Every houfe buckets, hatchets, fire-poles, and ladders. CA P. XIII. AN ORDINANCE For preventing accidents by fire.. HEREAS it is abfolutely neceffary for the prefervation of the lives and proper Wies of his Majefty's fubjects, that every precaution should be taken to prevent the dreadful accidents that might happen by fire, in the towns of this province: It is ordained and enacted by his excellency the captain general and governor in chief of this province, by and with the advice and confent of the Legislative council of the fame, that for each of the towns of Quebec, Montreal and Three Rivers, there fhall be an overseer to prevent accidents by fire, to be appointed by his Excellency the governor, the Lieutenant governor or other the commander in chief of this province, for the time being. II. The faid overfeers fhall caufe every chimney made ufe of in the towns, and fuburbs of the towns, in which they are overseers, to be fwept, and scraped as high as poffible, once in every month, by able and fkilful chimney fweepers, whom they fhall employ for that purpose; and for every chimney which they fhall fo caufe to be fwept and fcraped, they fhall receive fix-pence from the occupier of the house to which fuch chimney belongs: and the overfeer fhall forfeit the fum of Five fhillings, for every chimney that fhall be neglected to be fwept and scraped, once in every month, by the perfons employed by him, whether fuch chimney happens to take fire or not; and if the chimney fo neglected to be fwept and scraped fhall take fire, the said overfeer fhall forfeit the fum of Forty fhillings, to be recovered in the manner herein after directed. III. If any occupier of any houfe, or of apartments therein, fhall refufe to let his chimney or chimneys be swept as aforefaid, by the chimney fweepers employed for that purpose by the overfeer of the town in which fuch chimney fhall be fituated; he fhall for every fuch refufal forfeit the fum of Five fhillings; and if the chimney which he shall refufe to allow to be swept fhall take fire, he fhali forfeit the fum of Forty fhillings. IV. Every house-keeper in the faid towns and fuburbs, fhall keep two buckets for carrying water when any house shall happen to be on fire; and thefe buckets fhall be made either of leather, or feal fkin, or of canvas painter on the outfide and covered with pitch on the infide, and fhall hold at least two gallons of water each: the faid buckets shall be marked with the chriftian and furname of the houfe-keeper to whose house they belong. ་ And every houfe-keeper in the faid towns and fuburbs, fhall keep a hatchet in his house to affift in pulling down houses, in order to prevent the spreading of the flames; and two fire-poles,, of the length of ten feet, and five inches diameter, with cross bars made of wood ftuck into them at a convenient distance one from the other, in order to knock off the roofs of houses that are on fire, or that are in immediate danger of becoming fo. And every houfe-keeper in the faid towns and fuburbs, fhall keep as many ladders on each fide of his houfe as there may be chimneys or ftacks of chimneys, to be properly and fecurely fixed with iron hooks or bolts on the roof, and from the roof to the tops of the chimneys, and fo placed that eafy accefs may be had to fweep the chimneys or carry up water to them in cafe of fire. And every proprietor of any buildings covered with wood in the faid towns and fuburbs, fhall keep as many ladders on fuch buildings as the overfeer fhall think reasonable and neceffary.. Il fera nommé TANT abfolument néceffaire pour la confervation de la vie et des propriétés des fu- Préambule. jets de sa Majesté, de prendre toutes les précautions poffibles pour prévenir les accidens afreux qui peuvent arriver par le feu dans les villes de cette Province: Il est Statué et Ordonné par fon Excellence le Capitaine-général et Gouverneur en Chef de cette Province, de l'avis et confentement du Confeil Légiflatif d'icelle ce qui fuit, qu'il fera nommé par fon Excellence le Gouverneur, le Lieutenant-gouverneur ou autre Commandant en Chef de cette Province, un Inspecteur pour prévenir les accidens du feu, pour chacune des villes de Québec, de Montréal et des Trois Riviéres. un Infpecteur pour prévenir les accidens du fen Montréal et Trois Qui fera ramo ner les cheminees Sous peine d'une II. Les dits Infpecteurs feront ramoner et grater, auffi haut qu'il leur fera poffible, une fois chaque mois, toutes les cheminées dont on fe fert dans les villes et faubourgs des villes où ils font Inspecteurs, par des ramoneurs capables et expérimentés qu'ils em- mois, ploieront à cet effet; et ils recevront par chaque cheminée qu'ils feront ramoner et grater un demi fhelling du locataire à qui telle cheminée apartiendra. L'Infpecteur encourra l'amende d'une fomme de Cinq fhellings pour chaque cheminée qu'il négligera de faire ramoner et grater une fois dans chaque mois par les gens qu'il emploiera, foit que telle cheminée prenne en feu ou non; et fi telle cheminée qui n'aura point été ainfi ramonée et gratée prend en feu, le dit