ACT or ORDINANCE

For fecuring more effectually the Toll of the bridge over the river St. Char
les, near Quebec.

HEREAS Nathaniel Taylor, John Coffin, William Lindsay, David Lynd, Pe

and John Purfs, Gentlemen, all of the Province of Quebec, have lately obtained
His Majefty's Letters Patent to conftruct a Bridge over the River St. Charles, near
the city of Quebec, whereby they are authorized to exact, collect, and receive the fe-
veral Tolls herein after mentioned, for paffing the fame, that is to say, for every ca-
lefh, chaife or cart, loaden or empty drawn by one horfe and for the driver, four-
pence; for the fame with two horfes and driver, fix-pence; for every horfe and per-
fon riding the fame, two-pence; for every foot paffenger, one half-penny; for every
ox, cow, or horned cattle, two-pence; for every calf, fheep or fwine, palling on foot,
one half-penny; and fo in proportion for a greater number: and whereas it is appre
hended that other and different articles, not comprized in the faid Letters Patent, may
require to be transported over the faid Bridge, and for which it is proper to ascertain
a certain, fixed rate; be it enacted and ordained by His Excellency the Governor and
the Legislative Council, and it is hereby enacted by the authority of the fame, that
the Juftices of the Peace for the Diflrict of Quebec, in their Quarter Seffions, may,
and they are hereby authorized, from time to time, to fix a Toll for all and every
Carriage or kind of Cattle which may be required to pafs over the faid Bridge, as are
not enumerated in the faid Letters Patent or Ordinance, as herein before mentioned.
And the faid Patentees, and their feveral Heirs, Exccutors and Adminiftrators,
are hereby authorifed to exact, collect, and receive not only the Toll fpeci-
fied in the faid Letters Patent and Ordinance referred to, but alfo fuch Toll as fhall
at any time, and from time to time be fixed by the Juftices in their Quarter Sel-
fions as aforefaid, during the term granted by the faid Letter Patent. And
Whereas the laudable Undertaking of the Patentees in the conftruction of the
faid Bridge, tending to promote His Majefty's fervice, and conducing to the mani-
fest advantage of His Majesty's Subjects in the city of Quebec, and the vicinity there-
of, requires encouragement and protection; it is hereby further enacted by the fame
authority, that no person or persons whatsoever fhall, at any time hereafter during the
term granted by the faid Letters Patent, erect or caufe to be erected any Bridge, or
use or erect any Ferry Boat or Canoe for the pafling or conveying, or fhall in any
manner pass or convey, for lucre and gain, any perfon or perfons or any of the arti-
cles enumerated in the faid Letters Patent, or thofe to be afcertained by the Juflices in
their Quarter Seffions as aforefaid, over the faid River St. Charles, between the
North-West boundary of the land, the property of the Honorable William Grant, Efq.
and the North-Eaft boundary of the lands of the Ladies of the General Hofpital; and
if at any time any perfon or perfons fhall, for lucre or gain, pafs, tranfport, or con-
vey any perfon or perfons, or any of the articles fpecified in the faid Letters Patent,
or to be afcertained by the Juftices in their Quarter Seffions as aforefaid, during the
time the faid Patentees fhall enjoy the fame, fuch offender fhall, for every offence,
forfeit the fum of ten fhillings, recoverable by complaint before any one or more Jul
tices of the Peace, and to be levied by warrant of diftrefs under his or their hand and

