CHAPTER 216

AN ACT to appropriate the miscellaneous receipts for the purpose of furnishing proper terminals and facilities for barge canal traffic under chapter seven hundred and forty-six of the laws of nineteen hundred and eleven, and acts amendatory thereof and supplemental thereto.

Became a law April 1, 1925, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of one hundred and seven thousand one hundred and twenty-nine dollars and twenty-eight cents ($107,129.28), being the miscellaneous receipts from March fourth, nineteen hundred and twenty-four, to February twenty-fourth, nineteen hundred and twenty-five, on account of furnishing proper terminals and facilities for barge canal traffic under chapter seven hundred and forty-six of the laws of nineteen hundred and eleven, and acts amendatory thereof and supplemental thereto, is hereby appropriated for the purpose of furnishing proper terminals and facilities for barge canal traffic. No expenditure of such moneys shall be made without the approval of the governor, the chairman of the 1 senate finance committee and the chairman of the ways and means committee of the assembly, except for the payment of claims adjusted and judgments rendered according to law in connection with such improvement.

§ 2. This act shall take effect immediately.

CHAPTER 217

AN ACT making an appropriation for repairing the Delta dam, on the
Mohawk river.

Became a law April 1, 1925, with the approval of the Governor. Passed,
three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of twenty-five thousand dollars ($25,000), Approor so much thereof as may be needed, is hereby appropriated for priation. the repair of the Delta dam over the Mohawk river to insure the safety of such dam. The money hereby appropriated shall be expended for repair work only in connection with the expenditure of two hundred and twenty-five thousand dollars, which has been allotted from the barge canal funds for new construction work on such dam.

§ 2. The work provided for by this act shall be done by the Work, superintendent of public works, in accordance with plans and how to specifications prepared by the state engineer and surveyor; and no part of the money hereby appropriated shall be available, except for such plans and specifications, until a contract or con

tracts shall have been entered into by the superintendent of public works for the completion of such work within the amount hereby appropriated.

§ 3. This act shall take effect immediately.

CHAPTER 218

AN ACT making an appropriation for the expenses of the funeral of the late Leon De Mars.

Became a law April 1, 1925, with the approval of the Governor. Passed by a two-thirds vote.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of six hundred and fifty-three dollars and sixty-four cents ($653.64), or so much thereof as may be necessary, is hereby appropriated from any moneys in the state treasury not otherwise appropriated to re-imburse and pay Marshall W. Tebbutt and Sons for expenses and personal service in connection with the funeral of the late Leon De Mars, secretary of the legislative budget committee. The moneys hereby appropriated shall be paid out by the state treasurer on the warrant of the comptroller on vouchers approved by the speaker of the assembly.

CHAPTER 219

AN ACT making an appropriation for the supervision and inspection of summer and evening high schools and for holding regents' examinations therein.

Became a law April 1, 1925, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of twenty-five thousand dollars ($25,000.), or so much thereof as may be necessary, is hereby appropri ated out of any moneys in the state treasury not otherwise appropriated to pay the cost of supervising and inspecting summer and evening high schools in the cities and union free school districts employing superintendents, and of holding regents' examinations for pupils attending such schools, to be paid by the treasurer on the warrant of the comptroller issued upon the vouchers of the commissioners of education, in the same manner as other expenditures are made for the state department of education.

§ 2. This act shall take effect immediately.

CHAPTER 220

AN ACT making appropriation to the state fair commission for expenditures incurred for materials and supplies during the year ending December thirty-first, nineteen hundred and twenty-four.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. For the purpose of supplying the deficiency in appropriation made to the state fair commission for expenditures incurred for materials and supplies during the year ending December thirty-first, nineteen hundred and twenty-four, the sum of fifty-nine thousand four hundred and forty-eight dollars and @eighty-eight cents ($59,448.88), is hereby appropriated out of any money in the state treasury not otherwise appropriated. Such sum shall be paid out by the treasurer on the warrant of the comptroller on the certificate of the chairman of the commission. § 2. This act shall take effect immediately.

CHAPTER 221

AN ACT making an appropriation for the department of farms and markets to defray the expenses of such department, heretofore or hereafter incurred, for printing, advertising and supplies.