Inspecteur encourra l'amende d'une fomme de Quarante fhellings qui fera prélevée de la maniére ci-après ordonnée, III. Si quelque locataire de toutes maifons ou apartemens, refufe de laiffer ramoner ainfi fes cheminées par les ramoneurs emploiés par l'Inspecteur de la ville où elles font fituées, il encourra pour chaque refus une amende d'une fomme de Cinq fhellings; et fi la cheminée qu'il aura refufé de faire ramoner prend en feu, il encourra l'amende d'une fomme de Quarante fhellings. IV. Tous locataires des dites villes et faubourgs auront deux feaux pour charrier l'eau en cas que quelque maifon prenne en feu, et ces feaux feront faits de cuir ou de peau, ou de grolle toile peinte en dehors, et enduits de goldron en dedans qui tiendront au moins deux galons d'eau chaque. Les dits feaux feront marqués des noms de batême et de famille des propriétaires à qui apartiendront les maifons. Tous locataires des maifons des dites villes et faubourgs, auront une hache chez eux pour aider à jetter bas les maisons afin d'empêcher la communication du feu, et deux béliers de bois de dix pieds de longueur et cinq pouces de diametre, avec des barres de bois en croix à une diftance convenable les unes des autres, afin d'enlever les toits des maifons qui auront pris en feu, ou qui feront dans un danger éminent d'y prendre. Tous locaires de maifons des dites villes et faubourgs, auront autant d'échelles à chaque côté de leurs maifons qu'il y aura de cheminées ou rangs de cheminées, convenablement et furement attachées avec des crampons ou effieux de fer fur les toits, et des toits fur les fommets des cheminées, et elles feront placées de façon qu'il foit ailé d'en aprocher tant pour les ramoner que pour y porter de l'eau en cas d'incendie. If any houfe-keeper fhall, after the publication of this ordinance, keep or permit any hay or straw in any part of the houfe in which he lives; or fhall keep any afhes on a wooden floor, or in a wooden veffel, in the faid houfe, or in any outhoufe; he fhall forfeit the fum of Forty fhillings for every fuch offence, and likewife the hay or ftraw that fhall be found in any part of the dwelling-houfe. VI. It fhall be unlawful for any person, in either of the faid towns or fuburbs, to keep or heave at any time more than Twenty-five pounds of gun-powder in his houfe, or lodging, or in or lodging, or in any outhouse thereunto belonging; and the perfon in whofe dwel ling-houfe, lodging, ftable or other outhoufe, a larger quantity fhall be found, fhall forfeit the fum of Five pounds, together with the whole of the gunpowder. VII. It shall be unlawful for any person to build, or cause to be built, in either of Des or Cheminées the faid towns or fuburbs, any falfe chimneys, called in french Cheminées dévoyées or to dérovées to be built hereafter. No houfe to be with shingles, make or cause to be made or conftructed, any fire place at a diftance from the main chimney or chimneys of any houfe, and communicating therewith in a winding direc tion, for the purpose of discharging the fmoke through the flue of fuch main chimney or chimneys; and any períon offending herein, fhall for every chimney or fite place fo built, made, or conftructed, forfeit the fum of Ten pounds; and Five fhillings per day, as long as fuch chimney or fire place fhall be fuffered to ftand and remain; and every mafon, or other artificer, that fhall be employed in building fuch chimney or fire place, fhall forfeit the fum of Three pounds. And all chimneys or fire places of the above defcription, that are already built, fhall be taken down and removed, or effectually ftopt up, within fix months after the publication of this ordinance, under the penalty of One fhilling for every day they fhall remain unremoved, or not flop-ped up, after the expiration of the faid fix months; to be paid by the owner of the houfe to which fuch chimney or fire place fhall belong, VIII. No house or outhouse hereafter to be built or new covered, in either of the hereafter covered faid towns or fuburbs, fhall be covered with fhingles in any part, except over the garret windows, round the chimneys, at angles where two roofs may happen to join, and where the boards touch the end walls; under the penalty of Ten pounds, payable by the owner of fuch houfe, and a further penalty on the owner of Five fhillings for every day that any such house or out-house fhall continue covered with fhingles. IX. It fhall not be lawful hereafter, to build in either of the faid towns, any wooden dwelling houfe, under the penalty of Twenty pounds on the proprietor, and Ten pounds on the undertaker or contractor, and a demolition of fuch dwelling houfe; nor to make any fire in any wooden outhoufe, under the penalty of Forty fhillings.. X. V. Si quelque locataire de maison; après la publication de cette Ordonnance, garde ou permet de garder du foin ou de la paille dans aucune des parties de la maifon qu'il occupe, ou garde des cendres fur des planchers de bois ou dans des vaiffeaux de bois dans fa dite maison ou tout apenti, il encourra l'amende d'une fomme de Quarante fitellings pour