ATHANIEL Taylor, John Coffin, Wm. Lynfay, David Lynd, Peter Stewart, Préambule, Charles Stuart et James Johnston, Ecuyers, et Mr. Ralph Gray, et John Purfs tous de la Province de Québec, ayant ci-devant obtenu des Lettres Patentes de sa Majefté, pour conftruire un Pont fur la Riviére St, Charles, près la ville de Québec, en vertu desquelles ils font autorifés à exiger, prélever et recevoir les différens droits de Pontage ci-après mentionnés, pour paffer fur le dit Pont, favoir, pour toute et chaque calêche, chaife ou charette chargée ou vuide avec un cheval et le conducteur, quatre pence; pour les mêmes voitures avec deux chevaux et un conducteur, fix pence; pour chaque passant à pied, un demi penny; pour chaque boeuf, vache ou bête à corne, deux pence; pour chaque mouton ou cochon paffant fans, être tranfporté dans une voiture, un demi penny; et ainfi en proportion pour un plus grand nombre; et étant conçû que d'autres et différens articles, qui ne font point inférés dans les dites Lettres Patentes, peuvent être tranfportés par delà le dit pont, et étant néceffaire pour tels articles de conftater un certain prix fixe; qu'il foit ftatué et ordonné par fon Excellence le Gouverneur et le Confeil Legiflatif, et il eft par ces préfentes ftatué par la dite autorité, qui les Juges à Paix pour le diftrict de Québec, dans leurs Séances de Quartier, pourront et font par ces préfentes autorifés, de tems à autre, de fixer un droit de Pontage, pour toute et chaque voiture ou efpece de beftiaux qui pourront être transportés par le dit Pont, qui ne feront point mentionnés dans les dites Lettres Patentes ou Ordonance ci-devant mentionnées. Et les dits Impétrans et leurs différens Héritiers, Exécuteurs et Adminiftrateurs, font par ces préfentes autorifés d'exiger, de prélever et recevoir non feulement le droit de pontage fpécifié dans les dites Lettres Patentes et l'Ordonance qui y est référée, mais auffi tous et tels droits qui, de tems à autres, feront fixés par les Juges à Paix dans leurs Séances de Quartier comme ci-deffus, pendant le terme accordé par les dites Lettres Patêntes. les dites Lettres Patêntes. Et la louable entreprise de ceux qui ont reçus les Lettres Patentes, dans la conftruction du dit Pont, qui tend à étendre le fervice de fa Majefté, et à l'avantage évident des fujets de fa Majefté, dans la ville de Québec et fes environs, éxigeant l'encouragement et la protection, il eft deplus ftatué par la dite autorité, qu'aucune perfonne quelconque, dans aucun tems ci-après, pendant le terme accordé par les dites Lettres Patentes, ne pourra conftruire aucun Pont, ni fe fervir d'aucun Bac, Bateau ou Canot pour le paffage Limites dans ou le tranfport, ou ne tranfportera ou paffera, ou paTera en aucune maniére, pour lesquelles il ne lucre ou gain aucune perfonne, ou aucun des articles détaillés dans les dites Lettres ftruit aucun autre Patentes, ou ceux qui feront réglés par les Juges à Paix dans leurs féances de Quartier pot ni fe fervir comme ci-deffus fur la dite Riviére St. Charles, entre la borne Nord-Oueft de la terre appartenante à l'Honorable William Grant, Ecuyer, et la borne Nord-Eft des terres des Dames de l'Hôpital Général; et quiconque paffera ou transportera en aucun tems, pour lucre ou gain aucune perfonne, ou aucun des articles fpécifiés dans les dites Lettres Patentes, ou qui feront fixés par les Juges à Paix dans leurs Séances de Quartier ci-deffus mentionnées, pendant le tems que les dits Impétrans en jouiront, tel contrevenant payera une fomme de dix fhellings pour chaque contravention, qui fera prelevée fur plainte portée devant un ou plufieurs Juges à Paix, par ordre de faifie et vente fous leur feing et feau et moitié de telle amende fera

C A P. IV.

An ACT or

ORDINANCE

For preventing Cattle from going at large, or l'Abandon des Animaux.

WHER

THEREAS it has been reprefented by many refpectable inhabitants of the Dif tricts of Quebec and Montreal, that the ufage or cuftom of allowing Cattle to go at large in the Fall and Spring of the year, known under the name of l'Abandon des Animaux, is hurtful to improvement and Agriculture, be it therefore enacted by His Excellency the Governor and the Legiflative Council of this Province, and by the authority of the fame it is hereby enacted and ordained, that from and after the first day of September next, the aforefaid cuftom known by the name of the Abandon, fhall be abolished; that the fences fhall be kept up and maintained at all feafons of the year; nor fhall it be lawful for any perfon, at any time, to break down the fences that feperate his and his neighbour's lands, or the lands of any other perfon, or let his Hor fes, horned cattle, fheep, goats or hogs trefpafs on individuals, or ftray in the pu blic high-roads; any ufage to the contrary notwithstanding. And if any neat cattle, goat or fheep be taken in trespass, or ftraying in the public high-way, the proprietor thereof, over and above the damage which may be recovered in due courfe of law, fhall incur a fine of one fhilling for each neat cattle or goat, and three-pence for each sheep. Cattle taken in And any cattle taken in trefpafs may be detained until reclaimed by the owner thereof, and the reasonable charges of maintaining them fhall be added to the damage done, together with all cofts of fuit; and execution fhall iffue against the defendant's goods and chattles for the amount thereof; provided always that the perfon detaining any fuch cattle fhall have caufed the detention of them to be cried or proclaimed at the Church-door of the parish where taken, on the three fubfequent Sundays after their detention, immediately after divine fervice, if the owner does nor claim them at the firft or fecond crying.

