III. That every poftman or maître de pofle fhall fupport and keep four good and fufficient horfes at leaft, with the like number of good and fubftantial carriages; the caleches to be commodiously wide and long, and two of them at every polt-house to be mounted on iron creeks or fprings. That each poftman or maître de pofte fhall be allowed, and may retain, an affiftant or aide de pofte, who refpectively hall keep and support two good horfes, and the like number of fufficient carriages and barneffes. That each poftman or maître de pofte, together with two able fervants whom he fhall keep and fupport for the purpofe of driving the horfes and carriages as aforefaid; and alfo the affiftant or aide de pofte as aforefaid, fhall be exempted, are hereby freed and exempted, from all public fervice and duty, which by law otherwife they might be bound to perform: fuch fervices and duties always excepted, to which they are bound by the tenure of their land.

IV. That all and every postman, maître de pofte, affiftant or aide de poste as aforefaid, fhall immediately on demand, and without delay, furnish and provide for perfons fo journeying as aforefaid, horfes and carriages. And if any poftman, maitre de pofte, or aide, fhall delay or detain the perfon demanding any horfes, carriages, or faddle horfes as before mentioned, more than one quarter of an hour in the day, or half an hour in the night; or fhall not drive fuck horse or horfes, and the carriages fo hired as aforefaid, at the rate and diffance of two leagues for every hour at the leaft, provided the roads will permit; fuch poftman or afliftant fo neglecting as abovementioned, fhall forfeit and pay for every offence the fum of Ten fhillings.

V. That no maitre de pofte, or aide de pofte, fhall on any pretence whatever, pass or drive any carriage beyond the limits and diftance of his or their refpective fares and flages, without first having obtained permiffion fo to do from the next maitre de pofte, and to whose houfe his ftage and fare may end; under the penalty of One fhilling for each league which he or they may fo tranfgrefs to be recovered from, and paid by the maitre de pofte who fhall fo have tranfgreffed, to the maitre de pofte whofe permiffion and leave ought to have been obtained to drive and pafs as aforefaid. Provided always that whenfoever it may happen that all the horfes or carriages retained as aforefaid, at any post-house and the house of the aide or afliftant as aforefaid, fhall be employed, or abfent from their refpective stages; in fuch cafe any maitre de pofte, or aide de pofte fhall pafs, and he is hereby required, when demanded, to pafs and drive beyond the limits of his or their respective stages, without incurring the penalty abovefaid. And every maitre de pofte and his aide are hereby refpectively required to place and expofe to public view in his or their houfes an account of his and their lawful fare and diftance of road and ftage, which fuch maitre de pofte or aide may respectively drive as aforefaid, upon penalty of Five fhillings for every neglect.

VI.. In confideration of the advanced price of provender in the feveral towns of Quebec, Montreal and Three-Rivers, and in compenfation for the time they may lofe in attending at the respective houfes and lodgings of perfons taking the firft ftage: and alfo that the pofts of Quebec and Montreal are only employed in driving from the faid towns, it is enacted, that the maitres de pofte and the aide and affiftant as aforefaid, in the towns of Quebec and Montreal may demand and receive twentypence for each league for the hire of a horfe and carriage, whether the fame may carry one or two perfons; and for one horse and carriage from the town of Three-Rivers, One fhilling and four-pence per league; and in proportion for one or more horfes as is above-mentioned.

VII. That all and every ferryman, and perfon keeping a ferry, on the public roads in this province, fhall be provided with good and fufficient ferry-boats, bat

Que chaque maitre de pofte, avec deux bons domeftiques qu'il aura pour conduire les dits chevaux et voitures, ainfi que fon aide de pofte feront éxemts et font par ces préfentes libres et exemts de tous fervices publics auxquels ils peuvent être obligés par les loix ou autrement, à l'exception cependant des fervices et devoirs auxquels ils font tenus par les conceflions de leurs terres.

IV. Que tous et chacuns maitres de poste ou aides fourniront immédiatement et fans délai, à la demande des voiageurs, des chevaux et voitures, et que fi quelques maitres de pofte ou aides retardent ou retiennent les voiageurs qui demanderont des chevaux et voitures, ou des chevaux de felle plus d'un quart d'heure pendant le jour, ou d'une demie heure pendant la nuit, ou qui ne meneront point les dits chevaux et voitures de louage à deux lieues par heure au moins, lorfque les chemins le permettront, ils encourront et paieront pour chaque retardement une amende de Dix fhellings.

V. Qu'aucuns maitres ou aides de pofte ne pafferont fous aucuns prétextes, avec leurs voitures, les limites et diftances de leurs poftes, fans en avoir premierement eu la permiffion du maitre de pofte voifin, et de la maifon où finiffent fes limites, fous peine de l'amende d'Un fhelling par chaque lieue qu'ils pafferont hors de leurs limites, qui fera prélevée et paiée par les maitres ou aides de pofte qui auront contrevenu, au maitre de pofte dont ils n'auront point eu la permiffion de paffer la pofte; pourvû toujours que s'il arrivait, que tous les chevaux et voitures de toutes maifons de pofte ou d'aide de pofte fuffent emploiés, ou abfens de leurs diférentes poftes, en tel cas, tous maitres et aides de poste sont requis par ces préfentes de paffer les limites de leur pofte, à la demande des voiageurs, fans encourir la dite amende. Et que tous et chacuns maitres ou aides de poste font par ces préfentes requis d'afficher à la vue publique, dans leurs maisons, un état de leurs légitimes falaires, et de la diftance et de l'étendue du chemin de leur reffort, fous peine d'une amende de Cinq fhellings pour telle négli