chaque contravention, et en outre là confiscation du foin et de la paille qui feront trouvés dans aucune partie de fa maison. VI. Il ne fera permis à qui que ce foit; foit dans les dites villes ou dans les faubourgs, de garder ou d'avoir en aucun tems plus de vingt-cinq livres de poudre à tirer dans fa maifon ou apartement, ou dans aucun apenti en dependant; et le particulier chez lequel il en fera trouvé dans fes maifons, étables ou apenti une plus grande quantité, encourra l'amende d'une fomme de Cinq livres, et en outre la confifcation de toute la poudre qui s'y trouvera Aucunes chemi nées dévoiées ne venir. feront bâties a l'aAmende de ₤10 contre le proprié. taire et de 5 hellings par jour jufqu'à ce qu'elles foient changées. contre l'ouvrier. Il ne fera point permis à qui que ce foit de bâtir ou faire bâtir, foit dans les dites villes ou faubourgs, des cheminées dévoiées, ni faire ou faire faire et conftruire des foiers à feu ou forges auprès des maitreffes cheminées d'aucunes maisons, pour en faire paffer la fun:ée dans les dites maitresses cheminées. Et tout particulier Et tout particulier qui y contreviendra encourra par chaque cheminée ou foier à feu ou forge ainfi fait et conftruit, une amende de Dix livres et de Cinq fhellings par jour pendant le tems que de telles cheminées ou de tels foiers à feu ou forges fubfifteront; et tout maçon ou autre ouvrier qui fera emploié à la conftruction de tels foiers à feux ou forges, ou de telles cheminées, encourront l'amende d'une fomme de trois livres. Et toutes cheminées, et tous foiers à feu ou forges ci-deffus mentionnés qui font déja bâtis, feront jettés bas et changés ou fellés dans l'efpace de fix mois après la publication de cette Ordonnance, fous peine d'encourir l'amende d'Un fhelling par jour, jufqu'à ce qu'ils foient jettés bas, changés ou fellés après l'expiration des dits fix mois, qui fera paié par le proprié-s après le dit taire de la maison à qui telle cheminée, tel foier à feu ou forge apartiendra. VIII. Toutes maisons ou tous apentis qui feront bâtis à l'avenir, ou qui par la fuite demanderont de nouvelles couvertures, foit dans les villes ou faubourgs, ne feront point couverts en bardeaux fur aucunes parties, excepté fur les noues et lucarnes, l'entourage des cheminées et pour joindre les renvers contre les murs, fous peine de dix livres d'amende, qui fera paiée par le propriétaire de telles maisons et de tels apentis, et en outre fous peine de Cinq fhellings par jour, pendant tout le tems que telles maifons ou tels apentis continueront à être couverts en bardeaux. IX. Il ne fera point permis de bâtir à l'avenir dans aucunes des dites villes aucunes maisons en bois, à peine de l'amende d'une fomme de Vingt livres contre le propriétaire, et de celle de Dix livres contre l'entrepreneur ou ouvrier, et de démolition des dites maifons: ni de faire du feu dans aucun apenti de bois, fous peine de l'amende de Quarante shellings. For the better difcovering offences against this ordinance, the overseers fhall vifit all the houses in their respective towns, once in every three months, under the penalty of Five fhillings for every houfe they fhall neglect to vifit: and it shall be lawful for the faid overfeers, if they think fit, to vifit every houfe once a month, at any time between the hours of eight in the morning, and fix in the evening; and once a month if he every person refufing to admit the overfeer into his houfe, provided he has not vifited the fame within the space of one month then laft paft; or having admitted him, fhall refuse to produce to him the buckets, hatchets and fire-poles, or fhall refufe to fhew him the ladders which every houfe-keeper is bound to provide; or fhall prevent him from visiting any part of his dwelling houfe or outhouses, in order to enquire into and discover any offence that may be committed against this ordinance; such person fhall, for every fuch refufal, forfeit the sum of Five fhillings. tanks proper, Penalty for re fufing to admit him or to fhew him the buckets, &c. 55. All penalties and forfeitures incurred by any overfeer, for any offence against vering the penal- this ordinance, fhall be recovered by information before any one commiffioner of the peace of the district, in which the town, to which fuch overfeer belongs, fhall be fituated; who fhall hear and determine fuch information in a fummary manner, and upon the oath of one credible witness (being fome other than the informer) and fhall caufe fuch penalty or forfeiture, together with the cofts of fuing for the fame, to be levied by warrant to feize and fell the goods of the offender; one half of every fuch penalty or forfeiture fhall belong to the King's Majefty, and the other half to the informer. All penalties and forfeitures incurred by any other person than the faid oververing the penal feers, for offences against this ordinance, fhall be fued for and recovered by the overfeer for the town in which the offence fhall be committed, by information before any one commiffioner of the peace of the district, in which fuch town fhall be fituated; who |