II. And be it enacted by the fame authority, that any perfon or perfons who shall break any fence, or tread down any growing corn, or hemp, or flax, or pulfe or growing vegetable for the fuftenance of man, or enter upon any hay-field, while the grafs for breach of the Re- hay is growing thereon, fhall incur and pay a fine of two fhillings and fix-pence, over and above the damage which may be recovered by the proprietor thereof for eve ry fuch trespass in due courfe of law.

Beftiaux pris en

Qui empêche les Beftiaux d'errer, ou l'abandon des Animaux. PLUSIEURS habitans refpectables des diftricts de Québec et de Montréal, ayant repréfente que l'ufage ou la coutume de laiffer les Beftiaux errer ça et là dans les faifons d'Automne et du printems de l'année, connû fous le nom de l'Abandon des Animaux, eft i juricufe à l'amélioration et à l'Agriculture; qu'il foit à ces caufes ftatué par fon Excellence le Gouverneur et le Confeil Légiflatif de cette Province, et il par ces préfentes ftatué et ordonné, par la dite autorité, que depuis et après le premier jour de Septembre prochain, la coutûme ci-deffus mentionnée, connue fous le nom de l'Abandon, fera abolie; que les clôtures feront entretenues et maintenues dans toutes faifons de l'année; et il ne fera permi à qui que ce foit, dans aucun tems, d'abattre, ou jetter à bas les clôtures qui féparent fa terre d'avec celles qui l'avoifinent, ou de toute terre d'aucun autre perfonne; ou de laiffer fes chevaux, bêtes à corne, moutons, chêvres, ou cochons, caufer du dommage à aucun individu, ou errer dans les chemins publics, nonobftant aucun ufage à ce contraire; et lorfqu'aucune bête à dommages. corne, chêvre ou mouton fera pris en dommage, ou errant dans le chemin public, le propriétaire de tels befliaux, outre et en fus du dommage qui pourra être ordonné contre lui, encourra une amende d'un fhelling par chaque bête à corne, ou chèvre, et trois pence pour chaque mouton. Et tout et chaque bétail qui fera pris en dommage, pourra être retenu jufqu'a ce qu'il foit reclamé par le propriétaire, et les frais raisonnables de la nourriture feront ajoutés au dommage qui aura été fait, ensemble tous les frais de pourfuite; et l'ordre d'exécution fortira contre les biens et effets du défendeur pour le montant d'iceux. Pourvû toujours que celui qui retiendra aucuns et tels beftiaux, fera crier ou publier la prife de tels beftiaux à la porte de l'Eglife' de la Paroiffe dans laquelle ils auront été pris, pendant trois Dimanches confécutifs aprés leur prife, immédiatement après le fervice Divin, fi le propriétaire ne reclame pas les dits beftiaux à la premiere ou feconde criée.

11. Et qu'il foit flatué par la dite autorité, que quiconque brifera aucune clotûre, ou foulera aucun bled, ou froment, ou chanvre ou lin, ou légume ou végétable qui croiffent pour la fubfiftance de l'homme; ou entrera dans aucune prairie à foin tandis que l'herbe y croit, encourra et payera une amende de deux fhellings et fix pence, outre et cu fus du dommage qui pourra être prélevé par le propriétaire d'iceux pour de défoke face tel dommage dans une Cour de Loi.

And be it enacted by the fame authority, that every injury and damage which shall be sustained by every fuch ftraying or trefpafs as beforementioned, may be fued and recovered in the Court of Common-Pleas of the district, or other Court for the trial of small caufes in the circle where the fame fhall be incurred or fuftained, and may be ascertained upon the oath of one or more credible witness not interested in the damage fustained. And the fines impofed by this Act may likewise be fued in either of the aforementioned Courts. And one half of every fine adjudged under the fame fhall belong to His Majefty, and the other half to the informer, upon whofe oath without other proof, being a credible witnefs, the fame may be fued and adjudged, any law regulation, ufage, or cullom to the contrary notwithstanding.

An ACT or ORDINANCE

More effectually to prevent the Desertion of Seamen from the Merchant's

Service.

E it enacted by His Excellency the Governor and the Legiflative Council, and be it enacted by the authority of the fame, that whenever any marriner fhall deferting may be fert from the fhip fert from the fhip or veffel to which he belongs, contrary to the articles by which he may be bound in purfuance of the ftatute in that cafe made and provided, it fhall be lawful to proceed against him in the manner by the said statute directed, and to commit him to the common gaol, where he fhall be detained as effectually as if the fame was such house of correction by as the faid ftatute is intended, and that the keeper of the faid gaol fhall be as compellable to receive and detain fuch marriner, under the penalties to which the keeper of a houfe of correction may be liable on a commitment under the faid ftatute, until fuch marriner fhall be delivered by the due courfe of the law.
