench fhall adjudge against fuch perfon, fo as aforefaid convicted by the regular course of the law.

XII. And be it enacted by the fame authority, that nothing in this Act contained to the contrary notwithstanding, fhall be construed to make it neceffary for any veffel, being a canoe or batteau, or open boat going on thefe Lakes under the burden of ten tons, to be furnished with fuch register as aforementioned..

XIII. Provided nevertheless, that nothing herein enacted, fhall be conftrued to prevent his Excellency the Governor, or the commander in chief of this Province for the time being, upon any great and urgent occafion, when he may think fuch order necessary and for the fecurity of the Province, to prohibit for any given time, by an order under his hand and feal, all fuch velfels and craft from navigating the Lakes, or to prevent the faid Governor or Commander in Chief from making any other temporary regulations regarding these veffels and craft under fimilar circumstances, by an order under his hand and feal, that he fhall judge advifeable or expedient for the like purpose.

XIV. Be it also enacted by the fame authority, and it is hereby enacted, that in the transport of the feveral merchandize and effects as heretofore mentioned in this Act or ordinance, the proprietors of all fuch veffels above twenty tons, fhall be obliged, without favour or affection, to transport all merchandize and effects whatever in due rotation as they fhall have arrived at the place of depofit, according to an open which it has hitherto been usual to keep at fuch poft or depofit under the infpection of the officer commanding, and which open lift it is hereby enacted, fhall continue to be kept in the fame manner, under fimilar inspection, or under that of such other person as fhall be appointed thereto by the Governor or Commander in Chief of the Province

Et qu'il foit auffi ftatué, par la même autorité, que quiconque s'engagera de bonne foi, comm'homme d'équipage, dans aucun vaiffeau deftiné pour ce comerce comme ci-deffus, et qui fe fera engagê par écrit pour le dit engagement, et qui enfuite défertera, et ne remplira pas fes devoirs dans le vaiffeau pendant l'efpace de vingt quatre heures, fera, fur la conviction de tel fait devant un des Comiffaires de paix de fa Majefté, cnvoyé à la prifon publique, et y reftera pendant l'efpace d'un mois fans pouvoir donner caution pour fon élargiffement, à moins qu'un des propriétaires, le Capitaine, ou le conducteur du vaiffeau, ne confente fous la fignature qu'il adreffera et remettra au dit Commiffaire de paix, à fon élargiffement; et s'il déferte tandis que le vaiffeau fera en voyage, et avant fon retour, tel déferteur perdra fes gages, et fera dans le cas d'être emprifonné pendant l'efpace de trois mois, et il fera du devoir du Capitaine, ou du conducteur et de l'équipage de ne négliger aucuns moyens de faire prendre et conduire en juftice aucun et tel particulier, ou de tel autre equipage, qui aura commis aucun crime qui, par la loi du pais eft puniffable par la perte de la vie ou des membres du criminel, et qui que ce foit qui négligera volontairement de donner du fecours pour tel arrêt, ou refufera d'obéir aux ordres d'aucuns magiftrats à cet égard, encouria, fur preuve de conviction, fur une information, telle peine et tel emprifonement, auxquels la Cour du Banc du Roi le condamnera, lorsqu'il en aura été convaincû, dans la forme régulière de la loi.

XII. Et qu'il foit ftatué, par la même autorité, que rien de ce qui eft contenû dans cet A&te, ne s'entendra à obliger aucune voiture d'eau, qui fera canot, bateau, ou chaloupe, fans être ponté, et dont le port fera de dix tonneaux, à obtenir le regître

ci-deffus inentioné.

XIII. Pourvû toujours, que rien de ce qui eft ftatué par cette Acte ne fera entendû empêcher fon Excellence le Gouverneur de cette Province, ou le Comandant en chef, pour le tems d'alors, dans aucune occafion de conféquence, ou preffante, lorfqu'il jugera tels ordres néceffaires pour la fureté de la Province, de défendre, pendant aucun tems fixé, par un ordre fous fon feing et seau, à tous vaiffeaux et barques de naviguer fur les Lacs, ou d'empêcher le dit Gouverneur ou Commandant en chef, de faire tous autres réglemens momentanés, quant à ces vaiffeaux et barques, dans de pareilles circonftances, par un ordre fous fon feing et feau, ainfi qu'il le jugera bon et néceffaire à cet égard.

XIV. Qu'il foit auffi ftatué, par la même autorité, et il eft par ces préfentes flatué, que dans le transport des différens effets et marchandifes, dont il eft ci-devant fait mention dans cet Acte ou Ordonance, les propriétaires de tous vaiffeaux au deflus de vingt tonneaux, feront obligés, fans faveur ni partialité, de transporter tous effets et marchandifes indiftin&tement, à leur tour, et comm'elles arriveront à l'endroit de l'entrepôt, fuivant une lifte publique qu'il a été jufqu'ici d'ufage d'avoir à tel pofte ou

Abuses in the port of Quebec.

HEREAS it is neceffary for the encouragement of navigation, that the pilots in this Province be properly regulated, be it enacted and ordained by his Excellency the Governor and the Legislative Council, and by the authority of the fame it is hereby enacted, that from and after the publication of this ordinance, no perfon fhall take charge of any fhip or veffel as a pilot, without a licence under the hand and feal of his Excellency the Governor or Commander in chief for the time being, on a certificate of his capacity from fuch perfon as his Excellency the Governor or Commander in Chief may think proper to appoint from time to time, to fuperintend or take charge of the pilots, and two experienced mafters of veffels or pilots.

II. The pilots fhall be divided into companies of two pilots and one apprentice at leaft to a company, and every company, on or before the twenty-fifth day of April one thousand feven hundred and eighty-nine, fhall have and poflefs a proper pilot-boat, well fitted with fails, oars and one anchor, and each company fhall have one apprentice at leaft, not more than fixteen nor younger than fourteen years at the time of binding, and they fhall ferve until they have attained the age of twenty-one years.
