XII. Where moveables fhall be taken in Execution by the Sheriff of the District of Heffe, Luneburg, Mecklenburg, or Naffau, or Gafpé, he fhall caufe fuch feizure to be published at the church door of the parish, immediately after divine fervice, on the first Sunday fucceeding fuch feizure; or if there be no Church in the Township or Parish, then, fuch feizure fhall be notified by publication or advertisement in writing. affixed to the door of the Court-houfe of the Diftrict, and alfo at the nearest Grift-mill, as foon as may be after fuch feizure, and the faid notification fhall defign the day and place where and when he means to proceed to the fale thereof, not protracting Sale of Real E fuch fale beyond fourteen days from the date of fuch publication. And when Lands and Tenements fhall be taken in execution by the Sheriff of either of the faid Districts, he fhall advertise the fale by three feveral publications in writing to be fixed at the door of the Court-houfe of the District, and in fome oftenfible place in the office of the Clerk of the Court whence the Execution iffued, and at the nearest Grift mill; fuch notice to be renewed the firft Monday of three fucceffive months preceding the Sale, which fhall not take place in lels than four months after the date of the first publication.

XIII. Be it further enacted by the fame authority, that in all perfonal actions to be inftituted in any of the Districts in this Province, it fhall not be a legal exception that the cause of action arofe out of fuch Diftrict, or that by reafon of the Domicile of the Defendant it ought to be brought elsewhere, but that all the proceedings in füch actions, and the Judgments and Executions thereon, fhall be deemed and adjudged to have the like force and effect in every refpect, as if the caufe of action, and ground of defence had arifen, and all tranfactions relating thereto had happened in the Dif trict where the action is inflituted; any Law, Ufage or Cuftom to the contrary notwithstanding.

XIV. And be it enacted by the fame authority, that the course and power given by fue from one Dif the faid Act, intituled, "An Ordinance to regulate the proceedings in the Courts of "Civil Judicature, and to eftablifh Trials by Juries in actions of a commercial na"ture, and perfonal wrongs to be compenfated in Damages" for perfecting the execution of a Judgment out of the District where the fame was rendered, fhall be purfued in every old or new Diftrict of the Province.

XV. And that parties adjudged in the faid New Diftricts may not be deprived of the New Districts their Right and Benefit of Appeal, be it further enacted by the fame authority, that the giving fecurity as heretofore ufed on the bringing of a Writ of Appeal, fhall as effectualy fufpend execution in Caufes of the faid Diftricts, as in the Old Diftricts on the actual production of a Writ of Appeal, fuch Appellant in all other refpe&ts conforming to the Law of Appeals as it now ftands, and luing out within twenty days after Judgment an office copy of the proceedings in the caule adjudged; which, to prevent delays, shall be as effectual before the appellate Jurifdiction, as if transmit- ́ ted according to the prefent Law and Ulage in Appeals, from the Common Pleas 'Courts of the Old Diftricts.

Heffe, Luneburg, Mecklenburg, Naffau ou Gafpé, il fera publier telle faifie à la porte de l'Eglife de la paroiffe, immédiatement aprés le fervice divin, le premier Dimanche aprés telle faifie, ou s'il n'y a pas d'Eglife dans la jurisdiction ou paroiffe, alors telle faifie fera notifiée par publication ou avertiffement par écrit, affiché à la porte de la Chambre de Cour du dit Diftrict, et auffi au plus prochain moulin, auffi promptement que· poffible après telle faifie, et tel avertiffement défignera le jour et l'endroit où et quand le Sheriff entend procéder à la vente des dits meubles et effets, qui ne fera pas prolongé au delà de quatorze jours, à compter de la date de telle publication, et lorfque des terres et immeubles feront fous exécution par le Shériff de l'un ou de l'autre des dits Diftricts, il donnera par écrit un avertiffement de la vente par trois publications, qui feront affichées à la porte de la Chambre de la Cour du dit Diftrict, et dans quelqu'endroit visible dans le Bureau du Greffier de la Cour d'où l'éxécution a forti, et auffi au plus prochain moulin, et que tel avertiffement fera renouvellé le premier jour des trois mois fucceffifs qui précéderont la vente, qui ne fera faite qu'au moins quatre mois après la date de la premiére publication.

XIII. Qu'il foit de plus flatué par la dite autorité, que dans toutes actions perfonnelles, pourfuivies dans aucun des Diftricts dans cette Province, l'on ne pourra légalement excepter que la caufe d'action s'eft élevée hors de tel Diftrict, ou que par raifon du domicile du défendeur, elle doit être portée ailleurs, mais que toutes procédures en telles actions et jugemens et exécutions fur iceux, feront regardées et jugées avoir le même effet et valeur à tous égards, comme fi la caufe d'action et le principe des défenfes, ainfi que toutes tranfactions concernant la dite action, cuffent arrivés dans le District, où l'action a été pourfuivie, nonobftant toute Loi, Coutume et Ufage

XIV. Et qu'il foit de plus ftatué par la dite autorité, que la forme et le pouvoir donnés par le dit Acte, intitulé, Ordonnance qui régle les formes de procéder dans à l'autre. les Cours de Jurifdiction Civile et qui établit les procès par Jurés en action de na"ture de Commerce et torts perfonnels qui doivent étre compenfés en dommages" pour parfaire l'exécution d'un Jugement hors du Diftrict où il a été rendu, feront faits et existeront dans chaque ancien et nouveau District de la Province.