VI. Qu'en confidération du plus haut prix des fourages dans les villes de Québec, de Montréal et des Trois-Rivieres, et en compenfation du tems qu'ils perdent à attendre aux diférentes maisons ou logemens de ceux qui prennent la premiere pofte, et auffi parceque les maitres de pofte de Québec et de Montréal font feulement emploiés à mener hors des dites villes, il eft par ces préfentes Statué, que les dits maitres et aides de pofte dans les villes de Québec et de Montréal pourront demander et recevoir vingt penneis par chaque lieue du louage d'un cheval et d'une voiture, foit qu'ils conduisent un ou deux voiageurs. Et que par chaque cheval et voiture de la ville des Trois-Rivieres, on paiera un fhelling quatre penneis par lieue; et en proportion pour un ou plufieurs chevaux, ainsi qu'il eft dit ci-dessus,

VII. Que tous et chacuns paffagers et autres qui auront des bacs fur des riviéres qui aboutiffent aux chemins publics de cette Province, fe pourvoieront de bons et folides bacs, bateaux ou canots qui feront néceffaires pour la commodité des dits voiageurs. Que les dits paffagers ne pourront, fons aucuns prétextes, retarder aucuns voiageurs fous peine d'une amende de Dix fhellings pour chaque retardement.

VIII. Que toutes et chacunes amendes impofées par cette Ordonnance feront et pourront être pourfuivies, fur le ferment d'un ou plufieurs témoins dignes de foi, de

VIII. That all and every the forfeitures and penalties by this ordinance impofed fhall and may be fued for, profecuted and recovered, upon the oath of one or more credible witness, and before any one of his Majefty's commiffioners of the peace; and fuch penalties and forfeitures levied by warrant under the hand and feal of any commiffioner of the peace as aforefaid, one half to be paid to the receiver-general for his Majefly's ufe, the other half to the profecutor.

IX. That this ordinance, and every article and claufe herein contained, fhall continue and be in force and effect, for and during the fpace of two years, and until the end of the feflions of the legiflative council which will be held according to the ftatute in the year of our Lord one thousand seven hundred and eighty-two.

For altering, fixing and eftablishing the Age of Majority. W the LA mich a prefent establishes the age of majority at twenty-five years, be it therefore enacted and ordained by his Excellency the Governor, by and with the advice and confent of the Legiflative Council of the province of Quebec, an 1 by the authority of the fame, it is hereby enacted and ordained, that from and after the first day of January which will be in the year of our Lord one thousand seven hundred and eighty three, the age of majority hall, to all and every intent and purpose whatfoever, be held, taken and confidered, in every part and place wherefoever within this province, to be at the age of twenty one years, to be computed from the day of the birth of any perfon whofoever; any law, ufage or cuftom to the contrary notwithstanding.

Qui change, fixe et établit l'age de majorité.

OMMIL peut s'élever plufieurs grands inconvéniens de la continuation de la loi, qui actuellement établit l'âge de majorité à vingt-cinq ans. qu'il foit, à ces caufes, ftatué et ordonné par fon Excellence le Gouverneur, de l'avis et confentement du Confeil Législatif de la Province de Québec, et par l'autorité d'icelui il eft par ces préfentes ftatué et ordonné, que du jour et après le premier Janvier de l'année de notre Seigneur, qu'on comptera mil fept cens qua re-vingt-trois, l'âge de majorité sera, à tous éards quelconques, tenû, pris et confidéré dans toutes cours et places que ce foient dans cette Province, être à l'age de vingt-un ans, à compter du jour de la naiffance de qui que ce puiffe être: nonobftant toutes loix, ufages et coutumes à ce contraires.

HEREAS it hath graciously pleased the King's moft Excellent Majefty, in his inftructions to his Excellency the Captain General and Governor in Chief of this province, to commit to the Legiflature thereof, the confideration of making due provifion for the fecurity of the perfonal liberty of his fubjects therein, and to fuggeft that, for that purpose, the Legislature could not follow a better example, than that which the common law of England hath fet, in the provifion made for a writ of Habeas Corpus which is the right of every British fubject in that kingdom: be it decla red and enacted by his Excellency the Captain General and Governor in Chief of this province, by and with the advice and confent of the Legiflative Council thereof, and by the authority of the fame it is hereby declared and enacted, that from and af ter the day of the publication of this Ordinance, all perfons who fhall be or ftand committed or detained in any prifon within this province, for any criminal or fuppofed criminal offence, shall of right be entitled to demand, have and obtain from the Court of King's Bench in this province, or from the Chief Juftice thereof, or from the Commiffioners for executing the office of Chief Justice refpectively or from any Judge or Judges of the faid Court of King's Bench, the writ of Habeas Corpus, together with all the benefit and relief refulting therefrom, at all fuch times, and in as full, ample, perfect and beneficial a manner, and to all intents, uses, ends and pur pofes, as his Majefty's fubjects within the realm of England, who may be or ftand committed or detained in any prifon within that realm, are there entitled to that writ, and the benefit arifing therefrom, by the common and ftatute laws thereof.

II. And for the prevention of delays which may be ufed by Sheriffs, Gaolers, and other officers and perfons, to whose cuftody any of the King's fubjects may be committed or detained, for criminal or fuppofed criminal matters, in making returns of writs of Habeas Corpus to them directed; it is hereby further declared, ordained and enacted, by the authority aforefaid, that whenfoever any perfon or perfons fhall bring any writ of Habeas Corpus, directed unto any Sheriff, Gaoler, Minifter, or other perfon whatsoever, for any person in his or their cuftody, and the faid writ fhall be ferved upon the said officer, or left at the gaol or prifon with any of the under-officers, under keepers, or deputy of the faid officers or keepers, that the faid officer or officers, his or their under-officers, under-keepers, deputies or other perfons, shall within three