Became a law April 1, 1925, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. For the purpose of defraying the expenses of the department of farms and markets heretofore or hereafter incurred for printing and advertising, the sum of seven thousand dollars ($7,000), and for the purpose of defraying the expenses of such department heretofore or hereafter incurred for equipment, supIplies and materials, the sum of five thousand dollars ($5,000), or so much of such sums as may be necessary, are hereby appropriated out of any moneys in the state treasury, not otherwise appropriated, and shall be made available for such payment when this act takes effect. Such sums shall be paid out by the treasurer on the warrant of the comptroller on vouchers audited and approved in the manner provided by law.

§ 2. This act shall take effect immediately.

CHAPTER 222

AN ACT making an appropriation for the state's share of the cost of construction and improvement of the rural post roads within the state, pursuant to certain acts in congress which provide that the United States shall aid the states in the construction of rural post roads, and for other purposes, to be expended in accordance with article six-a of the highway law.

Became a law April 1, 1925, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of eight million dollars ($8,000,000) is hereby appropriated from any moneys in the state treasury not otherwise appropriated, to be expended for the payment of the state's share of the cost of construction or reconstruction of highways within the state, pursuant to certain acts of congress which provide that the United States shall aid the states in the construction of rural post roads and for other purposes in accordance with the provisions of article six-a of the highway law.

The moneys hereby appropriated shall be available also for the payment of preliminary engineering charges by the state in making surveys, and the preparation of necessary plans, specifications and estimates on such highways; for advertising, for overhead charges; for the purchase or exchange of automobiles; for traveling expenses of designated employees attending highway conferences; for membership dues in the American association of state highway officials, and for items disallowed by the federal government. The amount available for such construction or reconstruction for the fiscal year of the federal government ending June thirtieth, nineteen hundred and twenty-five, is three million six hundred and sixty-three thousand, one hundred and five dollars and eighty-six cents ($3,663,105.86).

The money hereby appropriated shall be expended in the construction or reconstruction of any state highway which is described and set forth in section one hundred and twenty of the highway law; for the construction of any county highway designated and described in section one hundred and twenty-two of the highway law; for the elimination or alteration of any railroad crossing as provided in section one hundred and sixty-seven-b of the highway law, and for reconstruction of any county highway.

The cost of the construction or reconstruction of such proposed federal aid highways for which the funds are made available by this act shall be borne as provided in article six-a of the highway law.

§ 2. This act shall take effect immediately.

CHAPTER 223

AN ACT making an appropriation for the construction of state and county highways as designated in sections one hundred and twenty and one hundred and twenty-two of the highway law, and for other purposes. Became a law April 1, 1925, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of three million dollars ($3,000,000) is hereby appropriated from any moneys in the state treasury not otherwise appropriated, to be expended for the payment of the state's share of the cost of construction of state and county highways designated and described in sections one hundred and twenty and one hundred and twenty-two of the highway law, and indicated on a map approved by chapter eighteen of the laws of nineteen hundred and twenty-one as amended. Moneys hereby appropriated, or so much thereof as may be necessary, shall be expended on those highways indicated on such map on which it is impracticable or inadvisable to secure federal aid, and shall be so allocated among the counties as to carry out as far as practicable the apportionment provided in section one hundred and twenty-one of the highway law, and the state's share of the cost of construction of any county highway improved from funds made available by this act shall be as provided in section one hundred and twenty-one. The moneys hereby appropriated, or so much thereof as may be necessary, shall also be available for the elimination or alteration of any railroad crossing on a state or county highway heretofore or hereafter to be constructed.

§ 2. This act shall take effect immediately.

CHAPTER 224

AN ACT making an appropriation for fire prevention and safety measures at certain state hospitals and state charitable institutions.

Became a law April 1, 1925, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The sum of one million dollars ($1,000,000) is hereby appropriated out of any moneys in the state treasury not otherwise appropriated, for the construction, purchase and installation of facilities and equipment for prevention of fire and of loss of life therefrom, in such state hospitals and state charitable institutions as may be designated by the state board of estimate and control. Such board of estimate and control shall apportion the amount of such moneys to be available for such purposes at each such hospital and institution designated by it and shall file with the state comptroller a statement of such apportionment, certified
