or by neglect or refusal to qualify of any of said commissioners, or by any other cause, such vacancy shall be filled by the city council. A commissioner, so elected to fill a vacancy, shall hold his office for the residue of the unexpired term of the commissioner whose office he is elected to fill, with all the powers and subject to all the restrictions in this act contained.

AN ACT TO ABOLISH THE POLICE COMMISSION OF THE
TOWN OF CUMBERLAND.

It is enacted by the General Assembly as follows:

SECTION 1. Chapter 993 of the public laws, passed at the January session, A. D. 1913, entitled "An act for the appointment of a police commission for the town of Cumberland," chapter 1691 of the public laws, passed at the January session, A. D. 1918, chapter 1818 of the public laws, passed at the January session, A. D. 1919, and chapter 2266 of the public laws, passed at the January session, A. D. 1922, are hereby repealed and the board of police commissioners for the town of Cumberland is hereby abolished.

SEC. 2. All the powers and authority vested in said board by chapter 993 of the public laws, passed at the January session, A. D. 1913, and by all acts in amendment thereof, are hereby conferred and vested in the town council of the town of Cumberland.

SEC. 3. All legal acts, matters and things done, of police comand all rights and powers conferred and all duties validated. imposed by the said board are hereby declared valid and effectual in all respects and shall continue in force until otherwise ordered by said town council.

It is enacted by the General Assembly as follows:

SECTION 1. Section 1 of chapter 1985 of the public laws, passed at the January session, A. D. 1920, entitled "An act fixing the time for holding the annual financial town meeting in the town of East Greenwich," is hereby amended so as to read as follows:

AN ACT REQUIRING A COMMITTEE OF THE BOARD OF
CANVASSERS OF THE TOWN OF EAST PROVIDENCE TO
BE IN SESSION ON ELECTION DAYS FOR CERTAIN
PURPOSES.

It is enacted by the General Assembly as follows:

SECTION 1. The town council of the town of East Providence sitting as a board of canvassers shall designate three of its members, who shall be located in the office of the town clerk, at the town hall, in said East Providence, on all election days between the hours of 10 A. M. and 12 M., and 5 P. M. and 7 P. M.; and any person whose name the town council sitting as a board of canvassers has, through oversight, error or mistake, neglected to place on the voting list of said town, may appear before said three councilmen on election days and file his request to be placed upon said voting lists, setting forth his residence, his qualifications and such other facts in connection with the neglect to place his name upon said list. If, upon hearing, said three councilmen or a majority of them shall find that the name of said person is entitled to a place upon said voting lists and

upon notice in writing to the town clerk or his deputy, by a majority of said three councilmen, the said town clerk, or his deputy shall forthwith certify such name to the moderator in whose district said petitioner is entitled to vote and such name shall be added to the respective voting lists as canvassed for such election and said person shall forthwith be entitled to vote thereon.

SEC. 2. The town clerk or his deputy shall act as clerk of said committee of three councilmen as aforesaid and shall keep a record of its proceedings.

SEC. 3.

This act shall take effect upon its passage.

It is enacted by the General Assembly as follows: SECTION 1. No person, firm or corporation shall excavate or dig into any portion of any of the public highways of the town of East Providence, without Providence. having first obtained the special permit hereinafter mentioned.

SEC. 2. The town council of said town may at any d time issue a special permit authorizing any person, firm or corporation to excavate or dig into the public highways of said town. Before issuing such special permit, however, it shall first receive from such person, firm or corporation a written application setting forth the name and address of such applicant and a designation of the particular portion of said public highways which said applicant desires to excavate or dig into, and a designation of the purpose for which such excavation or digging is to be carried on.