XV. Et afin que les parties Jugées dans les dits nouveaux Diftricts puiffent n'être pas privées de leur droit et privilége d'apel, qu'il foit de plus ftatué par la dite autorité, qu'en donnant caution, comme il a été en ufage ci-devant fur l'entrée d'un ordre d'apel, l'exécution fera auffi efficacement fufpendue dans les caufes des dits nouveaux Diftrias, comme dans les Anciens, à l'inftant de la production de l'ordre d'apel, tel appellant à tous autres égards fe conformant à la loi des apels, comme elle exifte. actuellement et en faifant fortir, dans vingt jours aprés Jugement, une copie d'office des procédures dans la caufe jugée; ce qui, afin de prévenir des délais, fera auff efficace devant la Jurifdiction d'apel, comme fi elle étoit tranfmife conformément à la Loi actuelle et à l'ufage en apels, des Cours des Plaidoyers Communs des anciens Districts. E it enacted by His Excellency the Governor and the Legislative Council, and it is hereby enacted by the authority of the fame, That the Aft intituled, "An A&t or Ordinance to alter the prefent method of drawing Sleds and Carioles in order to remedy the inconveniences arifing from Cahots or Banks of Snow, formed on the "Winter Roads, and to amend the fame" fo far as the fame affects the conftruction of the Winter Carriages, and the ufe and regulation of the fame, be, after the paffing of this Act, no longer of more force and efficacy, than if the fame Act refpecting the Conftruction of the Winter Carriages had never been made.

CA P. I.

An ACT or

ORDINANCE

To amend the Ordinance intituled "an Ordinance for regulating the Pilotage in the River St. Lawrence, and for preventing Abules in the Port of Quebec."

OR more effectually preventing accidents by fire, and without unnecessary ref traints on the fhipping, be it enacted by His Excellency the Governor and theLegislative Council, and it is hereby enacted by the authority of the fame, that from and after the publication of this Ordinance, it fhall not be lawful to have fire on board of any fhip or veffel laying in the Cul-de-fac or at any of the wharfs or. Fire on board quays in Quebec or the Suburbs thereof, in any other than close cambufes or fire-pla ces made of iron or other metal, brick or flone-and every fire on board any fhip or veffel, laying in the Cul-de-fac or at any of the wharfs or quays aforefaid, fhall be put out at Sun fet and fhall not be lighted again before Sun-rife the next day, and the mafter or owner of any veffel ufing fire-places on board, other than as aforefaid, fhall incur a penalty of five pounds, likewife the fame penalty for permitting fire to be made on board from Sun-down to Sun-rife, and the like penalty for every repeti tion of either of fuch offences..

II. And be it further enacted by the fame authority, that if any veffel fhall, in the night-time, use any lighted candle while laying in the Cul-de-fac or at any wharf or quay aforefaid, fuch candle not being in a lantern, the mafter and perfon or perfons ufing the fame fhall for every offence incur a penalty of twenty fhillings; but this clause shall not be conftrued to prevent the neceflary ufe of candle in the cabin or fteerage tho' the fame be not in a lantern.

III. And be it further enacted by the fame authority, that all propietors of wharfs facing or fronting the Cul-de-fac, fhall affix fufficient ring-bolts at thirty feet diftance from each other in the front or face of their wharfs, and permit the fhipping to make faft thereto, or incur a penalty of ten fhillings for every refusal or neglect; and whereas no danger can arise from permitting pitch or tar, turpentine, or rofin to be heated or boiled in the Cul-de-fac or any other pait or place where veffels lay for the purpose. of graving, if the fire and pitch-pot be at a proper diftance from any wharf, vellel or building; be it therefore enacted by the fame authority, that, notwithstanding any thing to the contrary in the twentieth fection of the faid Act or Ordinance or any other law or ordinance whatfoever, it fhall and may be lawful for the purpofe aforefaid to boil tar or pitch, turpentine or rofin in the Cul-de-fac or at any wharf or quay in or about Quebec; provided always the fame be done at the diftance of twenty feet at leaft from any veffel, wharf or building whatever, and provided that while the fame is heating or boiling, a perfon conftantly attend with a tarpauling and fhovel at hand. to cover the fame in the cafe of its taking fire: and provided alfo, that the fire be immediately thereafter carefully put out and extinguished; any mafter or owner of
